Method of Operation. Lessee covenants and agrees that when it commences operation in any coal leased herein it will thereafter diligently prosecute its operations hereunder utilizing modern mining equipment best suited for the prevailing mining conditions so as to develop thoroughly the coal herein leased and to conduct such operations in a careful, skillful, and workmanlike manner, and in compliance with the present and any future laws of the State of Illinois or any other applicable state and of the United States, and also according to the rules and practices of good mining and with due regard for the value of the Leased Premises as a coal producing property. Lessee shall be solely responsible for complying with all present and future laws and governmental regulations, including environmental laws and regulations, impacting on or controlling mining and related operations on the Leased Premises, which responsibility shall survive until final release of Lessee’s environmental reclamation bonds required by any regulatory authority or termination of this Lease, whichever shall last occur. If, as a result of Lessee’s operations hereunder, laws or governmental regulations are violated, or are claimed to be violated by the government, then Lessee shall indemnify Lessor and hold it harmless from any penalties, fines, costs, and expenses, including legal fees and court costs, imposed upon or incurred by Lessor as a result of said claim, violation or violations. Notwithstanding Lessee’s obligation to comply with all laws, rules, regulations and orders as set forth above, Lessor shall not declare a default hereunder solely as a result of routine operational violations which Lessee cures or abates as promptly as practical. Lessee shall be solely responsible for treatment of any water discharge caused by its operations, if required by present or future law or regulation, which responsibility shall survive until final release of Lessee’s environmental reclamation bonds required by any regulatory authority or termination of this Lease, whichever shall last occur. Lessee shall provide Lessor a permit map as a matter of information, in a format acceptable to Lessor, for any coal seams being permitted on the Leased Premises at the time of execution of this Lease and at the time of any subsequent permit submittal and at the time of any revisions and amendments thereof. Lessee acknowledges that Lessor holds the Leased Premises for the purpose of maximizing the royalty revenue generated therefro...
Method of Operation. The Organization may collect and receive money and contract for services subject to the provision of the Agreement from the parties and from any other sources approved by the Organization. The Organization may incur expenses and make disbursements necessary and incidental to the effectuation of the purposes of this Agreement. Funds may be expended by the Organization in accordance with procedures established herein. Upon Board approval, invoices shall be initialed by the chair or vice-chair for payment by the Organization office. Other legal instruments shall be executed on behalf of the Organization by the chair, vice-chair or an appointed Board member.
Method of Operation. The ARB shall review the accident reports and uphold or overturn the previous decision as to the preventability or non-preventability of the accident on the basis of those facts. The Board shall not assume the accident was preventable unless the driver refuses to cooperate with the investigation or fails to completely fill out an accident report as required by GCTD. The ARB will meet monthly as needed to review the accidents that occurred in the previous month.
Method of Operation. Scarify or loosen the areas requiring sod to a depth of 6 inches. Prior to sodding, thoroughly water the areas and allow water to percolate into the soil. Allow surface moisture to dry before sodding to prevent a muddy soil condition. Placesod immediately after ground preparation. Do not use sod, which has been cut for more than 72 hours. Stack all sod that is not planted within 24 hours after cutting and maintain proper moist condition. Do not sod when weather and soil conditions are unsuitable for proper results. Pre-wet the area prior to placing sod. Do not place sod on eroded or washed out sites. Place the sod on the prepared surface, with edges in close contact, and embed it firmly and smoothly by light tamping with appropriate tools. Place the sod to the edge of all the paving and shrub areas and 1 inch below adjoining pavement with an even surface and edge. Place rolled sod parallel with the roadway and cut any exposed netting even with the sod edge. Roll using a lightweight turf roller. Provide a true and even surface without any displacement of the sod or deformation. Where sodding in drainage ditches, stagger the setting of the sod pieces to avoid a continuous seam along the line of flow. Ensure that the offsets of individual strips do not exceed 6 inches. Tamp the outer pieces of sod to produce a featheredge effect. Peg sod at locations where the sod may slide. Thoroughly water the sod immediately after placing. The sod must be watered for four weeks and not in excess of 1 inch per week for establishment. The cost for sodding shall include the cost of materials, watering, fertilization, and installation. The sod must be warranted for thirty (30) days. At the end of the thirty day period an inspection will be performed and defective areas will be replaced by the Contractor at no additional cost to the County.
Method of Operation. Do not begin work until authorized, in writing, by the Engineer. Develop a work pattern from the locations listed in the work document, unless the Engineer designates the priority of the work. The blade of the edger must produce a clear sharp cut. The trench resulting from the actions of the cutting blade must not exceed one inch in width from the edge of the surface being edged. Do not allow grass or weeds into the trench. Sweep all debris (grass, weeds, soil, litter, etc.) from the curb and gutters, inlet throats and grates, sidewalk and sidewalk joints, and bike paths to produce a clean appearance. The use of blowers (away from traffic) (to be determined by the engineer) be allowed to remove the cuttings. Uniformly cut and remove all vegetation extending over the curb, sidewalk, bike paths, or other designated area to the back edge of the curb, sidewalk, bike path, or other designated area, including sidewalk joints. Removal of vegetation includes grass, weeds, or bushes up to one inch in diameter that extend beyond the normal grassed areas onto the curb, sidewalk, bike paths, or other designated areas. Remove and properly dispose of all debris produced by the edging, vegetation removal and sweeping operations from the job site daily. Do not stockpile or store debris on the right-of- way overnight. Dispose of all debris in accordance with Federal, State, and Local Rules and Regulations. Include the cost of vegetation removal, sweeping, and disposal of the debris, litter, soil and vegetation trimmings in the contract unit price for edging. Remove any debris that falls into any part of the storm water system at no additional compensation. Conduct all edging activities during daylight hours only, unless otherwise specified in the contract documents or approved by the Engineer. The Engineer may approve nighttime operations upon request, at no additional compensation for nighttime traffic control. The Engineer may restrict the hours of operations based on peak traffic hours, local conditions, or special events. Complete all required edging operations within the limits worked by the conclusion of each workday. In areas where access is blocked by parked vehicles or other obstructions, return to the area(s) to complete the edging as necessary at no additional expense to the Department. Method of Operation. The Joint Powers Board may collect and receive money and services subject to the provisions of this agreement from the member local governmental units and from any other sources approved by the Joint Powers Board and it may incur expenses and make expenditures and disbursements necessary and incidental to the effectuation of the purposes of this agreement. Funds may be expended by the Joint Powers Board in accordance with procedures established herein. Orders, checks, and drafts shall be signed by both the Chairperson or Vice-Chairperson and the Treasurer. Other legal instruments shall be executed on behalf of the Joint Powers Board by the Chairperson or Vice-Chairperson and the Secretary.

Method of Operation. 1. As soon as a request has been submitted to the Mediation Body, the secretary’s office informs the Chair of the nature and content.
2. The Chair and Deputy Chair consult to determine which of them will serve as acting Chair for the case.
3. Depending on the nature of the request, the acting Chair decides how many and which members will be asked to handle the complaint. In making this choice, the number of members nominated by FME must be the same as the number of members nominated by the trade unions.
4. The number of members dealing with the mediation request, including the Chair, will be three or five, this to be determined by the Chair.
5. If the group selected to deal with a mediation request feel the need to do so, they may present their opinion to the plenary Mediation Body for discussion before notifying the parties.
6. In all cases, the opinion of the group selected shall be the opinion of the Mediation Body.
7. The acting Chair and the members handling the complaint or dispute will be paid an amount to be determined by Consultative Council.
8. All documentation relating to the request will be provided to all members of the Mediation Body for their information.
