Nine Hour Break. An Employee shall, wherever practicable, be allowed a minimum break of nine consecutive hours off duty between the work of successive duties. Where an Employee receives less than the minimum break, the Employee shall be paid at time and a half rate for all hours worked after the break until the Employee is released from duty for a period of at least nine consecutive hours. This sub-clause shall not apply to Employees on call.

Nine Hour Break. (i) A break of at least nine continuous hours must be provided wherever possible between any two periods of duty. (ii) Periods of duty or more include: a. Periods of normal rostered work; or b. Periods of overtime that are continuous with a period of normal rostered work; c. Full periods of overtime/call back duty. (iii) This requirement to provide a break wherever possible applies whether or not any additional penalty payment will apply under the provisions of this clause. (iv) If a break of at least nine continuous hours cannot be provided between periods of qualifying duty, the duty is to be regarded as continuous until a break of at least nine continuous hours is taken and it shall be paid at overtime rates, with proper regard to time at which it occurs and the amount of overtime which precedes it. (v) The penalty payment provisions of this clause will not apply in any case where the result would be to give an employee a lesser payment than they would otherwise have received. (vi) Time spent off duty during ordinary hours solely to obtain a nine-hour break shall be paid at ordinary time rates. Any absence after the ninth continuous hours of such a break, if it occurs in ordinary time, shall be treated as normal absence from duty.
Nine Hour Break. 6.7.1 Where possible, employees are to be given an adequate break when working overtime between consecutive work days. 6.7.2 Employees will be given no less than nine (9) consecutive hours off duty between the end of their normal or rostered work on one day and the beginning of normal or rostered work on the next day. The break is exclusive of reasonable travel that is required for the employee to return home. 6.7.3 In cases where employees work overtime between 11.00 p.m. on one day and 5.00 a.m. on the next, then the nine (9) consecutive hour break will commence from the conclusion of their last period of overtime even if it continues after 5.00 a.m. The total overtime worked between 11.00pm and 5.00 a.m. must be not less than one and a half (1.5) hours in aggregate. 6.7.4 The arrangements as outlined above, will also apply when overtime is worked on Sunday or a public holiday prior to a rostered work day. 6.7.5 The safety of employees is most important and there may be circumstances where a nine (9) hours’ break may not be available but due to fatigue, it is determined that an employee should be given a break from work. In these cases, supervisors will have a discretionary right to provide additional paid time. 6.7.6 The provisions of this clause shall apply in the case of shift workers who rotate from one shift to another when overtime is worked.

  • Winter Break The Resident may apply to occupy a Room during the Winter Break period as detailed in Table 2. Winter Break applications will be made available to Residents by the Manager. Applications are due on or before December 1 at 5:00 p.m. If the Resident’s application is approved, they may be required to pay a small fee (detailed in Table 2) for Winter Break occupancy before the beginning of the Winter Break. During the Winter Break there is limited supervision of the Residence, all services are reduced or suspended, and annual maintenance and renovations may occur. To ensure the safety and security of the Resident and the Residence facilities it is the intention of the Manager to limit the number of Residents staying during the Winter Break to a small number of individuals that demonstrate a significant need for Residence accommodations. If the Resident is found occupying a Room during the Winter Break without having given written notice to the Manager, the Resident shall be subject to $30.00 for each day during the Winter Break period or $200.00 for the entire Winter Break, due immediately.   • H3 Break The Authority shall have the right to terminate the Contract at any time by giving three (3) Months’ written notice to the Contractor. The Authority may extend the period of notice at any time before it expires, subject to agreement on the level of Services to be provided by the Contractor during the period of extension.

  • Minimum Break between Shifts (a) Where it is necessary to work extended overtime, it is agreed that no Employee shall resume or continue to work without having had ten consecutive hours off duty between the termination of the overtime and the commencement of the Employee’s ordinary work on the next day or shift. (b) In the event that an Employee agrees to a request from site management to resume or continue to work without having had ten consecutive hours off duty, the Employee shall be paid at double ordinary time rates until the Employee is released from duty for such period.

  • Other Breaches The breach by such Borrower (other than a breach which constitutes a Default with respect to such Borrower under another Section of this Article VII) of any of the terms or provisions of this Agreement which is not remedied within 15 days (or, in the case of Section 6.9, five Business Days) after the chief executive officer, the chief financial officer, the President, the Treasurer or any Assistant Treasurer of such Borrower obtains actual knowledge of such breach.

  • Lunch Breaks The lunch break will consist of a one-half hour (or one hour where scheduled) unpaid break taken mid-way during regular work day. In the event that an employee is required to work during his regular lunch period he shall be allowed a one-half hour lunch period between the hours of ll:30 a.m. and l:00 p.m., otherwise he shall be paid double time for working through said lunch period.

  • Lunch Break Each Teacher shall receive each day an uninterrupted and continuous period of not less than forty (40) minutes for lunch, free from supervisory, teaching or other assigned duties (reference: Regulation 298.s. 3, Daily Sessions).

  • Coffee Breaks The Company will provide two (2) fifteen (15) minute coffee breaks during each work day, one in the morning and one in the afternoon.

  • Service Hours The services shall be provided during the working hours and days as defined by the Contractor.

  • Tea Breaks (a) Every employee will be entitled to a paid 10 minute tea break in each four hours worked at a time to be agreed between the employee and employer. (b) Subject to agreement between the employer and employee, such breaks may alternatively be taken as one 20 minute tea break. (c) Xxx breaks will count as time worked.

  • Minimum Hours All employees shall be paid their regular hourly rate for each hour worked except where employed for less than four (4) consecutive hours per day, in which event they shall receive a minimum of four (4) hours pay. An employee who is called for work and upon reporting finds that his or her services are not required shall receive two (2) hours pay.
