NO STRIKE OR. The Employer agrees that it will not cause or direct a lock-out of its employees, and the Union agrees that there will be no strike or other collective action that will stop, curtail or interfere with work or the Employer's operation. The meaning of "strikes and lock-outs'' shall be as defined in the Ontario Labour RelationsAct. ARTICLE LEAVE OF ABSENCE Union Conventions, Workshops and Seminars: Leave of absence without loss of seniority shall be granted upon request to the Employer, to employees who are readily replaceable and who are elected or appointed to represent the Union at Union functions. The Employer shall pay the employees their normal wages. while on such leave, and the Union shall reimburse the Employer.
NO STRIKE OR. For the duration of this Agreement: a) The Union agrees that there will be no strike as defined in Section I, Chapter Definition of the Manitoba Labour Relations Act, taken by the employees represented by the Union, and if such action should be taken by the employees, the Union will instruct the said employees to return to work and perform their usual duties forthwith and to resort to the grievance procedure established herein for the settlement of any complaint or griev- ance. When an employee is asked to perform work outside regular classification for a period exceeding three days, shall receive the rate of the job or own regular earned rate, whichever is greater. Any new rate of pay shall be effective the first day the employee commenced duties In the new classification. An Educational Assistant .who replaces the regular teacher who is absent for a temporary shall, subject to qualifications, be the occasional teachers rate for each day the teacher is absent. Except for mutual consent, no employee shall be transferred outside of a radius of thirty-five kilometres from current work location.
