Labour Relations Act. (b) If the time allowance, or any extension thereof, is not observed by the party who it has alleged has violated the Agreement, the grievance may be advanced by the Party instituting the grievance to the next step of this procedure including Arbitration.
Labour Relations Act. By mutual agreement the parties may elect to have a single arbitrator hear the matter in dispute instead of a three-person board. In such case, the party wishing to submit the issue to arbitration should indicate in its notice of intent to arbitrate, that it would like the matter heard by a single arbitrator. The recipient of the notice shall inform the other party within seven calendar days of receipt of the notice if it is agreeable or not to the matter being heard by a single arbitrator. If so, the parties shall endeavour to select the single arbitrator. Failing agreement within thirty days of such time as agreed by the parties clause 9.01 shall be followed. The single arbitrator shall be bound by all clauses of Article 9 in the same manner as a Board of Arbitration with the necessary changes being made.

Labour Relations Act. Any initiated and being processed under the terms of a Collective Agreement between the Teachers and a predecessor Board shall be dealt with under the grievance and arbitration procedure as set out in the Collective Agreement under which the grievance was initiated.
