Order of Lay-off. Teachers shall be laid off in reverse order of seniority subject to qualifications. For clarity: lay-off may be full or partial.
Order of Lay-off. 17.2.1 Within each class to be vacated, employees shall be laid off in the following order:
17.2.1.1 Probationary employees whose last overall performance rating was less than standard;
17.2.1.2 Other probationary employees;
Order of Lay-off. Members shall be laid off in reverse order of seniority.
Order of Lay-off. Members who are to be laid off under this Article shall be laid off in the following order:
(a) Non-renewal of Sessional Contracts
(b) Those holding Continuing Sessional Appointments
(c) Those holding Limited Term Contracts
(d) Those holding Tenure-Track Appointments
(e) Those holding Tenured Appointments Layoffs shall occur according to length of service at the University so that those with least seniority within each affected department or program are laid off first. Length of service shall be from the date of becoming a bargaining unit member at the University.
Order of Lay-off. 17.4.1 The employee with the least seniority in the affected job class (i.e. with the most recent date of hire in that class) shall be laid off first.
17.4.2 If two or more employees share the same date of hire within the affected job classification, the following tie breaker criteria will be used to determine the order of layoff:
(a) District date of hire – the first date of hire in any regular probationary position in the District will be used to establish seniority.
(b) If two or more employees are still equal in seniority, the determination shall be by lottery. District HR staff and a CSEA Executive Board Member or designee will participate in the lottery where names will be drawn. The first name drawn will be awarded the highest seniority ranking, the second name drawn will be ranked next, etc.
(c) Employees who have been employed the shortest time in the class, plus higher classes, shall be laid off first. Employees affected by lay off may exercise bumping rights in an equal or lower class in which they have previously served if their seniority is greater than that of the least senior person in the class. Displaced employees shall receive not less than sixty (60) days prior notice, as described above, by personal service or certified mail.
Order of Lay-off. In case it becomes necessary to reduce the workforce for a period of three (3) days or more, the lay-off procedure will be as follows:
(i) Probationary employees shall be laid off first provided that regular employees remaining can satisfactorily perform the required work.
(ii) Next, regular employees will be laid off in order of seniority provided that employees who are remaining can satisfactorily perform the required work.
(iii) For unforeseen emergency shutdowns of less than three
Order of Lay-off. In the event there is a reduction in personnel, lay-offs will be by classification within the affected department. The following is the order in which employees will be laid off:
A. Temporary part-time employees B. Temporary full-time employees
Order of Lay-off. Once the College has determined the reasonable rationale for faculty workforce reduction, the College shall decide which department(s) within a division and the number of positions that shall be affected by the reduction. The following process shall apply when a reduction in faculty workforce is necessary:
A. Identify, with documentation, the division and department(s).
B. Identify, with documentation, the number of faculty affected in each of those departments.
C. Prior to initiating a reduction in force of full-time faculty members, the College shall lay-off individuals within the affected division and affected program/departments in the following order:
Order of Lay-off. The Employer agrees that should any lay-offs occur, the Employees to be affected shall be decided by the department head, taking seniority and job qualifications into consideration. Seniority shall mean each person’s respective seniority on this project only, with permit members being the first to be laid off, and members of the Union being the last Employees to be laid off, provided such Employee has the ability to perform the remaining work
Order of Lay-off. Where lay-off is required, the order of lay-off shall be by reverse seniority as follows:
1) term employees, in reverse order of seniority; then
2) probationary employees, in reverse order of seniority; and then
3) permanent employees, in reverse order of seniority. In order to exercise seniority rights, employees must be qualified to perform the functions of the remaining position(s) which is most nearly equivalent to their former positions.
