Organization Representatives. The City will recognize employee representatives designated by the Union as the grievance representatives of the bargaining unit having the duties and responsibilities established by this Article. The Union shall notify the City in writing of the names of such employee representatives and of their successors when so designated.

A written list of the Union Representatives shall be furnished to the employer immediately after their designation and the Union shall notify the employer of any changes in the list which occur from time to time. Time spent by Union Representatives in handling grievances or attending meetings with City Representatives shall be without loss of pay provided Union Representative notifies his/her Department Head and provided that such time does not exceed two (2) hours per week. Time spent by Union President and/or Vice President in handling grievances or attending meetings shall not be subject to the two-hour limit provided the Department Head is notified and such time is reasonable. Coordination with the President’s and/or Vice President’s supervisor is required. Union Representatives will notify their Department Head and Human Resources in writing of actual time spent on union business. Union Bulletin Boards will be added to the following work areas for accessibility for Union Members and maintained by the Chief Xxxxxxx. These bulletin boards will be secured boards with sliding glass doors and be able to be locked. Keys for these bulletin boards will be held by both the Union and the Human Resources Department and all postings must be approved by Human Resources prior to posting. The cost of these boards will be shared 50%-50% by the City and the Union. Areas for Union bulletin boards will be as follows:

LELS shall notify the City inwriting of the names of such employee representatives and their successors when so designated.

The City agrees to grant paid leave of absence to employees at any given time to attend conventions, training and/or meetings of Delaware Public Employees AFSCME COUNCIL 81 and/or AFSCME International. The Union agrees to notify the Human Resources Department and the Department Head in writing at least seven (7) calendar days prior to the commencement of such leave. This leave shall not exceed one hundred twenty (120) hours, to be used in increments of no less than one (1) hour, for the entire bargaining unit during any three (3) consecutive contract year period. Two representatives from the Union will be included on the Safety Committee, when such program exists.

District employees who are official representatives of the Organization shall be given reasonable time off with pay to attend meetings with District management representatives, or to be present at hearings where matters within the scope of representation or grievances are being considered. The use of business time for this purpose shall be reasonable and shall not interfere with the performance of District services as determined by the District. Such employee representatives shall submit a written request for excused absence to their Supervisor, with an information copy to their respective Department Managers and the Human Resources Director, at least two (2) working days prior to the scheduled meeting whenever possible. Except by mutual agreement, the number of employees excused for such purposes shall not exceed three (3). Reasonable access to employee work locations shall be granted officers of the Organization and their officially designated representatives for the purpose of processing grievances or contacting members of the Organization concerning business within the scope of representation. Such officers or representatives shall not enter any work location without the consent of the General Manager or where the Authority has been delegated by the General Manager, the General Manager’s representative. Access shall be restricted so as not to interfere with the normal operations of the department or with established safety or security requirements. Organization membership activities shall not be conducted during work time.

The use of official time for this purpose shall be reasonable and shall not interfere with the performance of County services as determined by the County. Such representatives shall submit written requests for excused absences to Employee Relations at least two working days prior to the scheduled meeting whenever possible. Except by agreement with Employee Relations, the number of employees excused for such purposes shall not exceed three at any one time. If any employee's request for excused absence is not approved, such disapproval shall be subject to appeal to the County Manager whose decision shall be final.
