Powers and Functions. 4.1. The Board is established under section 9EB of the Local Government Act 2000 and Parts 2 and 4 of the Local Authorities (Arrangements for the Discharge of Functions) (England) Regulations 2012, and section 101(5) of the Local Government Act 1972 enabling the Parties to perform the functions in the manner set out in this agreement. 4.2. The Board has the power to take decisions on behalf of the Parties in relation to those functions set out in Schedule 1. The role of the Board is restricted to those matters described in Schedules 1 and 2. The Board may only exercise those functions delegated to it by the parties and the Board reserves the right to refuse the delegation. The delegation of functions to the Board may be amended or withdrawn by resolution of any of the Parties. Where any such resolution affects any financial liabilities and/or commitments of the Board twelve months notice must be given in writing not later than 31 March in any year to withdraw with effect from 1 April in the following year from any of the functions of the Board.

Powers and Functions. The Executive Council shall be the executive organ of the Organization. It shall be responsible to the Conference. It shall carry out the powers and functions entrusted to it in accordance with this Treaty. In so doing, it shall act in conformity with the recommendations, decisions and guidelines of the Conference and ensure their continuous and proper implementation.

Appoint an employee or an officer to be treasurer or controller or both; h. Acquire, construct, manage, maintain or operate any building, works or improvements; i. Take by grant, purchase, devise, or lease, or condemn in proceedings under eminent domain or otherwise acquire, and hold and enjoy, or lease, mortgage, sell or otherwise dispose of any real and personal property of every kind necessary for or incidental to the exercise of its powers; j. To raise revenue, to levy and collect taxes, fees and charges, and to issue bonds, notes, warrants, and other evidence of indebtedness to finance costs and expenses incidental to the purpose of ECCTA; k. To insure itself and the parties from loss, liability, and claims arising out of or in any way connected with the performance of this Agreement; and l. Xxx and be sued.
Powers and Functions. The functions, responsibilities, and powers of Council shall be as follows: (a) To perform the functions of a Transportation Management Area (TMA) for the metropolitan area, which includes those functions set forth in the MAP- 21 legislation of July 6, 2012, and related rules, as amended to implement MAP-21 as well as those functions, which may be required hereinafter by subsequent Federal Transportation legislation. (b) To perform the functions of a Metropolitan Planning Organization (MPO) as set forth in Title 00 Xxxxxx Xxxxxx Xxxx xxx Xxxxx 00 Xxxxxx Xxxxxx Code as currently adopted or as amended, and 23 CFR Parts 450 and 500 and 40 CFR Part 613, as currently adopted or as amended. (c) To perform the functions of a Regional Transportation Planning Organization (RTPO) as set forth in Ch. 47.80 RCW and Ch. 468-86 WAC, as currently adopted or as amended. (d) To prepare and update a Metropolitan Transportation Plan pursuant to 23 CFR Parts 450 and 500 and 49 CFR Part 613. (e) To engage in regional transportation planning. (f) To administer regional transportation funding programs and consider those projects which have been approved by the governing bodies of the Members and which are incorporated within the adopted Metropolitan Transportation Plan. (g) To participate in the development and maintenance of transportation related information necessary to support the functions and responsibilities of the Council. (h) To promote the regional transportation interests, plans and projects to local, state and federal public and private entities. (i) To contract with the WSDOT or other appropriate entities in order to meet requirements of State and/or Federal Transportation legislation. (j) To create committees as necessary, to advise the Board on regional transportation related matters. At a minimum this shall include: a. the Transportation Advisory Council (TAC) whose composition and responsibilities shall be defined by the Board. b. the Transportation Technical Committee (TTC) whose composition and responsibilities shall be defined by the Board. (k) To comply with the Transportation Planning requirements set forth in the Washington State Growth Management Act, and Ch. 47.80 RCW, consistent with Spokane County County-wide Planning Policies. Powers and Functions. YECA shall have the common power of the parties as set forth in Section 2 above, and in the exercise of the power under this Agreement, YECA is authorized in its own name to: 5.1 Employ agents and employees, establish salaries and benefits, and contract for professional services; 5.2 Make and enter into contracts; 5.3 Incur debts, obligations, and liabilities; provided, however, the debts, obligations and liabilities incurred by YECA shall not be, nor shall they be deemed to be, debts, obligations, or liabilities of any party; 5.4 Acquire, hold and convey, construct, manage, maintain and operate buildings and improvements; 5.5 Accept contributions, grants or loans from any public agency, or the United States or any department, instrumentality, or agency thereof, for the purpose of financing the planning, acquisition, construction, maintenance, or operation of facilities and/or services. YECA may also accept contributions, grants, or loans from other than the foregoing sources; 5.6 Invest surplus money in the County Treasury, as provided in Section 10 of this agreement, that is not needed for immediate necessities, as the Board determines advisable, in the same manner and upon the same conditions as other local entities in accordance with Section 53601 of the Government Code; 5.7 Purchase insurance, join insurance pooling programs and/or develop and maintain a self-insurance reserve; 5.8 Do all other acts reasonable and necessary to carry out the purpose of this Agreement; and 5.9 Sue and be sued. 5.10 Render communication services and other assistance to the Yolo County Office of Emergency Services (OES) and to state or federal emergency agencies at the request and direction of the OES or County Administrator in emergency situations. YECA shall be held strictly accountable for all funds received by, held and disbursed by it. 5.11 Assess and collect fees, taxes, assessments and/or special assessments as allowed by law. 5.12 The powers to be exercised by YECA are subject to such restrictions upon the manner of exercising such powers as are imposed upon the County of Yolo in the exercise of similar powers. 5.13 YECA shall be held strictly accountable for all funds received held and disbursed.

Powers and Functions. (1) The Joint Authority shall control all exploration and exploitation of the non-living natural resources in the Joint Development Area and shall be responsible for the formulation of policies for the same. (2) Without prejudice to the generality of the foregoing, the powers and functions of the Joint Authority shall include the following: (a) to decide, with the approval of the Governments, on the organizational structure of the Joint Authority; (b) subject to subparagraph (a), to appoint the chief executive officer and other officers of the Joint Authority, provided that the appointment of the chief executive officer and the deputy chief executive officer shall require the approval of the Governments; (c) to decide on the terms and conditions of service of the chief executive officer and other officers of the Joint Authority; (d) to decide on the plan of operation and the working programme for the administration of the Joint Development Area; (e) to permit operations and to conclude transactions or contracts for or relating to the exploration and exploitation of the non-living natural resources in the Joint Development Area subject to the approval of the Governments; (f) in respect of any contract referred to in subparagraph (e) for the exploration and exploitation of petroleum (i) to approve and extend the period of exploration and exploitation; (ii) to approve the work programmes and budgets of the contractor; and (iii) to approve the production programmes of the contractor, including the production costs, conditions and schedules of the production; (g) in respect of an operator of any contract referred to in subparagraph (f) (i) to inspect and audit the operator’s books and accounts relating to its operations in the Joint Development Area; (ii) (ii) to take periodic inventories of the properties and assets procured by the operator for petroleum operations; and (iii) to receive, collate and store all data supplied by the operator relating to its operations in the Joint Development Area; (h) to approve and award tenders and contracts relating to goods and services required in carrying out petroleum operations in the Joint Development Area; (i) to appoint committees, sub-committees or independent experts and consultants where necessary for the administration of the Joint Authority; (j) to regulate any meeting of the Joint Authority, any committee and sub-committee thereof; and (k) to do any other thing incidental to or necessary for the performance of a...
