RESPONSIBILITIES OF THE COUNCIL. The Judicial Council will provide to the Criteria Architect complete information regarding the Judicial Council’s requirements for the Project. The Judicial Council will provide to the Criteria Architect a legal description of the Project site and all reports, surveys, drawings, and tests in the Judicial Council’s possession that concern the conditions of the Project site. The Judicial Council will examine the documents submitted by the Criteria Architect and will render decisions so as to avoid unreasonable delay in the process of the Criteria Architect’s Services. The Project Manager will be available during normal business hours and as often as may be required to render decisions and to furnish information in a timely manner.

RESPONSIBILITIES OF THE COUNCIL. 18.1. The Council will provide to the Construction Manager complete information regarding the Council’s requirements for the Project. 18.2. The Council will provide to the Construction Manager a legal description of the Project site and all reports, surveys, drawings, and tests in the Council’s possession that concern the conditions of the Project site. 18.3. The Council will examine the documents submitted by the Construction Manager and will render decisions so as to avoid unreasonable delay in the process of the Construction Manager’s Services. 18.4. The Council will retain design professional(s) whose services, duties and responsibilities will be described in written agreement(s) between the Council and design professional(s). 18.5. The Project Manager will be available during normal business hours and as often as may be required to render decisions and to furnish information in a timely manner.
RESPONSIBILITIES OF THE COUNCIL. 6.1 The Council’s designated officer, or their agreed representative will liaise with the designated lead officer of the Friends of Tower Hamlets Cemetery Park, to develop the partnership approach, and for the purpose of monitoring the level and quality of service provided under the terms of the Agreement. 6.2 The Council will meet with the Friends At least six months prior to the end of this agreement in order to agree arrangements for the following three year period. The Council will pay the agreed level of funding to the Friends in accordance with section 1.4 of this agreement. 6.3 The Council retains overall responsibilities as freeholder of the Cemetery Park and will maintain a minimum of £5million public liability insurance for the site. 6.4 The Council will advise the Friends in advance of any events, activities or maintenance operations planned for the Park
RESPONSIBILITIES OF THE COUNCIL. 6.1 The Council’s designated officer, or their agreed representative will liaise with the designated lead officer of the Trust, to develop the partnership approach, and for the purpose of monitoring the level and quality of service provided under the terms of the Agreement. 6.2 The Council will meet with the Trust at least six months prior to the end of this agreement in order to agree arrangements for the following three year period. The Council will pay the agreed level of funding to the Farm in accordance with section 1.4 of this agreement. 6.3 The Council retains overall responsibilities as freeholder of the Mudchute Park and will maintain a minimum of £5million public liability insurance for the site. 6.4 The Council will advise in advance of any events, activities or maintenance operations planned for the Park.
RESPONSIBILITIES OF THE COUNCIL. The Council’s primary responsibilities shall be: i. To determine terms, election procedures and other matters necessary to future composition of the Council. The Council shall elect its replacement members. ii. To establish regular meetings, special meetings and meeting protocol, as a Council and with WSCN. iii. To report as necessary to the other Participating Municipalities. iv. To establish meetings and protocol for taking actions on behalf of the Council. v. To develop and establish a conflicts of interest policy for Council members. vi. To select the annual financial auditor for the Program Funds, together with the concurrence of WSCN, vii. To select the transaction compliance reviewer for the Program Funds, together with the concurrence of WSCN, viii. To advise WSCN on rules and proposed changes to rules for the Approved Programs, ix. To establish criteria for projects that may be located outside of the Service Area, however provide economic development advancements to the Service Area, and thus to consider and/or approve or deny WSCN’s participation in said projects, x. To establish criteria to consider and approve or deny proposals or requests from new Wyoming municipalities, counties and/or organizations who desire to become actively involved in the Approved Programs which in turn enable WSCN to better serve Wyoming, the Service Area and its economic development efforts, xi. To receive reports from the WSCN, including reports of possible conflicts of interest, xii. To consider waiver requests for any contracted obligation of the Manager or WSCN on behalf of all Participating Municipalities, xiii. To advise WSCN on any other matters brought by the Managers, and xiv. To establish other bylaws, policies or rules as deemed necessary by the Council to better govern and manage the Council’s affairs and operations.
RESPONSIBILITIES OF THE COUNCIL. On behalf of each and all parties hereto, the COUNCIL powers shall include, but not be limited to the following: A. Providing overall governance for implementing the provisions of the ACT and Regulations for the WDA to include creation of, and appointment of all members to, the REGION 2000CENTRAL VIRGINIA WORKFORCE DEVELOPMENT BOARD, hereinafter referred to as the “BOARD”. B. Approving policies, priorities, goals, and objectives of the BOARD and the programs and services to be provided by the BOARD, either directly or by contract with political subdivisions or public or private service providers. C. The COUNCIL, in partnership with the Board, shall submit to the Governor a regional strategic workforce development plan that meets the requirements in Section 108 of the ACT. D. The COUNCIL shall approve the Board budget annually and receive the BOARD’s annual report. E. The COUNCIL shall enter into an agreement with the BOARD that clearly details the partnership between the two entities for the governance and oversight of activities under the ACT.
RESPONSIBILITIES OF THE COUNCIL. The Council is responsible for: (a) Keeping the Structure and exterior of the building ion good repair, including gutters, drains and external pipes. (b) Keeping in good repair and proper working order the Council’s installations for space, heating, water heating, drainage and sanitation for the supply of water, gas and electricity. (c) In the case of flats, taking reasonable care to keep common entrances, halls, stairways, lifts, passageways, rubbish chutes, lighting and all other common parts in reasonable repair. (d) Carrying out those repairs which are the Councils responsibility within the current time limits. (e) Making reasonable arrangements to keep tidy all external communal spaces and communal xxxxxx on its housing estates. (f) Decorating the exterior and communal parts of the interior every five years. These obligations are subject to the Council’s right to make good and charge the tenant for wilful damage or neglect caused to the premises and communal amenities where provided. The Council shall: (g) Enquire into the reasons for failure to pay the rent and other charges due, and shall take all reasonable steps to provide financial counselling before going to Court to recover the money owed. (h) Provide information on Council policy on transfers and re-housing. (i) Ensure that tenants receive the current edition of the Tenants’ Charter. (j) Give Tenants 4 weeks notice before increasing the net rent; 1 week’s prior notice before increasing the district heating charge. (k) Consult tenants on any proposed alteration in tenancy conditions and give 4 weeks notice of any alteration. (l) Give 24 hours notice in writing of any visit to the premises to inspect, if a repair or inspection is being carried out other than in response to a request from the tenant. As an exception to this, an employee or agent of the Council may enter without notice if there is an emergency which might result in personal injury or damage to the tenant’s home or to neighbouring properties. Provide Warden Services as listed below: (m) Daily intercom checks. (n) Daily visit to those identified as being at risk. (o) Assistance with repairs reporting as appropriate. (p) Getting involved in Tenants Associations, Coffee Mornings etc. (q) Welfare Benefits advice. (r) Co-ordinating services and liaising with either statutory or non statutory agencies to ensure your welfare.

RESPONSIBILITIES OF THE COUNCIL. The Council’s responsibilities are as narrated in the Agreement and in this the Schedule, Part 2, Service Specification as follows: • The Council will provide support and advice from an Early Years Locality Leads with the specific remit to work with the Provider. • The Council will provide support to address quality improvement and development areas identified by any regulatory agency inspections or Council representative visits; • The Council shall ensure that the Council’s continuing professional development training programme for Early Learning and Childcare is available and open to Providers. • The Council shall ensure that the Provider is included in relevant and appropriate Council meetings.
RESPONSIBILITIES OF THE COUNCIL. 1. The Council will ensure that the Accommodation is developed and maintained in accordance with this Agreement, that service users are protected, and that contract monitoring arrangements are set up. 2. The Council will be responsible for the co-ordination of the assessment, allocation and care planning of Service Users. 3. Subsequent to initial placements the Council will be responsible for all nominations of Service Users requiring Accommodation from the Housing Provider. All nominations will be submitted on a copy of the form which is attached to Appendix ‘3’ and considered by the Nominations Panel. The final decision as to who will use the Service will be subject to agreement between the Nominations Panel and the Service Users or their representatives. 4. The Council will make Capital payments allocated to the scheme by the Council by BACCS, 50% prior to completion and 50% on receipt of the Certificate of Practical Completion referred to in Clause of the Agreement 5. The Council will employ and pay the revenue costs for the care and support staff operating in the scheme, and all operational decisions relating to the Support and Care Staff. 6. The Manager responsible for the care and support provided in the Accommodation will, after the first six months of the placement, carry out a review of service user needs. 7. Develop a close and open working relationship with compatible working practices and to promote mutual co-operation and regular consultation. 8. Ensure that the Accommodation and the provision of support are managed in an efficient and competent manner at all times. 9. Develop and implement formal procedures to resolve and conciliate about any complaint, disagreement or dispute which shall arise between them. 10. Assist each service user to maximise their income by making them aware of relevant welfare and housing benefits and allowances which they should claim. 11. Support and encourage each service user to claim state benefits and allowances by: 11.1. Providing Service Users with assistance in the completion and posting of the requisite claim forms and all other necessary paperwork 11.2. Ensuring Service Users have access to appropriate advice and support relating to the appeal procedure in the event that their benefit entitlement is withheld or restricted 11.3. Facilitating the access of Service Users to advocacy services and other support services where available.
RESPONSIBILITIES OF THE COUNCIL. 1.1. To ensure support and advice in relation to all aspects of Direct Payments is made available when requested. 1.2. To make Direct Payments at an amount estimated by the Council as a reasonable cost for securing adequate services in order to meet the assessed eligible needs as outlined in your Support Plan. 1.3. To financially assess you to determine the amount of money you will be required to contribute to your personal budget (‘the contribution’). 1.4. To pay the net Direct Payment (less the contribution) into the Prepaid Card Account or nominated Direct Payments Account at the agreed frequency, or as a one off payment (unless you have a holding account with a managed payroll service, in which case the gross amount will be paid). 1.5. To review the Direct Payments within the first 6 months and then at least annually thereafter, or sooner if the need arises. 1.6. To increase or decrease the amount of Direct Payments paid at any time following a review of your needs which results in the revision of your Support Plan and to give you appropriate notice of any changes. 1.7. To allow you to keep a balance on the Direct Payments Account not exceeding eight weeks payments of Direct Payments to help meet your needs in a flexible way. If you require more than eight weeks surplus you must discuss with us the reasons why this is required. 1.8. The Council may retain the Direct Payments if you are temporarily unable to receive services, for example; in the event of a hospital admission. 1.9. To arrange alternative support in the event of arrangements for care and support obtained via a Direct Payment breaking down. 1.10. To potentially reduce the Direct Payments or suspend or terminate this Agreement if: a) You are no longer eligible to receive a Direct Payment b) The Council consider the arrangements you make are inadequate to ensure your safety c) You do not meet the terms and conditions of this Agreement 1.11. In the event of the Direct Payment recipients death the Council will consider what contractual responsibilities existed at the time of death when determining what sum is to be repaid to the Council. Any monies held in the Direct Payment recipients Direct Payments account will not form part of the Direct Payment recipient’s estate. If expected monies are unpaid the Council may make a claim against the Direct Payment Recipient’s estate.
