Program Parameters. 1. It is understood that this program shall terminate if for any reason it is not fully funded through AB1X (1999, Villaraigosa) or successor legislation. 2. This Program shall not deal with teachers’ employment issues which arise from accusation or neglect of duty or misconduct which are distinct from teachers’ evaluations as defined in B of this Agreement. 3. The functions performed by the PAR Panel and Consulting Teachers shall not constitute either management or supervisory functions. 4. Not more than five (5) percent of the funds received for the PAR Program may be expended for administrative purposes. The District may expend PAR funds as allowed by legislation including, but not limited to, the Beginning Teacher Support and Assessment (BTSA) program and professional staff development activities. 5. The District shall hold harmless the members of the PAR Panel and the Consulting Teachers for any liability arising out of their participation in the PAR Program. PAR Panel members and Consulting Teachers shall have the same protection and access to appropriate defense as other public school employees pursuant to Division 3.6 (commencing with Section 810) of Title I of the Government Code. 6. All proceedings and materials related to the administration of this article shall be strictly confidential. Therefore, Panel members and Consulting Teachers may disclose such information only as reasonably necessary to perform their respective functions. 7. The District retains the responsibility for teacher evaluation under the Xxxxx Act; however, the written recommendation of the PAR committee and the Consulting teacher’s periodic reports shall be made available for placement in the Participating Teacher’s personnel file and may be used in the evaluation of the Participating Teacher.

Program Parameters. Full time seniority employees will be reimbursed for tuition and fees for approved coursework in accordance with the following provisions: a. Class attendance and homework assignments must be completed on the employee's own time and not during working hours. In addition, employees are prohibited from utilizing break periods and/or lunch periods to attend class for which they are requesting to receive educational reimbursement. Employees will be permitted to utilize vacation, personal and/or compensatory time to attend class when authorized to do so by their Department. b. Employees must be full time and on the active employment rolls at the beginning of the course, during the course, and at the completion of the course. Probationary employees are excluded from applying and being reimbursed. c. Coursework must be taken through an accredited college or educational institution, and must be job related. It is the understanding of the parties that the term "job related" will also encompass coursework taken by the employee in order to provide that employee with the necessary academic training to qualify for regular promotional opportunities within the established County-wide promotional system. d. Seminars and workshops are excluded. e. Employees must satisfactorily meet academic requirements ("C" or equivalent for all undergraduate coursework, and "B" or equivalent for all graduate coursework). f. Reimbursement per employee is limited to $1000.00 for approved courses which end in those calendar years. In no instance will a refund exceed the employee's actual expenditures, nor will reimbursement be issued for expenses also being reimbursed through other sources (i.e., scholarships, G.I. Xxxx, etc.). Fees and payments for books, supplies, transportation, parking, meals, recreational activities and graduation are excluded. Total reimbursement for all AFSCME Local 496-03 employees is limited to $4,000 for the calendar year. If applications for reimbursement exceed this maximum limit, reimbursement shall be on a first come first served basis, in accordance with the date on which the application was received by the Human Resources Department.

University shall at the request of Institution provide the Institution with verification of clearances.

During the course of the Program, Introgen shall present to the Steering Committee alternatives for [*] Products in the Field, together with preclinical data as to safety and efficacy providing reasonable support, as determined by the Steering Committee, for each such Product alternative. Based on such initial data, and from time to time thereafter, the Steering Committee shall determine the Products in the Field with respect to which Introgen shall focus its efforts in the Program, based on biological performance, ease of manufacturing, cost, safety, and other factors deemed appropriate by the Steering Committee. The Products selected, and the activities with respect to identifying, presenting, researching, developing and manufacturing Products in the Field, shall be reviewed on an ongoing basis by the Steering Committee, and may be revised or refined from time to time as the Steering Committee determines (collectively, such Products and activities, as the same may be changed from time to time in accordance with this Agreement, the “Program”).

Program Parameters. In order to implement the foregoing policy, the City has established the following restrictions with respect to use of the Paseo Nuevo Parking Facilities during Pre-Opening Hours of Operation: (a) No person entering the Paseo Nuevo Parking Facilities during Pre-Opening Hours (hereinafter referred to as "Early Morning Parkers") shall be entitled to more than seventy-five (75) minutes free parking where the seventy-five (75) minutes is calculated from the time the Paseo Nuevo Parking Facilities are operated and manned by City employees each morning; (b) Any validation program relating in whole or in part to the use of the Paseo Nuevo Parking Facilities during Pre-Opening Hours shall create a material and substantial disincentive to discourage Early Morning Parkers from remaining parked in the Paseo Nuevo Parking Facilities after the commencement of the Retail Hours of Operation; (c) Not more than two hundred thirty (230) parking spaces (or if the Lot 1 Parking Structure is operated as a public parking structure in accordance with Article 3 of the Xxx 0 Xxxxxxx Xxxxxxxxx not more than one hundred sixty-two (162) parking spaces) shall be available to the Early Morning Parkers in the Lot 2 Parking Structure during Pre-Opening Hours. The remainder of the spaces in the Lot 2 Parking Structure shall not be open for use by the general public until the commencement of the Retail Hours of Operation. Any vehicles parked for the purposes of authorized Employee or Carpool Parking shall not be considered to be Early Morning Parkers for purposes of this limitation. Similarly, any vehicles parked in a space set aside as Replacement Parking shall not be considered to be Early Morning Parkers for the purposes of this limitation; and (d) Not more than two hundred thirty (230) parking spaces (or if the Lot 1 Parking Structure is operated as a public parking structure in accordance with Article 3 of the Xxx 0 Xxxxxxx Xxxxxxxxx not more than one hundred sixty-two (162) parking spaces) shall be available to the users of the Lot 10 Parking Structure during Pre-Opening Hours.
