Promotion Outside of Bargaining Unit. A. An employee who is promoted to a position in the Police Department which is outside the bargaining unit shall continue to accumulate seniority until his promotion becomes permanent, at which time his/her seniority shall be frozen. B. If an employee in a position outside the bargaining unit is laid off from such position, he/she may be demoted to the rank of Sergeant in lieu of layoff in accordance with the provisions of Section 3 above.

Promotion Outside of Bargaining Unit. 13.01 Employees promoted to a position outside of the bargaining unit shall carry their seniority with them and said employee may return to the bargaining unit without loss of seniority and accumulated staff benefits within a three (3) month period. In order to return to the bargaining unit, an employee must give the Employer within the above mentioned three (3) month time period, their notice of intention to return to the bargaining unit. Such notice shall be sufficient to allow the Employer to provide ten (10) working days' notice to a displaced employee should the above mentioned employee return to the bargaining unit require a layoff.
Promotion Outside of Bargaining Unit. 14.01 Where employees are promoted outside the bargaining unit they shall carry their seniority with them. If within three (3) months worked from the date the employee was promoted to the position, the employee proves to be unsatisfactory or if the employee requests to return to their former position, the employee shall be returned to their former position and appropriate rate of pay without loss of seniority. Any other employee affected may also be returned to their former position and former rate of pay without loss of seniority and without any notice. 14.02 Where the Employer permits an employee who has been continuously employed by the Employer to re-enter the bargaining unit, the employee shall maintain their service only for the purpose of wage rate and vacation entitlement.
Promotion Outside of Bargaining Unit. (a) When an Owner Operator within the bargaining unit covered by this Agreement receives a leave of absence to take a position within the Company which is beyond the scope of the bargaining unit, he/she may retain his/her seniority for a maximum of one hundred and eighty (180) calendar days. Such individuals shall not directly hire, fire or discipline members of the bargaining unit but may participate with respect to making recommendations to same. (b) Owner Operators who have been granted such a leave of absence must remain a member of the Union and be covered under all benefits of this Agreement. (c) Not later than the one hundred and eightieth (180t(h) calendar day of this period, the Owner Operator must exercise his/her seniority rights by returning to his/her former position or relinquish all such seniority rights.
Promotion Outside of Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his/her consent. If an employee is transferred to a position outside of the bargaining unit, he/she shall retain his/her seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. Such employee shall have the right to return to a position in the bargaining unit during his/her trial period, which shall be a maximum of three (3) months. If an employee returns to the bargaining unit, he/she shall be placed in a job consistent with his/her seniority. Such return shall not result in the lay-off or bumping of an employee holding greater seniority.
Promotion Outside of Bargaining Unit. An employee promoted to a supervisory or staff position which removes him or her from the bargaining unit shall retain his or her Company and Department Seniority within the bargaining unit for a period of sixty (60) working days only, during which time he or she shall maintain Union membership. Any extension of the above shall be by mutual agreement and limited to twenty (20) working day intervals during which all conditions above shall apply.
Promotion Outside of Bargaining Unit. If an employee is promoted to a position outside the bargaining unit, they may return to the bargaining unit. In such case, the employee would retain the seniority that they had accrued at the time of promotion.

Promotion Outside of Bargaining Unit. Employees promoted to occupational titles outside of the collective bargaining unit covered by this Agreement shall continue to accrue service. Such employees, when returned to employment within the collective bargaining unit, shall be entitled to exercise their seniority as defined by Article 3, Section 7.

  • Positions outside the Bargaining Unit (a) An employee may substitute temporarily in a position outside the bargaining unit for up to fifteen (15) months from the date of the assignment. Bargaining unit employees shall be given the first opportunity to fill the resulting vacancy. The employee shall have the right to return to her or his bargaining unit position prior to the expiry of the fifteen (15) month period by giving the Employer six (6) weeks’ notice. Where an employee is backfilling outside of the bargaining unit for purposes of pregnancy and/or parental leave, the period of time will be extended up to nineteen (19) months from the date of the assignment. An employee who remains outside of the bargaining unit beyond the period covered by this article shall lose all seniority. When the employee returns to the bargaining unit, all other employee(s) shall revert to their previous positions. An employee must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer unless the parties agree otherwise. (b) An employee who accepts a transfer under (a) above will not be required to pay Union dues for any complete calendar month during which no bargaining unit work is performed. (c) An employee who accepts a permanent position outside of the bargaining unit will lose all seniority held at the time of the transfer. (d) The Employer will advise the Union of the names of any employees pursuant to Article 9.17(a) or (b).

  • Performance of Bargaining Unit Work No person whose regular job is not in the bargaining unit will work on any job for which rates are established by this Agreement, except for the purposes of instruction, experimentation, or management training, in which case trainees shall not displace or replace any employee in the aforesaid classifications except in cases of emergency when regular employees are not available.

In the event the employee is returned by the Hospital to a position in the bargaining unit within twenty-four (24) months of the transfer he or she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of his or her return to the bargaining unit. An employee not returned to the bargaining unit within 24 months shall forfeit bargaining unit seniority. (c) In the event an employee transferred out of the bargaining unit under (b) above is returned to the bargaining unit within a period of six (6) calendar months, he shall accumulate seniority during the period of time outside the bargaining unit."

  • SCOPE OF BARGAINING All matters pertaining to wages, hours or terms and other conditions of employment and the continuation, modification, or deletion of an existing provision of the Collective Bargaining Agreement are subject to collective bargaining between the parties.
