Scope of the Bargaining Unit.
31.01 The scope of the bargaining unit is defined as the work performed by the office employees, technicians, animal care assistants and child care workers of the University. The University agrees that bargaining unit jobs will not be performed by members of the other employee groups except as mutually agreed between the University and the Union.
Scope of the Bargaining Unit. The Employer recognizes the Union as the sole bargaining agent for persons employed by North East Community Care Access Centre as Case Managers, Placement Coordinators, Registered Nurses, employees performing case management/coordination, Nurse Practitioners, and Enterostomal Therapy Nurses, save and except managers, persons above the rank of manager and persons exempted under s.1(3) of the Labour Relations Act.
Scope of the Bargaining Unit. The parties agree that the criteria used by the Canada Labour Relations Board to determine exclusions will be used by an Arbitrator in settling disputes that arise during the life of the agreement concerning scope of the Bargaining Unit.
Scope of the Bargaining Unit. Classifications mutually agreed to be within the bargaining units are in the attached addendum. The Employer recognizes the Union as the sole and exclusive representative of those employed in classifications within the bargaining unit. Students who regularly register for credit in timely pursuit of a degree and who neither intend to become nor are regarded as permanent employees of the unit shall be excluded from the provisions of this agreement, it being mutually understood that such students employed by the unit shall not cause impairment or discontinuance of full-time employment of any permanent employee or of any permanent part-time employee. Temporary or irregularly-scheduled employees shall be excluded from this agreement so long as they are not used to deprive regular employees of work time. All regular employees must be working before temporary or irregularly scheduled employees are used. Supervisory staff may, at the discretion of the Employer, fill any position provided they do not permanently replace or displace a full-time employee. It is further agreed that such employment will not result in any reduction in the number of persons employed in the bargaining unit or in the number of regular hours of employment of any employee in the bargaining unit. A temporary employee is one whose employment is not intended to be permanent and is limited by an appointment for a specified time period. A temporary employee shall receive a rate of pay commensurate with the job classification he/she would be in if he/she were a permanent employee. Employees who work more than 30 calendar days shall, as a condition of continued employment, pay the bargaining agent a representation fee or dues. Employees who have completed their probationary period, as a condition of employment, shall pay the bargaining agent a representation fee in lieu of monthly dues and initiation fees. The Employer shall notify the employee and the bargaining agent when the employee has worked 30 calendar days. The employee shall have seven calendar days from receipt of the notice to comply with this requirement or the employee shall be discharged.
Scope of the Bargaining Unit. 1.01 The Employer agrees to recognize the Union as the sole agency for the purpose of collective bargaining for all Labour Relations Officers, Workplace Safety and Health Officers, Professional Practice and Education Officers, Communication Officers, Accounting and Information Technology Coordinators and In-House Legal Counsel employed by the Manitoba Nurses' Union, in the City of Winnipeg, in the Province of Manitoba, save and except clerical support personnel and elected officials of the Manitoba Nurses' Union, and those excluded by the Act, as stated in Manitoba Labour Board Certificate No. 4653.
Scope of the Bargaining Unit. The Employer recognizes the Canadian Union of Public Employees and its Local 145.1 as the exclusive bargaining agent for all health care aides, restorative care aides, recreational aides and registered practical nurses employed in a nursing capacity, employed by Xxxxxxx Centre Long Term Care (Xxxxxxx Centre LTC) in the City of Georgetown, save and except registered nurses, xxxx clerks, supervisors, and persons above the rank of supervisor.
Scope of the Bargaining Unit. 2.01 The Company recognizes the Union as the sole Collective Bargaining Agency for all the employees of Dresden Industrial Company at Rodney, save and except foremen, persons above the rank of foremen, office staff and outside sales staff.
Scope of the Bargaining Unit. 1.01 The Union shall be the exclusive collective bargaining representative of all employees of the bargaining unit which consists of all employees of the Company except -
(a) foremen and persons above the rank of xxxxxxx;
(b) office staff;
(c) operating engineers performing shift and maintenance duties, and who constitute a separate bargaining unit represented by the International Union of Operating Engineers, Local No. 772, provided that if any shift engineer is regularly assigned to that kind of maintenance work which is regularly performed by members of the bargaining unit for more than five days per month, he shall be required to be a member of the Union as provided in Section 2, but wherever possible only one such operating engineer will be so assigned.
(d) guards;
(e) employees covered by a subsisting agreement between Molson Breweries and S.E.I.U. Local 2, UFCW Local 175 or successors thereof.
1.02 The Company will supply to the Union a Brewery organizational chart every 6 (six) months of all brewery personnel. Employees classified as supervisor are those whose duties are mainly supervisory but who may occasionally relieve an employee in the bargaining unit for a short period or work in emergency situations, or to train or demonstrate.
1.03 Wherever the masculine is used in this Agreement, it shall be considered as if the feminine has been used where the context so requires.
Scope of the Bargaining Unit. 1.01 The Union shall be the exclusive collective bargaining representative of all employees in the bargaining unit which consists of all employees of the Company dispatched from and out of Toronto except:
(a) Supervisor dispatchers
(b) Office Staff
(c) Xxxxxxx and above the rank of xxxxxxx.
(d) Employees covered by a subsisting agreement between Molson Breweries and Canadian Union of Brewery and General Workers Component 325 or successors thereof.
1.02 The Company will supply to the Union a list of the above superintendents and dispatchers whose duties are mainly supervisory but who may occasionally work in emergency situations, or to train or demonstrate.
Scope of the Bargaining Unit. The parties agree that California Nurses Association (CNA) is recognized as the formal representative of Nurses in the Registered Nurses Bargaining Unit pursuant to the County’s Employee Relations Ordinance. The bargaining unit consists of all regular full- time and part-time regular County Nurses (probationary and permanent) and certain part-time Nurses as herein set forth in the following job classifications: Staff Nurse I, II & III Psychiatric Nurse I & II Public Health Nurse I, II, III Nurse Practitioner Senior Nurse Practitioner Psychiatric Nurse Practitioner Senior Psychiatric Nurse Practitioner The County agrees to inform CNA of any proposal to create a new classification which would be assigned to the Nurses’ bargaining unit prior to submission of any recommendation to the Board of Supervisors for final adoption.
