Reporting and Reviews. Unless otherwise agreed, Supplier and Buyer will review on a quarterly basis Supplier and the Buyer's performance under this Agreement. Such reviews shall include, but not be limited to:
9.1. Supplier's performance in respect of quality, on-time deliveries, price levels and lead times;
9.2. If applicable, Buyer's performance in respect of notifying Rolling Forecasts and placing subsequent Purchase Orders.
9.3. opportunities to enhance specifications for performance improvement.
9.4. Buyer and Supplier each appoint contract coordinators as indicated in Exhibit B.
9.5. Length of any Demand Plan, to the extent a six (6) month, rolling forecast is insufficient to permit Supplier to meet delivery, volume or pricing commitments agreed to with respect to Products under such Demand Plan.
Reporting and Reviews. (a) BGN will submit to Gaslink the reports that have been agreed between BGN and Gaslink in relation to the performance by BGN of its functions pursuant to this Clause 9 and Schedule 10 and such other Information on progress against the operations and maintenance programme in the Annual Work Plan as Gaslink may reasonably request from time to time.
(b) BGN shall undertake an audit programme agreed in advance with Gaslink (both Parties acting reasonably) to verify that the performance by BGN of such of its functions pursuant to this Clause 9 and Schedule 10 as BGN and Xxxxxxx may agree meet the Operations and Maintenance Requirements and shall notify Gaslink of any failure or anticipated failure by BGN to comply with Development Requirements of which BGN becomes aware.
(c) Gaslink may conduct all reasonable inspections and reviews to ensure that work undertaken complies with the Operations and Maintenance Requirements. Such inspections must be conducted at a reasonable time and on reasonable notice to BGN and in accordance with the Access Protocol.
(d) If arising from the results of the audit programme, an inspection or otherwise Gaslink considers that the Operations and Maintenance Requirements are not being complied with in any respect, it may notify BGN of such non-compliance giving reasons for its view.
(e) Save in the event of a Dispute as to whether there has been such non- compliance, which shall be dealt with in accordance with the Dispute Resolution Mechanism, BGN shall remedy any such non-compliance to the satisfaction of Gaslink within such timeframe as Gaslink may reasonably specify.
(f) The performance by BGN of its functions pursuant to this Clause 9 and Schedule 10 shall be reviewed against the Operations and Maintenance Requirements by Gaslink and BGN at the Monthly Meetings. In advance of those meetings BGN will provide Gaslink with a report comprising:
(i) a high level operations and maintenance activity report;
(ii) a schedule in respect of new operations and maintenance activities (if applicable); and
(iii) a management report outlining key operations and maintenance activities in the previous month and a report of the audit programme undertaken pursuant to Clause 9.3(b).
(g) BGN shall comply with and discharge any liability it may incur under any Customer Charter which may be in place from time to time that is applicable to its functions as set out above.

The Ministry of Finance and Planning will provide quarterly narrative and financial reports measuring process against project deliverables. The PA will conduct a post-evaluation of the activities financed from the grant that will focus on the results achieved, efficiency, effectiveness of implementation and quality of administration. This will be provided to DFID within 6 months of project finalisation. If DFID believes there has been a breach of the commitments by the PA, DFID will send a clear transparent signal that the PA’s actions are being taken seriously and that the level of trust in the aid relationship has been damaged. In this event, DFID may: Delay all or part of a specific aid disbursement to the PA; Change the way DFID delivers aid to the PA; Switch some or all of the aid away from the PA to other channels; Reduce or stop aid to the PA. DFID will not be responsible for the activities of any person, organisation or company engaged by the PA or its agencies as a result of this Memorandum, nor will DFID be responsible for any costs incurred by the PA or its agencies in terminating the engagement of the aforementioned persons, organisations or companies. Although accountable to DFID for the appropriate use of funding and delivery of project objectives, the PA will retain ultimate responsibility for the appropriate delivery of aid funding and will as such be solely responsible for any adverse effects of aid expenditure that have an undesired or unexpected result upon recipients.

The PA will co-operate fully with DFID and its agents during any assessment or review of the programme, providing the information and evidence necessary for effective assessments to be made. Whenever required and practicable, the PA will co-operate fully and participate in necessary meetings and/or steering committees concerning that project. The PA will collaborate with DFID and proactively look for ways to build support for development and raise awareness of DFID’s funding. Wherever appropriate, the Government will explicitly acknowledge DFID’s support through the use of DFID’s UK aid logo in all communications with the public or organisations regarding this funding. The PA also commits to collaborate with DFID on other awareness raising activities, where feasible and appropriate, in the UK and overseas, to profile the partnership and the results it is delivering. Consideration of safety and security will always take precedence over the need to brand. Intellectual property developed in all material (including, but not limited to, reports, data and designs, whether or not electronically stored) produced by the PA or its personnel, members of representatives in the course of this project (“the Material”) will be the property of the PA. Reporting and Reviews. Formal reviews and reporting will be conducted to assess progress against project objectives. It is expected that the Ministry of Financial and Economic Management (MOFEM) will meet with DFID on a monthly basis to report on the following: Performance to date and forecasts for both domestic (e.g. tax) revenues and expenditure; Related key budget policy and departmental developments performance against financial aid targets (e.g. as set out in the DFID Financial Aid Business Case and supporting logframe); Programme delivery risks. The Government must submit full and timely evidence in support of claims, including: a) performance to date and a forecast to the end of the claim period of both domestic (e.g. tax) revenues and of expenditure; b) a breakdown of expenditure needs by key department and spending area, including a separate section of each of the ring-fenced areas. The evidence and required reporting must be submitted by the dates indicated below to enable the planned disbursements in May July and November, to ensure payment within that month. 1. The bank custodian and the investment adviser shall each provide monthly statements of holdings and account activity to the District’s Treasurer. The bank custodian shall also provide such information to the District’s Investment Adviser(s).
2. Confirmations of all transactions and movement of funds shall be forwarded promptly to the District by the investment adviser. The investment adviser shall ensure a duplicate confirmation is provided to the District by the broker.
B. Investment performance
1. The investment adviser shall meet at least quarterly with District management and/or with the Finance & Information Technology Committee of the Board of Directors to review account activity, economic conditions and investment performance.
