Rest Periods After Overtime. 44.3(a) When overtime work is necessary it shall wherever reasonably practicable, be so arranged that employees have at least ten consecutive hours off duty between the work of successive days.

(a) An Employee who works overtime between the termination of their ordinary work hours on one day and the commencement of ordinary work hours on the next day, and they have not had a minimum break of ten (10) consecutive hours from duty, will not be required to attend duty until they have had ten (10) consecutive hours off duty. The Employee will be paid for the ordinary rostered working hours during this absence despite the hours not being worked.

Only in exceptional circumstances may there be mutual agreement to reduce the minimum rest-period to eight hours. If an employee extends a previous working period by additional working hours, then they must take a rest- period of ten consecutive hours off-duty before reporting back for work, and if this means reporting back for their next period of work after the rostered start-time then they will be entitled to be absent from work to take rest until they have had ten consecutive hours off-duty, and there will be no loss of basic salary (or applicable shift rate as appropriate for the missed hours of the rostered shift) for ordinary working time occurring during such absence. If on the instruction of the employer, the employee resumes or continues work without having had ten such consecutive hours off duty, they will be paid at double rates until they are released from duty for such period and they will then be entitled to be absent until they have had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. Where the employer and employee agree to reduce the break to not less than eight hours, any payment due to the employee in respect of ordinary working time occurring during such absence will be adjusted accordingly.

Where the working of overtime means an employee does not have at least 10 hours break before the commencement of ordinary hours the following day, the employee shall start work late the following day (at least 10 hours after the conclusion of the previous night's overtime) without losing any pay. They shall also not be requested to perform overtime that following day except in exceptional circumstances. If, due to exceptional circumstances and only by agreement, the employee commences work without having had 10 hours break, the employee will receive appropriate penalty rates until they are able to stop work for the proper rest break.

When overtime hours are worked, including on a Saturday, Sunday or Public Holiday and where it is practicable, an employee shall have at least 10 consecutive hours off duty between work on successive days. Where an employee is recalled or continues to work without having a 10 consecutive hour break from duty, the employee will be paid at the appropriate overtime rate until completion of the work on the following day.
Rest Periods After Overtime. 13.1 An employee who works a large quantity of overtime, between the completion of ordinary hours work on one day and the commencement of ordinary hours on the next day, will be released until he/she has had ten consecutive hours off duty. This rest period will be without loss of pay for ordinary hours rostered during such absence.

(a) An employee (other than a casual employee) who works so much overtime between the termination of his/her ordinary work on one day and the commencement of his/her ordinary work on the next day that he/she has not had at least ten consecutive hours off duty between those times shall be subject to sub-clause (b) be released after completion of such overtime until he/she has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
