Rest Periods After Overtime. (a) When overtime is necessary it shall, wherever reasonably practicable, be so arranged that the employee has at least ten (10) consecutive hours off duty between the work of successive days.
(b) An employee who works so much overtime between the termination of their ordinary work on one day and the commencement of their ordinary work on the next day that they have not had at least ten (10) consecutive hours off duty between those times shall, subject to this clause, be released after completion of such overtime until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
(c) If, on the instruction of the Company, the employee resumes or continues work without having such ten (10) consecutive hours off duty, the employee shall be paid at the appropriate overtime rate until he/she is released from duty for such period and shall then be entitled to be absent until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. Where there is a mutual agreement between the Company and the employee affected, eight consecutive hours may be substituted in lieu of ten (10) consecutive hours.
Rest Periods After Overtime. 11..4.1 When overtime is necessary it shall wherever reasonably practicable be so arranged that the employee has at least 10 consecutive hours off duty (or less by agreement subject to the provisions of the Occupational health and Safety Act) between the work of successive days.
Rest Periods After Overtime. (a) An Employee who works overtime between the termination of their ordinary work hours on one day and the commencement of ordinary work hours on the next day, and they have not had a minimum break of ten (10) consecutive hours from duty, will not be required to attend duty until they have had ten (10) consecutive hours off duty. The Employee will be paid for the ordinary rostered working hours during this absence despite the hours not being worked.
(b) If, on the instructions of the Employer, the Employee resumes or continues to work without having had a break of 10 consecutive hours off duty, the Employee will be paid at the rate of double time until they are released from duty for such a period. The Employee is then entitled to be absent until they have had a break of 10 consecutive hours off duty without loss of pay for their ordinary rostered working hours that occurs during such absence.
Rest Periods After Overtime. 27.1.1 If the employee works so much overtime between successive days that the employee does not have a ten hour break, the employee must be released from duty after completing the overtime. The employee must then be given a ten hour break and must not lose pay for any time lost by reason of that break. This break may be reduced to eight hours at the request of the employee.
27.1.2 If the employee is required by the Company to resume or continue work without having that ten hour break, the employee must be paid at the rate of double time until the employee is released from duty. After the completion of this work, the employee is then entitled to a break of ten consecutive hours.
Rest Periods After Overtime. 17.1 An employee who works so much overtime after the termination of his/her ordinary work on one day and the commencement of his/her ordinary work on the next day that he has not had at least ten consecutive hours off duty between those times, will be released after completion of such overtime until he/she has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
17.2 If on the instruction of the Company such an employee resumes or continues work without having had such ten consecutive hours off duty, he/she will be paid at double time until he/she is released from duty for such period and he/she will then be entitled to be absent until he/she has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
17.3 Weekend work on overtime is excluded from the provisions of 17.1 and 17.2. Such overtime stands alone for all purposes.
17.4 Award provisions for rest periods will apply in the case of call backs.
Rest Periods After Overtime. The Company is firmly committed to ensuring a minimum rest-period of at least ten 10.0 consecutive hours off- duty between the termination of one working period and the commencement of the next working period. Only in exceptional circumstances may there be mutual agreement to reduce the minimum rest-period to eight 8.0 hours. If an employee extends a previous working period by additional working hours, then they must take a rest-period of ten 10.0 consecutive hours off-duty before reporting back for work, and if this means reporting back for their next period of work after the rostered start-time then they will be entitled to be absent from work to take rest until they have had ten 10.0 consecutive hours off-duty, and there will be no loss of basic salary (or applicable shift rate as appropriate for the missed hours of the rostered shift) for ordinary working time occurring during such absence. If on the instruction of the employer, the employee resumes or continues work without having had ten 10.0 such consecutive hours off duty, they will be paid at double rates until they are released from duty for such period and they will then be entitled to be absent until they have had ten 10.0 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. Where the employer and employee agree to reduce the break to not less than eight 8.0 hours, any payment due to the employee in respect of ordinary working time occurring during such absence will be adjusted accordingly.
Rest Periods After Overtime. Where the working of overtime means a Day Worker or Shift worker does not have at least 10 or 8 hours break respectively before the commencement of ordinary hours the following day, the employee shall start work late the following day (at least 10 or 8 hours after the conclusion of the overtime) without losing any pay. Where an employee does not receive the required break the employee will be paid at double time until they can have a break.
Rest Periods After Overtime. (1) For the purposes of this clause:
(a) Urgent overtime is where an Employee is notified 48 hours or less of the overtime hours required to be worked.
(b) Pre-scheduled overtime is where an employee is notified more than 48 hours of the overtime hours required to be worked.
(2) When overtime is necessary to be worked by an employee it shall, wherever reasonably practicable, be arranged so that Employees have at least ten hours off duty between the ordinary working hours and the overtime.
(3) An Employee undertaking urgent overtime who does not have at least 10 hours off duty between the end of the day work and commencement of the overtime and/or end of the overtime and commencement of the day work will be released after the completion of the overtime, as applicable, until the Employee has had 10 hours off duty, without loss of pay for ordinary working hours involved.
(4) If the Employee undertaking urgent overtime is required to resume or continue work without having had at least 10 consecutive hours off duty, the Employee will be paid at double rate until released from duty. Once the Employee is released from duty they will then be entitled to be absent until the Employee has had 10 hours off duty without loss of pay for any ordinary working time during that absence.
(5) Where an Employee is undertaking pre-scheduled overtime a rest period of 10 hours will be provided. An Employee will not suffer a loss of pay as a result of the 10 hour breaks. If the employee is required to resume or continue work without having had a 10 hour break the provisions of sub-clause (4) above will apply.
Rest Periods After Overtime. (a) An employee (other than a casual employee) who works so much overtime between the termination of his/her ordinary work on one day and the commencement of his/her ordinary work on the next day that he/she has not had at least ten consecutive hours off duty between those times shall be subject to sub-clause (b) be released after completion of such overtime until he/she has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
(b) If on the instructions of the Company an employee resumes or continues work without having had such ten consecutive hours off duty, he/she shall be paid at appropriate overtime rates for all time of duty until he/she has had ten consecutive hours rest.
(c) The provisions in above sub-clauses will apply to shift workers as if 8 hours were substituted for ten hours when overtime is worked:
(i) For the purpose of changing shift rosters; or
(ii) Where the shift worker does not report for duty and another shift worker or day worker is required to replace such shift worker; or
(iii) Where a shift is worked by arrangement between the employees themselves

If on the instructions of RACV, such an employee resumes or continues work without having had ten consecutive hours off duty he/she shall be paid at double the ordinary time rate of pay until he/she is released from duty for such period and he/she shall then be entitled to be absent until he/she has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
(c) The provisions of this sub-clause shall not apply in the case of shift workers when overtime is worked:-
(i) For the purpose of changing shift rosters; or
(ii) Where a shift worker does not report for duty and a day worker or a shift worker is required to replace such shift worker; or
(iii) Where a shift is worked by arrangement between the employees themselves.
