TEN HOUR BREAK.
(1) When overtime work is necessary it shall, wherever reasonably practicable, be so arranged that an Employee has at least ten (10) consecutive hours off duty between the work of successive days.
(2) An Employee who works so much Additional Overtime between the completion of the Project Working Hours worked on one day and the commencement of the Project Working Hours on the next day that the Employee has not had at least ten (10) consecutive hours off duty between those times shall, subject to this subclause, be released after completion of such overtime until the Employee has had ten (10) consecutive hours off duty without loss of pay for Project Working Hours occurring during such absence.
(3) If, on the instructions of the Company, an Employee resumes or continues work without having had ten (10) consecutive hours off duty, the Employee shall be paid at double time rates until the Employee is released from duty for such period and the Employee shall then be entitled to be absent until the Employee has had ten (10) consecutive hours off duty without loss of pay for Project Working Hours occurring during such absence.
(4) Where an Employee is called into work on a Sunday or holiday prescribed under this Agreement preceding an ordinary working day, the Employee shall, wherever reasonably practicable, be given ten (10) consecutive hours off duty before the usual starting time on the next day. If this is not practicable, then the provisions of subclauses (2) and (3) of this clause shall apply.
(5) The provisions of this clause shall apply in the case of shift Employees as if eight (8) hours were substituted for ten (10) hours when overtime is worked:
(a) For the purpose of changing shift rosters; or
(b) Where a shift Employee does not report for duty; or
(c) Where a shift is worked by arrangement between the Employees themselves.
(6) Overtime worked as a result of a recall shall not be regarded as overtime for the purpose of this clause when the actual time worked is less than three (3) hours on such recall or on subsequent recalls.
TEN HOUR BREAK. An employee who has worked overtime will be informed that they are entitled to and be granted a break of at least ten hours between the time of finishing work and the time when they next commence work, and no deductions will be made from their pay because of any time lost by reason of such break. Where the employee is required to work before they have completed the break of ten hours they will be paid double time for all time worked until they have had a break of at least ten hours.

(b) An employee who works so much overtime between the completion of the ordinary hours worked on one day and the commencement of the ordinary hours on the next day that the employee has not had at least ten (10) consecutive hours off duty between those times shall, subject to this sub-clause, be released after completion of such overtime until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
(c) If, on the instructions of the Employer and in exceptional circumstances, an employee resumes or continues work without having had ten (10) consecutive hours off duty, the employee shall be paid at double time until the employee is released from duty for such period and the employee shall then be entitled to be absent until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary hours occurring during such absence.
(d) Where an employee is called into work on a Sunday or holiday prescribed under this Agreement preceding an ordinary working day, the employee shall, wherever reasonably practicable, be given ten (10) consecutive hours off duty before the usual starting time on the next day. If this is not practicable, then the provisions of (b) and
TEN HOUR BREAK. When overtime work is necessary it shall, wherever reasonably practical, be so arranged that: the employee(s) has at least ten consecutive hours off duty between the finish of one ordinary shift and the commencement of the next ordinary shift. An employee (other than a casual employee) who works so much overtime between the finish of ordinary work on one day and the commencement of ordinary work on the next day has not had at least ten consecutive hours off duty between those times shall subject to this clause, be released after completion of such overtime until the employee has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. If on the instructions of the Company such employee resumes or continues work without having had ten consecutive hours off duty, the employee shall be paid at the rate of double time until the employee is released from duty for such period, and the employee shall be entitled to be absent until the employee, has had ten consecutive hours off duty without loss of pay for ordinary working, time occurring during such absence.
TEN HOUR BREAK. 4.3.1 The work of employees shall be arranged so that there are at least ten consecutive hours off duty between the work of successive days.
4.3.2 An employee who is rostered to commence ordinary hours of duty without having had at least ten consecutive hours off duty since the termination of work on the previous day shall be given ten consecutive hours off duty without loss of pay for any rostered working time occurring during such absence.
4.3.3 The employee shall be responsible for notifying their manager if;
4.3.3.1 They are rostered for work in another department and / or there is the potential for not having a 10 hour break between shifts, and
4.3.3.2 Where the 10 hour break requires them to commence late for their next day’s work.
4.3.4 If an employee is authorised to resume work without having had ten consecutive hours off duty, that employee shall be paid an additional 100% (double time) penalty of their base rate until released from duty for such period and shall then be entitled to be absent until having had such ten consecutive hours off duty without loss of pay for rostered working time occurring during such absences.
4.3.5 A required meal break shall not constitute a break in the work of the employee. Accordingly work done before and after the meal break shall be counted as being continuous.
4.3.6 The provisions of this subclause shall not apply under the following circumstances:
4.3.6.1 Where the work is by arrangement between the employees themselves with the prior approval of management.
TEN HOUR BREAK. A. Except as required by the Municipality, an employee who has been on duty for four (4) or more hours outside of the regular shift shall not report to work the next regularly scheduled shift until the employee has had a minimum of ten (10) hours of relief. The employee shall be paid at the employee’s applicable straight time rate for those hours of the employee’s regularly scheduled shift included in the employee’s ten (10) hours of relief. If the employee does not report for work following the ten (10) hours of relief or does not have approved leave for the remainder of the employee’s straight time shift, the employee will not be entitled to straight time pay for those hours of their regularly scheduled shift which were included in the employee’s ten (10) hours of relief.
B. If an employee is required to report to work without having had a ten (10) hour break, the hours the employee is required to work without having had the break shall be paid at the overtime rate.
TEN HOUR BREAK. (a) When overtime is worked, a break of not less than ten (10) hours will be taken between the completion of work on one day and the commencement of work on the next, without loss of salary for ordinary working time occurring during such absence.
(b) Provided that where a lecturer is directed to return to or continue to work without the break provided in sub-clause 40.6 (a) then the lecturer will be paid at double the ordinary rate until released from duty, or until the lecturer has had ten consecutive hours off duty without loss of salary for ordinary working time occurring during such absence.
TEN HOUR BREAK. An Employee shall be entitled to a break of ten hours between the finish of overtime or work after recall and before reporting again for duty and will not incur a reduction in payment for ordinary hours of work. When directed to resume work before such a break is taken, the Employee shall be paid at the rate of double time subsequently worked until a break of at least ten hours has been taken. Ten Hour Break does not apply to planned Night Works.
