Rights Upon Return. An employee returning from a leave of ninety (90) days or less will be returned to the location from which the leave was taken except that the employee may be transferred if such a transfer would have been made if the employee had been on duty. An employee returning from a leave of more than ninety (90) days will have return rights to a position in his/her class.
Rights Upon Return. A bargaining unit member shall be restored to his/her former position or to a position of like nature and status. All accrued rights of seniority, retirement, leave with pay, salary increments and other benefits provided by this Contract or by law shall be preserved and available to the member of the bargaining unit after the termination of the sabbatical leave. Sabbatical leave shall constitute a year of experience for seniority purposes and placement on the Salary Schedule.
Rights Upon Return. Teachers returning from a personal, medical, parenting or military leave of one (1) year or less retain the right to return to their previous work location (same position and FTE). If there is a staff reduction, the canvassing process that includes the teacher on leave will be followed pursuant to the Transfer and Reassignment Process (see 13.7).
Rights Upon Return. Any employee returning from a leave of forty-five (45) calendar days or less will be returned to the location from which the leave was taken except that the employee may be transferred pursuant to Article XI (Transfer Procedures), if such a transfer would have been made if the employee had been on duty. An employee who returns from leave after the 45 day period shall be considered for return to the location, including patrol, from which the leave was taken if at the time of return there is a vacancy at that location. If not returned to the existing vacancy, the employee shall be entitled to the statement of reasons pursuant to Section 2.1 of Article XI.
Rights Upon Return. An employee on a leave and replaced by a substitute may be returned to the assigned position held prior to taking a leave if circumstances permit or, upon consent of the employee, to another vacant position for which the employee is qualified. Upon notification of the employee’s intent to return, the employer shall inform the employee of the web address for current position vacancies on the District website. If conditions permit, the employee may be assigned to a position similar to that held prior to leave. Until the time the employee is reassigned from leave status, the employee may apply for reassignment to any vacancy, and may indicate preferences to the Human Resources Office for reassignment beyond current vacancies. The employee shall be notified of reassignment from leave status as soon as such reassignment is made by the Human Resources Office. Leaves of absence as specified in this Article shall be limited to tenured teachers in the District with the following exceptions: educational leave, sick leave, court summons leave, jury leave, maternity leave, bereavement leave and industrial accident/illness leave.
Rights Upon Return a. A Unit member shall return to the same location and the same classification from which leave was taken if they return to service no later than one (1) year from the beginning date of the leave.
Rights Upon Return. 11.12.1 In the case of a leave of absence by a unit member for a period less than a full year, which commences after the beginning of the school year and ends prior to the close of the same school year, the unit member shall have the right of return to the same school site unless the unit member has been replaced by the transfer of another permanent unit member or that unit member’s class or assignment has been eliminated.

Consistent with legal requirements, any bargaining unit member returning from a leave of more than ninety (90) days will have return rights to a position in his/her classification.
Rights Upon Return. On return to the School District, the probationary or tenured teacher or full-time paraprofessional shall be guaranteed all rights and benefits provided all other unit members including, but not limited to, maintenance of seniority and position on salary schedule. The probationary or tenured teacher or full-time paraprofessional shall further be guaranteed a position of equal responsibility and status.
Rights Upon Return. A Unit member shall return to the same location and the same classification from which leave was taken if he/she returns to service no later than one (1) year from the beginning date of the leave. During this one (1) year period, if a Unit member would have been reassigned to another classification or transferred to another location, notwithstanding the leave, such reassignment or transfer shall be affected and the Unit member shall have return rights to the new classification or location. Beyond one (1) year, the Unit Member shall be given consideration to return to a position as near as reasonably possible to the position held prior to the leave.
