Safety Director. If the grievance is not resolved at Step 2, the Safety Director of the City of Newark shall hold a grievance meeting, within twenty-one calendar days of his/her receipt of the appeal, unless otherwise agreed by the parties. He/she shall reply to the grievance in writing within fourteen (14) calendar days after completion of the meeting, unless otherwise agreed by the parties. The Lodge shall be permitted to have up to two (2) representatives attend such meeting with the aggrieved Employee. Management may have up to two (2) representatives at such meetings. The Human Resources Director of the City of Newark may also attend the meetings at the third (3rd) step. At this step the grievant, or his representative, must file copies of the grievance with the Human Resources Director.
Safety Director. A. Should the grievant or the Labor Council representative, if one is involved, decide that the reply of the Police Chief is unsatisfactory, the grievant or representative of the Labor Council, if one is involved, shall, within ten (10) calendar days, forward a copy of the grievance and all other pertinent information to the City's Safety Director or his designated representative. The Safety Director or his designee shall sign and date the form upon receipt and return a signed copy to the grievant or his representative if one is involved. A waiver form must be presented by the grievant at this step.
B. The Safety Director or his designated representative shall arrange a hearing between the grievant and, if the grievant so desires, the Labor Council representative and the City within fifteen (15) calendar days unless otherwise mutually agreed to. The Safety Director or his designee shall answer the grievance within ten (10) calendar days after the hearing in writing.
C. The City may require the hearing to be held outside normal working hours. Meetings and/or conferences by the Labor Council and the grievant with respect to discussion of the various actions associated with resolving such a matter, shall be scheduled for the off-duty hours of the participants. No compensation will be provided by the City for the participants in such meetings and/or conferences. A hearing scheduled for a time period during which the grievant and his representative would normally be on duty will proceed as scheduled. The grievant and his representative shall be released from duty during the time period of the hearing and shall not suffer any loss of pay or benefits.
D. If a decision of the Safety Director or his designee is not satisfactory to the Labor Council, arbitration must be requested in writing within twenty-one (21) calendar days from the date the decision was rendered at the last step of the grievance procedure.
Safety Director. Contractor shall retain a qualified person or firm to serve as the safety director for the Project (the “Safety Director”), subject to the approval of Owner, not to be unreasonably withheld. If required by either Owner’s or Contractor’s insurance provider, such Safety Director shall have the qualifications and authority necessary to support the issuance of the required insurance for the Project. The Safety Director shall be responsible to observe and enforce safe practices at the Site and related support facilities and shall report to PM/CM, Contractor and the Owner on a biweekly basis. The role and responsibilities of the Safety Director shall be more particularly set forth in the agreement between Contractor and the Safety Director (the “Safety Contract”).
Safety Director. The Contractor shall designate a responsible member of his organization at the site whose duty shall be the prevention of accidents. This person shall not be the Contractor’s superintendent unless otherwise designated in writing by the Contractor and approved by Owner. In any emergency affecting the safety of persons or property, the Contractor shall act, at his discretion, to prevent threatened damage, injury, or loss. The Contractor shall be responsible for the safe operation of all equipment, for utilizing safe construction methods, and for any damage which may result from failure or from improper construction, maintenance, or operation.
Safety Director. 14 If the aggrieved party is not satisfied with the written decision at the conclusion of 15 Step 2, a written appeal of the decision may be filed with the Safety Director within 16 seven (7) days from the date of the rendering of the decision in Step 2.
Safety Director. If the aggrieved party initiating the grievance is not satisfied with the written decision at the conclusion of Step 2, a written appeal of the decision may be filed with the Safety Director within seven (7) calendar days from the date of the rendering of the decision in Step 2. Copies of the written decision shall be submitted with the appeal. The Safety Director, or a designee, shall convene a meeting within fourteen (14) days of the receipt of the appeal. The meeting will be held with the aggrieved party and his representative, if any, and any other party necessary to provide the required information for the rendering of a proper decision. The Safety Director, or a designee, shall issue a written decision to the Employee, with a copy to the Employee's repre- sentative, if any, within fifteen (15) days from the date of the meeting. If the aggrieved party is 2023-2026 OPBA Police Supervisors Contract 10/6/2023 41 not satisfied with the decision at Step 3, he may proceed to arbitration pursuant to the Arbitration Procedure contained herein.

If required by either Owners’ or Contractor’s insurance provider, such Safety Director shall have the qualifications and authority necessary to support the issuance of the required insurance for the Project. The Safety Director shall be responsible to observe and enforce safe practices at the Site and related support facilities. If retained by subcontract, the Safety Director shall be considered a Subcontractor for purposes of this Agreement.

MGE Construct shall retain a qualified person or firm to serve as the safety director for the Project (the “Safety Director”), subject to the approval of Owners, not to be unreasonably withheld. If required by either Owners’ or MGE Construct’s insurance provider, such Safety Director shall have the qualifications and authority necessary to support the issuance of the required insurance for the Project. The Safety Director shall be responsible to observe and enforce safe practices at the Site and related support facilities and shall report to PM/CM, MGE Construct and the Owners on a bi-weekly basis. The role and responsibilities of the Safety Director shall be more particularly set forth in the agreement between MGE Construct and the Safety Director (the “Safety Contract”). To the extent applicable, the Safety Contract shall be consistent with the requirements of Article 15 of this Agreement.

The CONTRACTOR shall retain a qualified person or firm to serve as the safety director for the Project (the “Safety Director”), subject to the approval of the PROJECT COMPANY, not to be unreasonably withheld. If required by either the PROJECT COMPANY’ or the Contractor’s insurance provider, such Safety Director shall have the qualifications and authority necessary to support the issuance of the required insurance for the Project. The Safety Director shall be responsible to observe and enforce safe practices at the Site and related support facilities and shall report to PM/CM, the CONTRACTOR and the PROJECT COMPANY on a bi-weekly basis. The role and responsibilities of the Safety Director shall be more particularly set forth in the agreement between the CONTRACTOR and the Safety Director (the “Safety Contract”). To the extent applicable, the Safety Contract shall be consistent with the requirements of Article 14 of this Agreement.
Safety Director a. Provide all levels of Management the services and technical advice needed for proper administration of the Safety Program.
b. Establish procedures and guidelines for the Safety Program(s) and update as necessary.
c. Maintain current knowledge of Federal, State, and local regulations and maintain outside professional contacts.
d. Be available at the worksite regularly during pre-construction and construction for the purpose of inspection to determine compliance with OSHA regulations and project safety rules.
e. Review all accidents and injury reports and maintain accident data.
f. Make analysis of statistical data. Identify problem areas and make recommendations for solutions.
g. Coordinate safety training activities.
h. Prepare and distribute regular reports on the status of safety to Executive Management.
i. Recommend programs and activities that will develop and maintain incentives and motivations for employee safety.
j. Develop technical guidelines and safety recommendations for special exposure situations.
k. Develop a written Hazard Communication Program for the company.
l. Ensure Material Safety Data Sheets (MSDS) are received from the supplier and properly filed in the company MSDS binder.
m. Provide necessary MSDS to each worksite according to chemicals used.
