Scheduling Compensatory Time Off. The compensatory time off shall be used no later than six (6) months from when it was earned. If the unit member has not taken the compensatory time within this period, the unit member has the option to request payment or, if payment is not requested, management shall determine when the compensatory time shall be taken within the next ninety (90) calendar days. Any accumulated compensatory time off shall be deducted prior to the use of vacation leave. Compensatory time off shall be scheduled in a minimum of 15 minute increments.
5.15 Overtime, Compensatory Time, and Holiday Pay for Maintenance & Operations Classifications
Scheduling Compensatory Time Off. Section 28.1 Subject to the bona fide operating requirements of the Agency, an employee shall have their choice of scheduling compensatory time off. If two (2) or more employees request the same period of time off and the matter cannot be resolved by agreement between the employees concerned, the employee having the greatest seniority with the Agency shall be granted the time off.
Section 28.2 Employees shall be allowed the option of taking compensatory time off consecutively with vacation leave. However, compensatory time off taken in this manner shall be subject to the provisions of Article 31 (Vacation Leave) rather than the provisions of this Article.
Section 28.3 Employees shall request in writing from their immediate supervisor compensatory time off by the 15th of the preceding month in which the employee wants time off. The notification period may be waived by the immediate supervisor.
Section 28.4 An employee shall be eligible to accrue up to one hundred twenty (120) hours of compensatory time off. Any hours in excess of that number of hours shall be paid to the employee by the Agency.
Section 28.5 When an employee terminates employment with the Agency, the Agency shall pay all unused compensatory time hours to the employee in the last paycheck.
Section 28.6 Scheduling compensatory time off for the Distribution Center employees (LDW 1, LDW 2, and LDEO).
a. During January of each year, Distribution Center management will post a notice advising employees to turn in their time off request forms, by the last work day in February, for any requested compensatory time off that begins on any date from May 1st through April 30th of the following year.
b. Using the leave slips received, Distribution Center management will schedule compensatory time off in agency seniority order based on the Distribution Center operational needs. Management will approve/deny time off requests and return the requests no later than the fifth work day in March.
c. For compensatory time off requests received after the last work day in February, the employee who first requests the time off is entitled to the time off. Distribution Center management will respond to these requests within three (3) work days.
d. Compensatory time off requests for Thanksgiving week and Christmas/New Year’s (the Friday before the week of Christmas, the week of Christmas, the week of New Year’s Day and the Monday after) will be handled differently. An employee may request time off for these Thanksgiving...

Management will respond to the employee within five (5) days of the request. Request to use accumulated compensatory time will not be unreasonably denied, subject to the operational needs of the Department. Compensatory time may be taken in time increments of less than eight (8) hours.
a. Except for the Youth Challenge Program (see 4(b)). An employee may accrue up to one hundred (100) hours of compensatory time. The Department may allow accrual of additional hours of compensatory time off above one hundred (100) hours if specifically requested by the employee. When the accrual exceeds forty (40) hours, a mutually agreed upon plan may be developed by the employee and supervisor. The plan shall be submitted to the State Personnel Office (AGP). If there is no mutually agreed plan, a plan will be provided. The plan will provide an employee up to six (6) months to use hours accrued over seventy (70). If there is no plan in place, when the leave exceeds one hundred (100) hours and after a forty-five (45) day period following the end of a pay period, the employee shall be paid for all leave over seventy (70) hours.
Scheduling Compensatory Time Off. Requests for compensatory time off shall be approved or denied within ten (10) working days of being submitted. Cancellation of the pre-approved compensatory time off shall be limited to emergency situations not under the control of the City.

(Reasonable request shall be defined as requesting said time off when no other bargaining unit Employee has been previously scheduled and approved for vacation, administrative or compensatory leave time on the same shift.) In the event that two or more requests from the same bargaining unit and shift for compensatory time off for the same time period are submitted simultaneously, preference shall be given to the Employee with the greater amount of accumulated compensatory time. If, in the opinion of the Chief, an Employee is not making a reasonable effort to reduce his/her compensatory time bank to the one hundred and twenty (120) hour threshold, he may direct the Employee to do so, and may schedule compensatory time off for said Employee.

Any hours in excess of eighty (80) hours shall be paid to the 36 employee by the Agency, or scheduled off with the mutual agreement of the supervisor and the 37 employee, within thirty (30) days of the excess accrual.
Scheduling Compensatory Time Off. Scheduling Compensatory Time Off is hereby modified to provide that employees assigned to the special weekend shift schedule shall schedule compensatory time off and utilize compensatory time in the same fashion as modified for the scheduling and utilization of vacation time.
