Seniority Factors. The Employer and the Union agree that in selecting employees for a job opening, appointment will be made of the most senior applicant on the applicable list, (the regular employee seniority list) who meets the normal requirements of the job with a reasonable amount of orientation and training. If there are no applicants from the applicable list, applications will be considered from the other list (the on-call employee seniority list) and an appointment made of the most senior applicant who meets the normal requirements of the job with a reasonable amount of orientation and training.
Seniority Factors. (a) The Employer and the Union agree that in cases of transfers and promotions (other than promotions to positions outside of the bargaining unit) and demotions, the following factors shall be considered:
(i) current: ability, experience, performance and qualifications;
(ii) length of continuous service. Where the factors in sub-paragraph (i) are relatively equal, seniority shall govern. This provision shall not be exercised in an arbitrary manner.
(b) The Employer and the Union agree that in case of lay-off or recall (other than a lay-off as a result of the elimination of the nurse's position, in which case clause 8.03 applies), length of continuous service shall govern provided the nurses in question have the qualifications, ability and experience to perform the work available.
Seniority Factors. When filling vacancies, the Corporation will consider:
(a) skill, ability, experience, knowledge, training and physical fitness;
(b) seniority. However, having regard to the fact that the Employees are assisting in the operation of a Home for the Aged, the Union agrees that the qualifications in factor (a) must govern, and only where such qualifications of the Employees involved are relatively equal, will factor (b) govern. Having in mind the importance of operating the Home for the utmost benefit of its Residents, the Corporation shall be the judge of the qualifications in factor (a).
Seniority Factors. The Employer and Union agree that in cases of transfers, promotions (other than promotions to positions outside of the bargaining unit), demotions and increase or decrease of forces in a classification, the following factors shall be considered:
(a) skill, ability, experience, knowledge, training, integrity and
Seniority Factors. At each mine on the Marquette Range in Michigan in all cases of promotion (except promotion in positions excluded from the appropriate bargaining units as defined in Section II. of this Agreement) and for the purpose of layoffs in connection with the decreasing of the working forces and of the recalling to work of men so laid off, the following factors shall be considered; and if factors B. and C. are relatively equal, the length of continuous service shall govern:
A. Length of continuous service with the Company
B. Physical fitness, and
C. Ability to perform the work.
Seniority Factors. The Employer and the Union agree that in the case of promotions (other than promotions to positions outside of the bargaining unit), transfers and permanent lay-off or recall, the following factors shall be considered:
a) current qualifications including ability, (including but not limited to communication and interpersonal skills with tenants and with fellow staff), knowledge, education, skill, physical fitness, experience and capability of assuming positions of responsibility;
b) length of continuous service. Where the factors in (a) are relatively equal, then (b) shall govern, provided, however, that the Employer will not act in an arbitrary, capricious or discriminatory manner.
Seniority Factors. The Corporation and the Union agree that in the cases of promotions (other than promotions to positions outside of the bargaining unit) and demotions and in all cases of increase or decrease of forces, seniority shall be the governing factor, provided that the employee has the skill, ability and qualifications to perform the work. When the Corporation decides to make a reduction in the number of employees or to rehire other than according to seniority, the Corporation will notify the Union xxxxxxx, and the Union Grievance Committee will have five days from the date of mailing or delivery of the notice to make representations. All full-time Emergency Medical Care Assistants accumulate seniority based on their date of hire. Effective date of ratification all part-time Emergency Medical Care Attendants accumulate seniority on the basis of all regular hours worked. Seniority will be converted on the basis of 2080 hours of work equals one (1) year of full-time seniority. For the purpose of wages, vacation and overtime, all Emergency Medical Attendants (Part-time) gain progression on the basis of all part-time regular hours worked. Where a part-time employee is off due to either a) illness or injury or b) a work- related injury and is in receipt of WSIB benefits, the employee shall receive credit for seniority based upon the employee’s average weekly hours in the ten (10) weeks immediately preceding the date of the injury. In addition, a Regular part-time employee who has completed their probationary period, who is absent on sick leave without pay for a period of over a week and provides a Doctor’s note supporting such absence shall receive credit for seniority based upon the employee’s average weekly hours in the ten (10) weeks immediately preceding the commencement of sick leave without pay.
Seniority Factors a) In layoffs and rehires, preference will be given to Employees with the greatest length of service with the Employer in their classification unless the necessities of the operation require the skills and abilities of a specific Employee.
b) If a layoff exceeds thirty (30) days, and is not based on seniority, an Employee having seniority and the qualifications and ability to perform the work, shall be given three (3) days to demonstrate his ability and qualifications. The decision of the employer shall be subject to the grievance procedure.
c) In the case of transfers, promotions (other than promotions to positions outside the bargaining unit) or demotions, preference will be given to Employees on the basis of skill, ability and efficiency. Where these factors are relatively equal, preference will be given to the Employee with the greatest seniority in his classification.
Seniority Factors. The Employer and the Union agree that in the cases of transfers or promotions, the following factors shall be considered for bargaining unit employees applying for these positions;
(a) Current qualifications including required knowledge, education, ability and skills.
(b) Seniority. The Union agrees that the qualifications of factor (a) must govern and only where such qualifications of the employees involved are relatively equal will factor (b) govern.
Seniority Factors. 1) The Agency and the Union agree that in the case of permanent lay-off or recall, seniority will govern.
2) The Agency and the Union agree that in the case of promotions (other than promotions outside of the bargaining unit), transfers and postings, the only factor to be considered will be seniority.
