STAFF PLACEMENT. 22.01 (a) Except where otherwise stated in this Agreement, for the purposes of hiring and contested vacancies, but excluding administrative/supervisory positions in Article 24, selection of the successful applicant shall be based upon either the evaluative approach or the seniority-dominant approach, as described in Article 22.02 herein.
STAFF PLACEMENT. 15.01 The Board shall place teachers in accordance with the following order of priority:
(a) firstly, any teacher who has in the previous school year been transferred pursuant to clause 13.09
(a) shall be offered any vacant or unfilled position at his/her original school;
(b) secondly, any teacher who has been declared surplus according to the provisions of clause 12.05 and teachers who cannot be placed after school closures and re-alignment pursuant to clause 13.11 shall be offered any vacant or unfilled position;
(c) thirdly, permanent contract teachers who have made application during two rounds of teacher initiated transfer according to the provisions of clause 13.04;
(d) fourthly, teachers on the Re-employment List shall be hired according to the provisions of clause 11.09 (e);
(e) fifthly, teachers who have applied for positions posted pursuant to Article 16 – Vacancies and Appointments and Article 14 – Term Recall;
STAFF PLACEMENT. (a) Except where otherwise stated in this Agreement, for the purposes of hiring and contested vacancies, but excluding administrative/supervisory positions in Article 25 – Administrative Positions, selection of the successful applicant shall be based upon either the evaluative approach or the seniority-dominant approach, as described in Article 23.02 herein.
(b) The evaluation of qualifications, abilities and experience shall be determined by the Board, provided that when qualifications, abilities and experience are relatively equal, seniority shall be the determining factor.
23.02 For purposes of this Article, one of two (2) approaches to selection of applicants shall apply:
(a) The evaluative approach, whereby selection of the most suitable applicant shall be based upon qualifications, abilities and experience to perform the requirements of the position; and
(b) The seniority-dominant approach, whereby selection of the successful applicant shall be based upon seniority, conditional upon the successful applicant possessing the qualifications, abilities and experience necessary to perform the requirements of the position.
23.03 The Board shall notify, in writing, the Presidents of the NSTU Locals of the percentage weights attached to each criteria in the evaluative approach and the seniority-dominant approach pursuant to Article 23.02 prior to the implementation of Article 23.07.
23.04 In all such staffing decisions, the Board shall be bound by its Hiring of Staff Policy.
23.05 In the event the Board, or its delegate, shall choose not to accept the recommendation of the Interview Team, such decision shall be open to grievance and reviewable by an arbitrator, whose decision on the matter shall be final and binding upon the parties.
23.06 In all such staffing decisions, the evaluation of the Board with respect to qualifications, abilities and experience, under all Articles of this Agreement, shall be objectively determined. Any teacher who feels aggrieved by such evaluation process shall be entitled to request of the Superintendent of Schools, or designate, an explanation/interview to discuss the evaluation process.
23.07 When positions are to be filled, the Board shall select and place teachers in accordance with the following methods and priorities:
(a) First, for administrative positions, in accordance with Article 25 – Administrative Positions and the approach described therein;
(b) Second, any teacher who has in the current school year or previous schoo...
STAFF PLACEMENT. The following procedure is intended for use in identifying teachers to be laid off in accordance with seniority, certification and qualification. Beginning with the first name of the seniority list, each individual will be assigned in accordance with the following sequence of priorities:
a. Current assignment (defined as more than one-half of a teacher’s current assignment in his/her area of certification and qualification). If a full-time teacher does not receive a full-time assignment under this step, he/she shall have the right to move down the sequence of priorities to locate the first full-time assignment for which he/she is certified and qualified.
b. Current grade/department in another building; if not available, then
c. Another grade/department in same building; if not available, then
d. Another grade/department in another building.
e. If no position remains in any grade/department for which the employee is certified and qualified, in any building, the employee will be laid off. Written notification of layoff according to the contract will be forwarded to the affected teacher, with copies to the Association. When a choice of building, grade, or department is possible (within any of the above sequences, a through d) for a displaced teacher, the teacher's choice shall be honored. A "displaced" teacher is identified as one whose position has been reduced by one-half or greater, or when no class/period exists for which he/she is certified and qualified. A teacher is considered "displaced" until he/she is placed in another position using the above procedures or until he/she is laid off.
STAFF PLACEMENT. 3.1 In order to ensure that businesses related to the Purchased Assets are smoothly operated by Shenzhen Subsidiary after acquisition is completed, Party A agrees to take over the staff members of Party B as listed in Annex 4 hereto according to the provisions herein (if the staff members listed in Annex 4 hereto change after the conclusion hereof and before Closing of assets Shenzhen Subsidiary and Party B shall separately negotiate and determine this issue); Party B is responsible for following the provisions in Article 3.2 and other provisions herein in arranging the above-mentioned staff members for accepting the employment notices of Shenzhen Subsidiary and working at Shenzhen Subsidiary. At the same time, Party B hereby warrants that it will not solicit, seduce or otherwise make any of the above-mentioned staff members refuse to work for Shenzhen Subsidiary nor will it attempt to do so.
3.2 Party B shall terminate labor contracts with Party B’s staff members listed in Annex 4 hereto by September 30, 2010. Party B ensures Party B’s shareholders and officers (i.e. Xxxxx Xxxxx, Hu Zhenning, etc.) sign Shenzhen Subsidiary labor contracts, confidentiality agreements and non-competition agreements on the date hereof; Party B ensures that Party B’s key employees (i.e. Chen Shunhuang and Xxx Xxxxxx) will sign labor contracts and confidentiality agreements with Shenzhen Subsidiary within five days after the establishment of Shenzhen Subsidiary; Party B’s ordinary employees will sign labor contracts and confidentiality agreements at their own discretion with Shenzhen Subsidiary.
3.3 Shenzhen Subsidiary will observe the PRC laws and regulations and this Agreement in signing labor contracts and confidentiality agreements with relevant staff members as listed in Annex 4 hereto. After the new employment relationships have taken effect, Shenzhen Subsidiary will be responsible for paying the above-mentioned staff members’ salaries and remunerations, social insurance as well as employee welfares and expenses as provided for in relevant laws and labor contracts. Before the new employment relations take effect, the same shall be borne by Party B.
3.4 Party B hereby confirms that, as the employer, it has performed all the obligations for the staff members listed in Annex 4 hereto as specified in the PRC Laws, regulations and labor contracts. STAFF PLACEMENT. 18.01 The Board shall place teachers in accordance with the following order of priority:
(i) firstly, any teacher who has in the previous school year been transferred pursuant to Article 16.10
(i) shall be offered any vacant or unfilled position at his/her original school;
(ii) secondly, any teacher who has been declared surplus according to the provisions of Article 15.05 and teachers who cannot be placed after school closure and realignment pursuant to Article 16.12 shall be offered any vacant or unfilled position;
(iii) thirdly, teachers who have made application during two rounds of teacher initiated transfer according to the provisions of Article 16.
(iv) fourthly, teachers on the Re-employment List shall be hired according to the provisions of Article 14.09 (v);
(v) fifthly, teachers who have applied for positions posted pursuant to Article 19 - Vacancies and Appointments and Article 17 - Term Recall;
(vi) sixthly, transfers initiated by the Board according to the provisions of Article 16.09;
(vii) seventhly, new teachers shall be hired.
STAFF PLACEMENT. Teachers already on staff shall be given full credit for previous experience on the Park West Division staff plus credit for previous experience as provided in above. No teacher at present on the Park West staff shall suffer a reduction in salary according to Article and Teachers employed under contract on a part-time basis shall:

STAFF PLACEMENT. 1. Beginning with the first names on the seniority list, each individual will be placed in an assignment matching his current grade, if an elementary teacher, or department, if a secondary teacher.
2. If no vacancy exists in the teacher's current grade or department, teacher will be assigned to another grade or department for which he/she is certified. If such placement occurs in the 7th or 8th grades and the teacher does not possess a major or minor, the Board may require that individual to present a plan to the Administration which would gain at least a minor in the field within two (2) years from the date of assignment or a period which encompasses two (2) xxxxxxx whichever is less. If the teacher does not complete a minor within the two years, he/she may be laid off. If a teacher chooses to not present a plan to gain a minor in the area of assignment, he/she may be laid off.
3. If no vacancy remains in any grade or department for which the teacher is certified, the teacher will be laid off. The effective date of any such layoff shall be the firth day of the forthcoming school year. If economic or enrollment changes occur during a school year which are greater than those specified in Paragraph 1., the parties agree to re-open this paragraph of the Agreement.
4. A teacher with a major in a field will not be replaced by a teacher with a minor with more seniority. Deckerville EA Contract - 1997-2000 Page 27 A teacher with lesser seniority in a field who has a major or minor will not be replaced or displaced by a teacher with greater seniority who is certified. Any teacher currently in a position for which he/she is certified but not qualified (possessing a major or minor) shall have the same amount of time to obtain a major or minor as set forth above.
STAFF PLACEMENT. 3.1 Party A shall guarantee to maintain sufficient labor force of the Cunliji gold mine necessary to sustain normal production activity of the mine after the execution of this agreement.
3.2 Party B shall be obliged to hire back, under a new employment contract, sufficient labor force of the Cunliji gold mine necessary to sustain normal production activity of the mine after the execution of this agreement.
3.3 Party B shall remunerate the above-mentioned labor force of the Cunliji gold mine (including salary and fringe benefit) in accordance to the Labor Law in the PRC.
3.4 After the execution of this agreement, Party A shall be obliged to take up all other labor of the Cunliji gold mine not employed by Party B.
