VACANCIES AND APPOINTMENTS. In case of a Trustee's declination to serve, death, resignation, retirement, removal, physical or mental incapacity by reason of illness, disease or otherwise, or if a Trustee is otherwise unable to serve, or if there is an increase in the number of Trustees, a vacancy shall occur. Whenever a vacancy in the Board of Trustees shall occur, until such vacancy is filled, the other Trustees shall have all the powers hereunder and the certificate of the other Trustees of such vacancy shall be conclusive. In the case of a vacancy, the remaining Trustees shall fill such vacancy by appointing such other person as they in their discretion see fit, to the extent consistent with the limitations provided under the 1940 Act. Such appointment shall be evidenced by a written instrument signed by a majority of the Trustees in office or by resolution of the Trustees, duly adopted, which shall be recorded in the minutes of a meeting of the Trustees, whereupon the appointment shall take effect. An appointment of a Trustee may be made by the Trustees then in office in anticipation of a vacancy to occur by reason of retirement, resignation or increase in number of Trustees effective at a later date, provided that said appointment shall become effective only at or after the effective date of said retirement, resignation or increase in number of Trustees. As soon as any person appointed as a Trustee pursuant to this Section 3.04 shall have accepted this Trust, the trust estate shall vest in the new Trustee or Trustees, together with the continuing Trustees, without any further act or conveyance, and such person shall be deemed a Trustee.

VACANCIES AND APPOINTMENTS. 7.4.1 Where an employer intends to fill a position that is vacant in Te Kura (other than with a fixed term employee) the employer shall wherever practicable, notify or advertise the vacancy in a manner sufficient to enable suitably qualified persons to apply for the position. 7.4.2 Attention is drawn to the State Xxxxxx Xxx 0000 in so far as it provides that the person best suited to the position shall be appointed. 7.4.3 Every appointee to a vacancy shall be notified in writing of: (a) the appointment; and (b) the salary to be paid; and (c) the hours and weeks to be worked; and (d) the purpose and /or duration of employment if the appointment is to a fixed term position.
VACANCIES AND APPOINTMENTS. 16.01 A list of all teaching and supervisory positions that become vacant or are created in the system shall immediately be sent by the Director of Human Resources or his/her designate to each school at least three (3) working days prior to the closing date for applications and shall be immediately posted in the school or workplace by the Principal and/or the Union representative. 16.02 During summer vacation, such positions will be advertised in a provincial newspaper or, at the option of the Director of Human Resources, through an electronic means that is widely available to teachers. The Union and the teachers shall be informed as to the procedure to be used by the Human Resources Department. 16.03 Permanent contract teachers presently in the employ of the Board shall be given priority in filling all vacant and unfilled positions within the system provided they possess the necessary qualifications. Where the final selection is between two internal candidates who, in the opinion of the Director of Human Resources are equally qualified and competent, seniority shall be the deciding factor. 16.04 Where posted qualifications and job description for a position have been significantly altered, the position shall be reposted. 16.05 In filling vacancies, the Board shall consider applications that adhere to its application procedures. If a vacancy is not filled from the original applicants, and the Board still wishes to fill the vacancy, the Board will call for further applications. All internal applicants will be considered and only the short listed candidates will be interviewed. 16.06 Interviews shall be held by the Board for all supervisory positions which become vacant. Administrative vacancies shall only be declared after consideration is given to Board initiated and/or teacher initiated requests for transfers to an equivalent position. Among the considerations in determining an equivalent position shall be the number of teachers and grade levels taught. 16.07 In order to minimize disruption to students during the school year, the parties agree that where the Board determines there is a vacancy in a permanent teaching or supervisory position which occurs after the twentieth (20th) teaching day of the school year, the Board may fill the permanent teaching vacancy or the supervisory position on a temporary basis. The permanent vacancy will then be posted in sufficient time for the filling of the permanent vacancy prior to the commencement of the next school ...
VACANCIES AND APPOINTMENTS. 27.01 Notice of all teaching vacancies, including administrative/ supervisory positions, as well as newly created positions, shall be posted on the Board’s web site. (a) The Board shall maintain a website with up to date listings of all teaching vacancies, including administrative/supervisory positions. (b) Administrative and supervisory vacancies shall be filled according to the provisions of Article 28 - Administrative Positions. (c) Applications for such vacancies shall be forwarded to the Human Resources Department, according to the time frame described in the posting using the Board on-line application system. (d) Normally, all short listed applicants shall be given a minimum of twenty-four (24) hours notice of an interview. (e) All short listed applicants shall be advised of the decision of the Board within five (5) working days of such decision. If the appointment is contrary to the recommendation of the interview team, and the teacher has not been awarded a position of equal or greater percentage or status, the teacher shall be notified by the Director of Human Resources, or designate from the Department of Human Resources, of the reasons for the denial of the recommendation of the interview team.
VACANCIES AND APPOINTMENTS. 13.1 In the event that a vacancy is to be filled, the employer shall provide notice to each association member. 13.2 Reasonable effort will be made by the employer to offer the employee(s) whose position is reduced or eliminated an alternative position for which they are qualified if such a position is available. Such offer of employment may require the affected employee to relocate to a different facility in the School Division. 13.3 Transfers and offers of other employment: The employer has the right to allocate its staff as it sees fit with regard to the operational needs of the organization. Every effort will be made to manage transfers or relocation of staff in a manner that is not a hardship on the employee. Employees will not be required to transfer to a position that is greater than 30 minutes from their home location. If upon being offered a position which requires the employee to relocate their place of employment to a location not farther than 30 minutes from their home, and the employee refuses to accept this offer then the employee will be released from employment in accordance with The Employment Act. 13.4 At the same time that a vacancy is posted internally, the Board may also advertise publically. All Support staff employed in the previous twenty‐four months shall be considered for re‐employment prior to the hiring of any new support staff. 13.5 Support staff within the given school that has the vacancy occurring will be given consideration before employees in other schools. 13.6 Effective date of signing, in situations where other employment or transfers are not available and the employee is to be laid off, the following shall serve as notice time or payment in lieu based on their years of employment with the Horizon School Division or a legacy school division: a. One (1) week written notice, if the period of employment is less than one year; b. Two

As well the Board shall post the list at the Centre. After June 30, the Board may advertise externally and fill positions on a term basis in accordance with the qualifications it determines are necessary. Internal candidates may apply after June 30, at the same time, in accordance with the same criteria as external candidates. After June 30, when the Board hires from outside APSEA, it shall offer a term or probationary contract and the position shall be for one year. The positions shall be available to all teachers in the following school year pursuant to 16.04.
