Structural Efficiency. At each plant or enterprise a consultative mechanism may be established upon request by the employees. The consultative mechanism and procedure shall be appropriate to the size, structure and needs of the plant or enterprise. Measures raised for consideration shall be consistent with subclause (2) of this clause.
Structural Efficiency. (a) Arising out of the decision of the State Wage Case on 8 September 1989 and in consideration of the wage increases resulting from the first structural efficiency adjustment operative from the commencement of the first pay period beginning on or after 27 October 1989, employees are to perform a wider range of duties including work which is incidental or peripheral to their main tasks or functions.
(b) Arising out of the decision on 8 September 1989 in the State Wage Case the parties to this Agreement are committed to implementing a new wage and classification structure. In making this commitment, the parties -
(i) accept in principle that the descriptions of job functions within a new structure will be more broadly based and generic in nature;
(ii) undertake that upon variation of the Agreement to implement a new wage and classification structure, employees may undertake training for a wider range of duties and/or access to higher levels in accordance with the definitions and training standards laid down in the Agreement variation relating to a new classification structure;
(iii) will co-operate in the transition from the existing classification structure to the proposed new structure to ensure that the transition takes place in an orderly manner without creating false expectations or disputation.
(c) In the event that there is a claim for reclassification by an existing employee to a higher level under any new structure on the ground that the employee possesses equivalent skill and knowledge gained through on-the-job experience or on any other ground, the following principles apply -
(i) The parties agree that the existing Agreement disputes avoidance procedure shall be followed.
(ii) Agreed competency standards shall be established by the parties in conjunction with TAFE and SESDA (when operative) for all levels in any new classification structure before any claims for reclassification are processed.
(iii) An agreed authority (such as TAFE or SESDA) or agreed accreditation authority (when operative) shall test the validity of an employee's claim for reclassification.
(d) Reclassification to any higher level shall be contingent upon such additional work being available and required to be performed by the employer.
(e) The parties are committed to modernising the terms of the Agreement and to addressing the issues associated with training in an endeavour to finalise matters by 1 January 1990. SECOND SCHEDULE - NAMED PARTIES TO THE AWARD Communications, E...
Structural Efficiency a. The parties to this Agreement are committed to co-operating positively to increase efficiency and productivity within the Company and to enhance the career opportunities and job security of employees.
b. The parties agree that a JCC shall be established and recommendations made to the Company in the consideration and implementation of all aspects of the structural efficiency principles of the National Wage Case, and on an ongoing basis facilitate employee involvement in issues that affect the work and conditions of those employed under this Agreement. The parties recognise that the deliberations of the JCC do not compromise the independent position of either the Company or the Union.
i. Without limiting the scope of consultation and negotiation the primary matters for consideration by the JCC shall be those of a wide nature arising out of, or affecting employment with the Company.
c. Measures raised for consideration consistent with clause 21(b) herein shall be related to:
i. Further facilitative provisions being negotiated for this Agreement.
ii. Matters concerning training.
iii. Relaxation of demarcation issues.
iv. A review of management and work practice inefficiencies.
v. Identifying outdated agreements which inhibit the efficient and effective operation of the Company in carrying out its statutory responsibilities.
d. Any disputes arising in relation to the implementation of the above shall be subject to relevant dispute/demarcation settling procedures contained in this agreement or be referred directly by either party to the FWC for conciliation and/or arbitration.
e. Without limiting the rights of the parties to arbitration at any time, any other measures not referred to in clause 21c herein designed to increase flexibility within the Company and sought by any party shall be notified to the FWC and by agreement of the parties involved shall be implemented subject to the following requirements:
i. The majority of Employees affected by the change at the workplace or within the Company must genuinely agree to the change.
ii. No Employee shall suffer a loss in their ordinary rate of pay.
iii. The parties shall not unreasonably oppose any agreement.
iv. Any agreement shall be subject to approval by the FWC and if approved, shall operate as an Appendix to this agreement and take precedence over any provision of the Agreement to the extent of any inconsistency. Flexibility in Employment

Structural Efficiency. To gain maximum efficiency at the enterprise the following shall apply:
a) Employees may be directed to carry out such duties and use such tools as may be required, which are within the limits of the employee’s skill, competence and training, including but not limited by duties which are incidental and peripheral to the employee’s main task or function;
b) Employees may be directed to transfer to another job, or location, or onto or off a building or construction site;
c) Any instruction issued by the Company pursuant to sub clause (a) and (b) of this clause shall be consistent with the Company’s responsibility to provide a safe working environment.
Structural Efficiency. 29.1 The parties to this Agreement are committed to co-operating positively to increase the efficiency, productivity and international competitiveness of the Company and to enhance the career opportunities and job security of employees of the Company.
29.2 The Company shall establish a consultative mechanism and procedures that are appropriate for consultation and negotiation on matters affecting their efficiency and productivity.
Structural Efficiency. 9.1 The parties to this Industrial Agreement are committed to co-operating positively to increase the efficiency, productivity and competitiveness of the Company and to enhance the career opportunities and job security of employees in the industry.
Structural Efficiency. 10.1.1 At each plant or enterprise, an employer, the employees and where relevant, the organisation that is the chosen representative of the employees, may establish consultative mechanisms and procedures appropriate to the size, structure and the needs of that plant or enterprise which enables them to communicate and consult about matters arising out of this Agreement.
10.1.1(a) Measures raised by the employer, employees, the organisation that is the

10.1.3 Without limiting the rights of the employer, employees, or a union or other chosen representative of the employees, any other measure designed to increase the flexibility at the plant or enterprise and sought by any party shall be notified to the Commission and by agreement of the parties involved shall be implemented subject to the following requirements:
Structural Efficiency. 3.1.1 The employer may direct an employee to carry out duties and use tools and equipment that are within the limits of the employee's skill, competence and training and are consistent with the classification structures in this Agreement provided that such duties are not designed to promote xx-xxxxxxxx.
Structural Efficiency. The parties are committed to continuously modernising and reviewing the terms of this Agreement so that it provides for more flexible working arrangements, improves the quality of working life, enhances skills and job satisfaction and assists positively in the restructuring process. The parties recognise that this on-going process of change is based on consultation, provision of training, skill formation and commensurate and appropriate career paths.
Structural Efficiency a. The parties to this Agreement are committed to co-operating positively to increase the efficiency, productivity, and competitiveness of the enterprise and to enhance the career opportunities and job security of employees in the enterprise. The parties will utilise established consultative mechanisms and procedures to deal with matters related to achieving these aims.
b. Any disputes arising in relation to this clause will be resolved in accordance with Clause 11 (Avoidance of Industrial Disputes).
