Use of License Area a) The Licensee shall use the Commercial Space for the sole purpose of temporarily extending the Licensee's existing business services on the Lands. b) The License Area shall not be used for the storage of any materials other than tables, chairs, and umbrellas. Whenever furniture is stored on the License Area, it shall be stored so as not to obstruct passage or be a safety hazard. c) The License Area shall not be used for cooking, barbecuing or preparation of food or refreshments or for the storage of food or refreshments without the express permission of the Licensor. d) The Licensee shall not do or permit to be done any act or thing, which in the opinion of the Licensor might interfere with, injure, impair the operating efficiency of, or obstruct access to or the use of the City Parcel. e) The Licensee shall clean the License Area and the surrounding part of the City Parcel each day, before and after closure of its business, and remove the refuse to a suitable container that belongs to the Licensee.

Use of License Area. During Use Days (as defined in Section 4 below), PG&E and its employees, contractors, agents, and representatives ("PG&E's Representatives") may enter the License Area for purposes of establishing and operating a customer resource center in the case of a PSPS Event. LICENSOR acknowledges that PG&E's Activities may include the following: setting up tents with tables and seating where PG&E customers can obtain water and snacks, charge phones, and get up-to-date information on outages; installing trailers, portable toilets, portable back-up generators, and temporary fencing; parking mobile vehicle units and other vehicles. For purposes of this License Agreement, a "PSPS Event" means the existence of one or more environmental conditions creating extreme fire danger that results in the shutoff of power for public safety. Examples of PSPS Events include red flag warnings issued by the United States National Weather Service, low humidity levels, high winds, and dry vegetation.
Use of License Area a. Licensee shall use the License Area solely for the parking of a maximum of four (4) passenger motor vehicles in connection with the Licensee's use for customers and employees (the "Permitted Uses"), and for no other purpose whatsoever. b. Without limiting the foregoing, Licensee agrees that neither Licensee nor Licensee's Agents shall charge any visitor, customer or invitee a fee for parking in the License Area.. Licensee agrees to keep, perform and observe all rules and regulations from time to time promulgated by Licensor with regard to the License Area.
Use of License Area. The Licensee shall be allowed to access and use the License Area for the purpose of launching boats or other watercraft, retrieving boats or other watercraft, picking up commercial passengers, and dropping off commercial passengers, and for no other purpose unless authorized by the City in writing (the “Licensed Activities”).
Use of License Area. The Historical Society shall maintain the License Area in good and safe condition. Upon the approval of the Town, the Historical Society may place signage and make improvements on the License Area. The Town shall have no responsibility, liability, or obligation with respect to the safety or security of any the improvements or other personal property of the Historical Society placed or located on, at, or in the License Area, it being acknowledged and understood by the Historical Society that the safety and security of any such property is the sole responsibility and risk of Historical Society.
Use of License Area. (a) Cleveland Metroparks shall, at all times, exercise all reasonable care to guard the License Area against damage by Cleveland Metroparks’ invitees, guests or others, and keep the License Area clean and free from refuse and debris. (b) Neither Party shall not park any vehicle or equipment so as to block access to the License Area by emergency, Police, fire or medical vehicles. Both Parties shall also ensure that its employees, invitees, and guests park in designated parking areas only. (c) Except as necessary for construction or maintenance of the Improvements, neither Party shall not store any materials or equipment in the License Area. (d) During the term of the License, at Cleveland Metroparks’ sole cost and expense, Cleveland Metroparks shall maintain the License Area consistent with Cleveland Metroparks park maintenance practices.
Use of License Area. (a) Licensee shall only use the License Area for the Permitted Use. No other use of the License Area is permitted without the prior written consent of Licensor, which consent may be withheld at Licensor’s sole discretion. Licensee agrees to be in compliance at all times and to comply with such Governmental Requirements imposed upon the License Area and/or the Licensee and shall not in any way subject Licensor to liability or exposure for failure to adhere to the same. (b) Licensee shall not discriminate against any person on the basis of race, creed, color, sex, religion, national origin, age, marital status or disability in its use and operations of the License Area. (c) Licensee acknowledges and agrees that, while Licensor may (but shall not be obligated to) provide a security guard and alarm system for the Building, Licensor is not providing any security services with respect to the Building, the License Area or otherwise, and Licensor shall not be liable for, and Licensee hereby waives any and all claims against Licensor with respect to, any loss by theft or any other damage or injury suffered or incurred in connection with any unauthorized entry into the License Area or Building or any other breach of security with respect to the same. (d) Licensee shall only use the License Area during the hours of 7:30 a.m. and 7:30 p.m., Monday through Friday, as may be adjusted by Licensor in its reasonable discretion from time to time. Licensee’s use of the License Area shall not include Saturdays, Sundays, or holidays observed by Licensor without the prior written consent of Licensor, which consent may be withheld at Licensor’s sole discretion. (e) For the Term of this License and any extension thereof, Licensee shall provide at its sole cost and expense Licensee employees and/or volunteers to staff the 1st Floor Reception Desk within the License Area. Such staff shall be provided by Licensee and staff the reception desk and work the normal business hours of the Building, defined as Monday through Friday, 8 a.m. to 5 p.m., or as otherwise designated by Licensor from time to time in its reasonable discretion. (f) Licensee shall have the right to non-exclusive use of the Common Areas, together with any other tenants or licensees occupying the Building; provided however, that the Common Areas shall at all times be subject to the exclusive control and management of the Licensor. Use of License Area. 5.1. Licensee shall use the License Area only for supporting or housing the Utilities or allowing them to occupy the airspace or underground space included within the License Area, and for no other purpose whatsoever. Licensee shall not construct or create any Utilities or facilities other than those defined as Utilities in, on or about the License Area or the Land. 5.2. Following completion of the construction and installation of the Utilities, Licensee shall not make any material alteration, improvement, addition or other installation to the Utilities or otherwise on the License Area without City’s prior written consent. If Licensee desires to make any such material alteration, improvement, addition or installation, Licensee shall submit a written request to City, together with plans of the proposed alteration, improvement, addition or installation, and Licensee shall not commence such work unless and until the City has granted its approval thereto in writing, which approval shall not be unreasonably withheld. Any alteration or improvement made by Licensee shall be completed expeditiously and in compliance with all laws and ordinances and all rules and regulations of any and all governmental authorities having jurisdiction of or over the License Area.
Use of License Area. CITY has advised SEGERSTROM that CITY will be undertaking three (3) construction projects: (1) construction of a northbound off-ramp from the northbound connector road to the 405 Freeway to connect with Xxxxx Xxxxxx (“Off Ramp”), (2) widening of the Fairview Road overpass over the 405 Freeway (“Overpass”) and (3) widening northbound Harbor Boulevard to the north of the 405 Freeway (collectively, “Projects”). CITY shall use the License Area solely as a staging and storage area for vehicles, equipment and materials for the Projects. In connection with such use of the License Area (“Permitted Use”), SEGERSTROM and CITY agree as follows: (a) Persons permitted to exercise the License shall be limited to the CITY, its contractors, subcontractors and consultants and their respective employees, consultants and independent contractors (collectively, “CITY Parties”). . (b) CITY OR CITY Parties may, at their sole expense, pave or place gravel on some or all of the License Area and may erect a fence around the License Area. Upon the termination of the Term, all such materials shall be removed by CITY Parties and the License Area shall, prior to return to SEGERSTROM of the License Area, return the License Area to approximately the same condition less reasonable wear and tear as when CITY or CITY Parties took possession thereof. No improvements other than those specifically permitted pursuant to this subparagraph shall permanently remain in or on the License Area by CITY Parties. (c) Ingress to and egress from the License Area may, during construction of the Off-Ramp, be along the length of the westerly boundary of the License Area. Thereafter, ingress to and egress from the License Area shall be solely through the intersection depicted on Exhibit A and to be constructed with or as a part of the Off-Ramp. In addition, and subject to obtaining the right to do so from the owner of the Xxxxxx flood control channel (“Channel”), CITY Parties may use the Channel for purposes of moving materials and equipment to and from the License Area and the Overpass. In such event, ingress to and egress from the License Area may be from the Channel into the southerly boundary of the License Area. In no event shall CITY or CITY Parties have ingress to or egress from any other portion of the Home Ranch onto the License Area. During Use Days PG&E shall have the non-exclusive right to use the License Area, up to twenty-four (24) hours per day. Hours for use to PG&E customers shall be from 8:00 am to 10:00 pm. On Use Days, the License Area shall be fully staffed by PG&E and its representatives, at PG&E’s sole cost and expense. PG&E shall provide uniformed unarmed security at its cost and expense to ensure the protection of its equipment, the safety of the public and to prevent any damage to the Property.
