Voluntary Lateral Transfers. A faculty member may request a voluntary lateral transfer to a new or vacated position to take effect at the beginning of the next academic semester. A. The request for voluntary lateral transfer may be initiated at any time. B. All requests for voluntary transfers shall be considered on the basis of (1) minimum qualifications as defined in 5 CCR §53410, (2) reasonableness, and (3) seniority. C. No faculty member shall be overtly or indirectly coerced by management to seek a voluntary lateral transfer. D. If a voluntary transfer request is denied, the faculty member, upon request, shall be provided with the reasons for the denial.

Voluntary Lateral Transfers. Employees may request to be transferred to a vacant position within their classification or grade in another department/division and may be transferred pursuant to such request with the written approval of their department head, the involved appointing authority and the Employer's Director, Labor Relations. Such transferred employees shall serve a six (6) month probationary period in the new position. If removed by the appointing authority during the probationary period, the involved employee shall be reassigned to a vacant position within the classification or, if none is available, to their previous position.

In either event, the request shall be made on a "Teacher Transfer Request" form and sent to the Human Resources office. 11.1.1.1 Whenever application is made for a transfer to take effect during the school year, it shall be made within ten (10) days of the posting of the "Notice of Vacancy". 11.1.1.2 Whenever the request is made for a transfer to take effect at the beginning of the next school year, it shall be made no later than June 16 of the school year preceding the effective date. 11.1.1.3 All requests for voluntary transfers shall be considered on the basis of four (4) criteria: (1) credentials to perform the required services; (2) District-wide seniority; (3) professional qualifications; and (4) the needs of the District. 11.1.1.4 Voluntary transfer requests by a teacher for any opening shall be given priority consideration over a new teacher. 11.1.1.5 A teacher shall not be pressured by the District to seek a voluntary transfer. However, conscientious advisement may be offered for self-improvement. 11.1.1.6 If a voluntary transfer request is denied, the teacher shall be provided with written reasons within ten (10) days of a written request. 11.1.1.7 Teacher Transfer Request" forms shall be available at all sites. 11.1.1.8 Voluntary transfer requests shall not be denied arbitrarily.

Voluntary Lateral Transfers. Management agrees to provide a uniform procedure for considering employees’ requests for transfer at the time vacancies are to be filled. All vacancies will be posted on the Transfer Opportunities website (xxxx://xxx.xxxxxxxxxx.xxxx). On or before January 1st and July 1 st of each year, Employees wishing to transfer will forward a written request to the Human Resources Manager and Director of Environmental Health Services. These written requests will be maintained in an active file within the Human Resources office for a period not to exceed six (6) months. The six month period will be January 1 through June 30 and July 1 through December 31, each year. Employees desiring to keep their individual request active beyond the above time limit must submit a new written request. Each January and July, management will review requests for transfer and attempt to accommodate employee preferences. Transfers will be made based on the needs of the service.
