Access During Construction. During construction of the Tenant Improvements in the Premises with the approval of Landlord, Tenant shall be permitted reasonable access to the Premises, as long as such access does not interfere with or delay construction work on the Premises for the purposes of taking measurements, making plans, installing trade fixtures, and doing such other work as may be appropriate or desirable to enable Tenant eventually to assume possession of and operate in the Premises.
Access During Construction. During construction of the Tenant Improvements and with prior approval of Landlord, Tenant shall be permitted reasonable access to the Premises for the purposes of taking measurements, making plans, installing trade fixtures, installation of voice/ data cabling and doing such other work as may be appropriate or desirable to enable Tenant to assume possession of and operate in the Premises; provided, however, that such access does not interfere with or delay construction work on the Premises and does not include moving furniture or similar items into the Premises. Prior to any such entry, Tenant shall comply with all insurance provisions of the Lease. All waiver and indemnity provisions of the Lease shall apply upon Tenant’s entry of the Premises.
Access During Construction. At least one elevator to the Demised Premises shall be available at all times during construction, to be coordinated with Lessor’s construction or property management representative, to bring materials to the space for the purposes of modifying the Demised Premises. Subject to the rules and regulations attached hereto as Annex 4-Construction Rules and Regulations and such other reasonable rules and regulations as Lessor from time to time establishes concerning construction work in the Building, Lessor shall assure Lessee of adequate access to the Demised Premises during construction of Leasehold Improvements.
Access During Construction. TxDOT is committed to ensuring safe access to schools and reducing impacts to public transit, pedestrian, and bike access within the project area throughout the construction phase. TxDOT will continue to communicate with schools, parents, neighborhood and community stakeholders, and METRO regarding the construction schedule to ensure continued safe pedestrian, bike and transit access during construction of the Project.
a) School access during construction:
i. In order to ensure that pedestrian and bike access to schools is maintained during construction, during the detailed design phase TxDOT will develop plans for traffic control detours of pedestrian and cyclist movements, as depicted in Exhibit C, showing the locations of schools adjacent to the project footprint, existing routes traveled by children to these schools, routes during construction, and the anticipated finished condition of pedestrian and cyclist routes after construction on the project is completed.
ii. Where construction of the Project will require pedestrian and bicycle detour routes to maintain access to schools, TxDOT commits to bring such designated detour routes up to current standards prior to beginning the associated construction in order to ensure that students, staff, and the public continue to have safe and accessible pedestrian and bicycle paths of travel to those schools.
iii. TxDOT will design and direct its contractor to maintain non-circuitous sidewalks to maintain safe pedestrian and cyclist access to schools during and after construction.
iv. TxDOT will work directly with schools to develop parent and school bus drop-off and pick-up routes, direct TxDOT contractors to maintain the safe operations of these routes during construction, and inform decisions about appropriate detour routes with the goal of safety and minimizing increased commute times.
v. TxDOT will maintain communication with school officials for the design of access accommodations during the construction phase.
vi. TxDOT will provide an ombudsman for the schools to communicate concerns that arise during construction to TxDOT in order for timely resolution of concerns.
vii. During construction, TxDOT will establish and maintain a public website to inform the public about bicycle and pedestrian access. The website will include maps and ways to contact the ombudsman.

Access During Construction. Buyer acknowledges that the Home and Property being purchased pursuant to the Agreement is and shall continue to belong to Seller until Closing. Buyer agrees that neither they, nor their agents or representatives, shall enter onto the Property during construction unless accompanied by Seller’s authorized representative, and then only at the sole risk of Buyer. Buyer further agrees that only Seller and Seller’s employees, Seller’s agents, contractors, or subcontractors are authorized to enter and do work on the Property. Buyer is expressly denied permission to enter the Property, or perform any work on the Home or Property prior to Closing.
Access During Construction. 10.1 If by the provisions of this Agreement, the Developer is required to construct the Municipal Services he shall maintain access to all properties adjacent to the Municipal Services being constructed, during the period of construction, so that the owners of such properties shall have proper ingress and egress to their properties.

Prior to any such entry, Tenant shall comply with all insurance provisions of the Lease. All waiver and indemnity provisions of the Lease shall apply upon Tenant’s entry of the Third Expansion Space.

Tenant shall have the right at Tenant’s sole cost and expense (which may be deducted from Tenant’s Allowance), subject at all times to compliance with the terms of this Exhibit C, to install at the Building to service the Premises, an above ground emergency 277/480 volt diesel generator with an approximate capacity of 125 KW and associated systems related directly thereto, (hereinafter collectively referred to as the “Diesel Generator System”). Tenant agrees that the location, construction and installation of the Diesel Generator System for the Building shall be subject to the prior written approval by Landlord. Tenant shall submit detailed plans and specifications for the Diesel Generator Systems for the Building to Landlord for its review, and if approved by Landlord, for Landlord’s approval prior to the commencement of any construction. Tenant agrees that Landlord shall have the right to require Tenant to make changes in Tenant’s plans and specifications for the Diesel Generator System to avoid any adverse effects to the Premises, the Building, the tenants of the Building or any of the other buildings within Parkway Plaza. It is understood and agreed that any Diesel Generator System must be installed only at the Building and that the Diesel Generator System shall not serve any locations other than the Premises. Tenant acknowledges and agrees that in addition to any approval given by Landlord, in the event that fuel or lubricating oil storage tank(s) and dispensing or distribution systems are installed as part of or related to the Diesel Generator System then Tenant, at its sole expense, shall:

Access During Construction. At such time as such Initial Premises or portions thereof are Sufficiently Complete, the Tenant thereafter shall have, at no cost to the Landlord, full and completed access to such applicable portion of the Initial Premises and all utilities for the purpose of preparing such space for the Tenant’s occupancy, including, but not limited to, moving and installing furniture, fixtures, and equipment, installing supplemental cabling and communications and computer equipment and other technology related equipment, decorating, and performing any other tasks deemed necessary or useful by the Tenant in preparing the Initial Premises for the Tenant’s occupancy. The Tenant acknowledges for itself and its authorized agents, employees and contractors that the access to the Initial Premises shall be afforded during such time as the Initial Premises Work shall be continuing, or any portion thereof, and in that regard, the Tenant releases the Landlord and its members, officers, directors, employees, agents and contractors, from any claim, liability, loss or damage arising out of or related to such access to a site in which the Initial Premises Work is on-going, including without limitation damage to completed portions of the Initial Premises Work, and the Tenant assumes all risk associated with such access, except to the extent of the gross negligence or willful misconduct of the Landlord and its members, officers, directors, employees, agents or contractors. In that regard, the Tenant agrees to indemnify, defend and hold harmless the Landlord and its members, officers, directors, employees, agents and contractors in connection with any claim made against the Landlord arising out of the Tenant’s access to the Initial Premises, or any portion thereof, during such construction phase, except to the extent of the gross negligence or willful misconduct of the Landlord and its members, officers, directors, employees, agents or contractors.
