Breaks and Lunches. Customer Service office employees’ normal lunch break shall begin either at 12:00 noon or 1:00 p.m. All other employees normal lunch break shall begin at 12:00 noon. The above times may be altered at the sole discretion of Management, up to thirty (30) minutes before or after the start of the normal lunch break. Where the work requires and as authorized by Management, an allowance of ten dollars ($10.00) will be paid to each employee required to remain at the work site during the normal lunch break. Attendants on the 11:00 a.m. to 7:00 p.m. and 12:00 noon to 8:00 p.m., afternoon and night shift shall be allowed a half hour paid lunch break during their eight hour shift.

Breaks and Lunches. A. It is recognized by the District and the Union that the Unit contains both non- exempt and exempt employees for purposes of overtime. Those employees who are exempt are not guaranteed rest breaks or meal periods, and are not entitled to overtime when his/her workload does not permit breaks or meal periods. Accordingly, the following applies only to non-exempt employees. 1. Non-exempt employees who work more than five (5) hours per day may take two 15 minute paid breaks per day, and one unpaid meal period of one (1) hour or one half hour (30 minutes) per day or as determined by management provided it does not result in overtime or additional cost to the District or otherwise violate this Agreement. 2. One rest break is permitted at the mid-point of the first half of the workday and the other rest break is permitted near the mid-point of the last half of the workday. 3. Rest breaks not taken may not be used to shorten the workday or be added to a meal period to extend its length. 4. Meal periods should occur near the mid-point of each scheduled workday and therefore are not permitted at the beginning or end of a workday. 5. Except as otherwise required by applicable federal or state law, failure to take rest breaks and/or meal period breaks as a result of work load shall not result in eligibility for overtime pay.
