Compensation for Working Out of Class. A. Regular Compensation for Working in a Higher Level Job class (1) When an employee is assigned the responsibilities of a higher-level position for a period of two weeks or more, the Employer shall pay the employee according to the pay range allocation of the higher level position. The employee must meet minimum qualifications of the higher level job classification to receive such compensation. The assignment detailing the higher-level responsibilities must be made in writing prior to the beginning of the assignment. (2) Step placement in the higher pay range shall not be less than a two step increase in the lower range. If the employee is at a step 13 of the lower range, the increase may not be less than the difference between step 12 and step 13 of the lower range. (3) An employee is not eligible for payment at the higher level job class rate of pay for hours on regular pay status but not worked (e.g., vacation or holidays); however, such hours shall not be deemed to have interrupted a continuous out-of-class assignment.

If a bargaining unit member is directed to perform the duties in a higher classification for a management position, and such work period exceeds five (5) working days in any fifteen (15) calendar day period, the unit member shall be paid an additional amount not to exceed fifteen percent (15%) of the current base pay rate of the unit member.

Human Resources will post the assignment internally. Normally assignments do not exceed 6 months duration. Assignments or extensions beyond six months must be requested in writing at the beginning of the 5th month and will be reviewed for approval by HR and CSEA. (Attachment P) i. For the period of January 1, 2020 to December 31, 2022, assignments shorter than six (6) months in duration to nor require approval by CSEA, but the District will notify CSEA of the assignment prior to the work commencing. This term will sunset on December 31, 2022 unless re- negotiated into the successor contract. d. If the employee is assigned to duties of a position not currently found on the salary schedule, an hourly salary adjustment shall be negotiated between the District and CSEA prior to the work being assigned. e. Employees in the unit may be assigned duties within an equal (i.e. same salary range) classification with no change in compensation. Compensation for Working Out of Class. When an employee is required by the District to work in a higher classification for four (4) or more consecutive hours, the employee shall receive the appropriate range and step for the classification worked or five percent (5%) above the employee's base pay, whichever is higher.

For purposes of calculating amounts payable by the Borrower to the Lenders under this Section 3.05, each Lender shall be deemed to have funded each Eurodollar Rate Loan made by it at the Eurodollar Rate for such Loan by a matching deposit or other borrowing in the London interbank eurodollar market for a comparable amount and for a comparable period, whether or not such Eurodollar Rate Loan was in fact so funded.

In addition, Executive shall not be entitled to any other benefits including, without limitation, such group medical, life and disability insurance and other benefits as may be provided to employees and/or executives of MediciNova.
