This obligation does not apply to a release of Regulated Substances, pollutants, contaminants, or petroleum products that existed on the Leased Premises prior to the execution of the agreement caused solely by the act or omission of the XXXX or a third party for whom the operator is not responsible (e.g. not a customer, invitee, employee, agent, or person having any contractual or business relationship with Xxxxxx).

Compliance Action. Within forty-five (45) days after submittal of the Airline’s Plan for Compliance, Airline shall commence and expeditiously proceed to complete, subject to XXXX’x review and approval not to be unreasonably withheld, the actions identified in the Airline’s Plan for Compliance.
(a) Notwithstanding the foregoing, if any local, state or federal agency with jurisdiction over the Airport establishes a remediation plan or schedule to address any confirmed Release of Regulated Substances by Airline at the Airport, such agency's plan or schedule shall control.
(b) If Airline does not complete the required remedial actions, as required by Applicable Environmental Laws and Airline’s Plan for Compliance in the time periods set forth in the remediation plan or Plan for Compliance approved by XXXX (or such additional time as may be reasonably approved by XXXX as a result of site conditions and/or force majeure events), XXXX shall have the right, but not the obligation, after providing Airline with a reasonable opportunity to cure, to implement a Plan for Compliance which it reasonably deems necessary to address such non-compliance. If XXXX implements any remediation action pursuant to this section of the Agreement, Airline shall reimburse XXXX promptly upon demand for its actual, reasonable costs, plus a ten percent (10%) administrative fee without limitation of other claims or damages that XXXX may have against Airline arising out of the terms of this Agreement or otherwise; provided, however, pursuant to Airline’s rights under Paragraph 6 of this Section, Airline may refer any disputed costs from XXXX’x implementation of a Plan for Compliance hereunder to mediation.
(c) Airline reserves all rights to seek contribution or other legal or equitable reimbursement of costs incurred by Airline in any clean- up, removal or remediation of Regulated Substances or correction of any violation of Applicable Environmental Laws required under this Agreement.

Remove the gas strut from the engine mount and secure the rod end using Loctite. Why is the compliance time presented in calendar time instead of hours time- in-service (TIS)? Although the failures of the fuel line, exhaust system, and piston rod of the gas strut occur during flight, the condition is not a direct result of sailplane operation. A calendar time for compliance will ensure that the unsafe conditions are addressed on all sailplanes in a reasonable time period. Sailplane operation varies among operators. For example, one operator may use the sailplane 50 hours TIS in 3 months while it may take another 12 months or more to accumulate 50 hours TIS. In order to ensure that preventive and corrective actions are done in a timely manner, the compliance time for installing an additional filter for the primer valve and inspecting and aligning the exhaust system is required within the next three calendar months after the effective date of this AD, unless already done. Because of the impact on safety, the compliance time for modifying the placement of the fuel lines and removing the gas strut from the engine mount and securing the rod end using Loctite is required within the next 30 days after the effective date of this AD, unless already done.

To identify the technological and operational shift necessary to achieve full compliance and alignment with HIPAA and Centers for Medicare & Medicaid Services (CMS) transactions and claim processing code sets, DDD contracted with BerryDunn to develop a long-term Information Technology (IT) Roadmap. Compliance Action. CNNIC hereby confirms: All Registrars authorized by ICANN must enter into a Registrar Accreditation Agreement (“RAA”) with ICANN.
