ELIGIBILITY FOR STATUTORY HOLIDAY PAY. (a) To be eligible to receive pay for a statutory holiday, an employee must work their last regularly scheduled shift immediately prior to the holiday and their first regularly scheduled shift following the holiday.
(b) The eligibility requirements in paragraph (a) above will be waived by the Employer when the employee's absence from an eligibility shift has been approved by the Employer, or when the employee fails to satisfy the eligibility requirements only because of a bona fide sickness or accident. The Employer is entitled to require a doctor's certificate as proof of such sickness or accident, and any abuse of this provision by an employee may be cause for discipline.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. (a) An employee shall establish eligibility for statutory holiday pay for any statutory holiday other than one which occurs during a period of his annual vacation, by
(i) working on the statutory holiday; or
(ii) working on both his last regularly scheduled shift immediately preceding the holiday and his first regularly scheduled shift immediately following the holiday; or
(iii) working on either his last regularly scheduled shift immediately preceding the holiday or his first regularly scheduled shift immediately following the holiday, and being on a leave of absence approved by the Employer on the other of such two days.
(b) In the case of an employee's absence from either his last regularly scheduled shift immediately preceding a statutory holiday or his first regularly scheduled shift immediately following such statutory holiday, because of sickness or accident, the Employer is entitled to require a doctor's certificate as proof of such sickness or accident, and any abuse of this provision by an employee may be cause for discipline.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. An employee will be eligible to receive Statutory Holiday pay after thirty (30) calendar days of employment.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. (a) To be eligible for statutory holiday pay an employee must have been employed by the Employer for at least thirty (30) days. An employee who is absent on his/her scheduled work day immediately prior to and/or following the statutory holiday shall not be eligible for statutory holiday pay.
(b) The eligibility requirements in paragraph (a) above will be waived by the Employer when the employee’s absence from an eligibility shift has been approved by the Employer, or when the employee fails to satisfy the eligibility requirements only because of a bona fide sickness or accident. The Employer is entitled to require a doctor’s certificate as proof of such sickness or accident, and any abuse of this provision by an employee may be cause for discipline.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. (a) To be eligible to receive pay for a statutory holiday, employees must have been employed for thirty (30) calendar days or more, and, an employee must work their last regularly scheduled shift immediately prior to the holiday and their first regularly scheduled shift following the holiday.
(b) The eligibility requirements in paragraph (a) above will be waived by the Employer when the employee's absence from an eligibility shift has been approved by the Employer, or when the employee fails to satisfy the eligibility requirements only because of a bona fide sickness or accident. The Employer is entitled to require a doctor's certificate as proof of such sickness or accident, and any abuse of this provision by an employee may be cause for discipline. The application of this clause shall not result in payment of the statutory holiday from more than one source.
(c) If an employee is eligible for statutory holiday pay in accordance with (a) and (b) above, then the amount paid shall be in accordance with the formula contained in Article 13.03 (b).
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. To be eligible to receive pay for a statutory holiday, an employee must work their last regularly scheduled shift immediately prior to the holiday and their first regularly scheduled shift following the holiday.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY a. To be eligible to receive pay for a Statutory Holiday, an Employee must work their last regularly scheduled shift immediately prior to the holiday and their first regularly scheduled shift following the holiday.
b. The eligibility requirements in (a) above will be waived when the Employee’s absence from an eligible shift has been because of: • a Company approved leave of absence that is not longer than one (1) week, or • when an Employee fails to meet the eligibility requirements because of a bona fide sickness or accident that is not covered under a Workers Compensation or Disability Insurance Program.
c. If an Employee is laid off within fourteen (14) days of a statutory holiday, the statutory holiday will be paid provided the Employee worked their last regularly scheduled shift prior to the statutory holiday. An Employee who is on a Workers Compensation or Disability Insurance Program will have their Statutory Holiday pay covered by these agencies.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. (a) To be eligible to receive pay for a statutory holiday, an employee must work their last regularly scheduled shift immediately prior to the holiday and their first regularly scheduled shift following the holiday.
(b) The eligibility requirements in paragraph (a) above will be waived by the Employer when the employee’s absence from the eligibility shifts or shift due to a bona fide sickness or injury or an authorized leave of absence, provided that the absence of the employee commences no earlier than in the week prior to the week in which the holiday occurred.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. (a) To qualify for compensation under Article 16.1 the employee, prior to the actual statutory holiday, must:
(1) have worked the last scheduled shift before and the first scheduled shift following the holiday, unless the absence is excused by Citizens Bank of Canada; or,
(2) have worked at least fifteen (15) of the preceding thirty (30) scheduled shifts.
(b) Employees do not qualify when they:
(1) have agreed to work on the holiday and without satisfactory cause failed to report to work and perform the work; or
(2) are on leave of absence, disability leave or on layoff the day on which the holiday is observed.
ELIGIBILITY FOR STATUTORY HOLIDAY PAY. Employees who have accumulated a minimum of 90 calendar days of service with the Company will be eligible to receive unworked holiday pay providing:
(a) They have not been absent without permission on their last workday preceding or their first workday following the holiday, and
(b) They have not been absent on official leave of absence on the holiday (sick leave shall not be considered as official leave of absence, see Section 805), and
(c) They have worked in the thirty calendar days preceding the holiday.
