Health & Welfare Funds. (1) The EMPLOYER agrees to be bound by all provisions set forth in the Agreement and Declaration of Trust, and all amendments thereto, governing establishment and operation of the I.U.P.A.T. District Council No. 21 Welfare Fund. The Trust Agreement provides, inter alia, for the receipt of contributions by the Welfare Fund for the purpose of providing group health, medical surgical disability and other related welfare benefits to eligible workers and their families, in such form and amounts as the Trustees of the Welfare Fund may determine in conformity with the discretion vested in them under provisions set forth in the Trust Agreement. The EMPLOYER agrees to contribute for each EMPLOYEE covered by this Agreement to the Welfare Fund in the manner provided herein, in the then current amounts and for the periods as set forth in Article 5.

Health & Welfare Funds. 16.01 The Employer will pay the amount as set out in Schedule A for all scheduled hours worked for each Employee or DSP towards the Union’s Health and Welfare Fund. No amount of these payments will be deducted from an employee’s or DSP’s wages. The total amount will be remitted to the Union thirty (30) days following the end of each month together with an itemized list of the employees or DSPs for whom the remittances are made and the amount remitted for each. 16.02 It is the responsibility of each employee or DSP to be familiar with the specific details of coverage and eligibility requirements of all benefit plans and neither the Union nor the Employer have any responsibility for ensuring that all requirements for eligibility or conditions of coverage or entitlement of benefits are met by the employee or DSP, beyond the obligations specifically stipulated in this Agreement. 16.03 Penalties for delinquent payment of health and welfare contributions and/or deductions: a) The Union will notify the Employer in writing within 48 hours of any delinquency. Refer to MOA dated March 8, 2017 for further clarification.

For the period July 1, 2021 through June 30, 2022, the Employer shall contribute the amount of $923.87 (nine hundred twenty-three dollars and eighty-seven cents) each month on behalf of each employee on its active payroll to the SEIU Local 1 & Participating Employers Health Trust; provided, however, that the Employers’ contributions shall be prorated for those months in which employees begin working, cease their employment and/or remain on medical or personal leaves of absence for periods in excess of those specified in Article XVII, Sections 1 and 2 and Section 5 of this Article, respectively. If, as of July 1, 2022, the Trustees of the SEIU Local 1 & Participating Employers Health Trust, after reviewing all other options, determine that benefit changes may be necessary, the parties agree to meet and confer to discuss alternative funding options. Section 2. For the period July 1, 2022 through June 30, 2023, the Employer shall contribute the amount of $923.87 (nine hundred twenty-three dollars and eighty-seven cents) each month on behalf of each employee on its active payroll to the SEIU Local 1 & Participating Employers Health Trust; provided, however, that the Employers’ contributions shall be prorated for those months in which employees begin working, cease their employment and/or remain on medical or personal leaves of absence for periods in excess of those specified in Article XVII, Sections 1 and 2 and Section 5 of this Article, respectively. The Trust Agreement provides, inter alia, for the receipt of contributions by the Welfare Fund for the purpose of providing group health, medical surgical disability and other related welfare benefits to eligible workers and their families, in such form and amounts as the Trustees of the Welfare Fund may determine in conformity with the discretion vested in them under provisions set forth in the Trust Agreement. The EMPLOYER agrees tocontribute for each EMPLOYEE covered by this Agreement to the Welfare Fund in the manner provided herein, in the then current amounts and for the periods as set forth in Schedule A.

  • HEALTH & WELFARE 16:1 The parties signatory hereto shall enter into a Health and Welfare Plan for which there is a Trust Agreement, known as the Line Construction Benefit Fund, for the purpose of providing insurance benefits for eligible employees and/or their dependents. Effective the first of the month following the signature date of this Agreement, the Employer shall pay to the Line Construction Benefit Fund the sum of $6.50 for each hour worked. Hours worked shall be deemed to include straight-time hours worked, overtime hours worked, and report time not worked. Remittance shall be forwarded to the place designated by the parties hereto on or before the fifteenth (15th) day of each month for each hour worked in weekly payroll periods ending during the preceding month, together with a monthly payroll report on a form to be furnished to the Employer. It is understood and intended by the parties to this Agreement that the purpose of this clause is to establish an Employer financed Health and Welfare Trust and that contributions thereto shall not be deemed to be wages to which any employee shall have any right other than the right to have such contributions paid over to the Trust fund in accordance herewith. Failure of an individual Employer to make all payments provided for, including liquidated damages for late payments, within the time specified, shall be a breach of this Agreement and will further require action by the Trustees as set forth in the Trust Agreement. Any increase in the required contributions set forth above will be paid equally (50% by the Employer and 50% by the Employee). The amount paid by the Employee will come from their NEAP contribution. 16:2 HRA: Effective the first of the month following the signature date of this Agreement, the Employer also agrees to pay into the Line Construction Benefit Fund $1.00 per hour through the term of this Agreement. HRA is calculated on all hours worked for all working classifications covered by this Agreement. These contributions shall be used to provide Health Reimbursements Accounts(s) under the Line Construction Benefit Fund Plan of Benefits.
