Jury Duty and Court Appearance Leave. Leave of absence shall be authorized for jury duty and under subpoena as a disinterested witness in court. The employee’s salary while absent will be subject to deduction of the amount he/she receives for jury service or witness fee as certified by a responsible court officer.
Jury Duty and Court Appearance Leave. 9.9.1 An Employee shall, upon written application to the Xxxx or equivalent, and upon prior written acknowledgement, be granted leave of absence with full pay for all absences resulting from or associated with being summoned to serve on a jury or being subpoenaed as a witness in court proceedings. If required by the Xxxx, the Employee shall produce a summons or subpoena or submit such other evidence as will show the necessity of attendance at court.
9.9.2 In cases where an Employee’s private affairs have occasioned a court appearance, such leave to attend court shall be without pay.
9.9.3 An Employee in receipt of their regular earnings while serving at court, shall remit to the Employer all monies paid to them by the court, except travelling and meal allowances not reimbursed by the Employer.

8.9.1 Leave of absence without loss of pay and benefits will be provided to a faculty member summoned to serve on a jury; or when subpoenaed or summoned as a witness in a criminal or civil proceeding not occasioned by the faculty member’s private affairs; or when the faculty member accompanies a dependent child when the child is subpoenaed or summoned to appear as a witness in a criminal or civil proceeding; or when appearing as a defendant in a criminal or traffic case if acquitted therefrom.
8.9.2 To qualify for permission from the appropriate Xxxx or Director to be absent with pay and benefits, the faculty member shall produce the summons or subpoena or submit such other evidence showing the necessity for the court appearance.
8.9.3 A faculty member in receipt of pay or benefits under this Article has the responsibility to reimburse the employer all monies paid to them by the Court, except travelling and meal allowances not reimbursed by the College.

When an employee has been subpoenaed for non-school business, the leave will be without pay, unless the employee uses personal leave. As soon as is practical after an employee has been notified that he/she is to appear for jury duty or has received a subpoena, he/she will inform the building principal of the date and hour he/she is to appear.

If required by the supervisor, the employee shall produce a summons or subpoena or submit other evidence as will show the necessity of attendance at court. In all cases of absence, the employee will assign any fees received to the employer.

The District will provide employees paid leave at their regular rate of pay if they are required by law to serve on a jury and provide the District reasonable notice that they are required to serve. (Labor Code § 230). Employees must report to work on whatever days they are not required to serve. Employees shall remit to the District any compensation they receive for jury service, exclusive of expenses for meals, mileage and/or parking. Employees will be granted leave to appear in court as required by law. (Labor Code § 230.) If the District is not a party to the action, the District will deduct the cost of a substitute from the employee’s regular rate of pay for every day they are absent. If the District is a party to the action and requests the employee to appear in court, employees will suffer no loss of compensation for any days they are absent.

9.9.2 Any remuneration received for jury duty shall be forfeited to the Institute.
Jury Duty and Court Appearance Leave a. All school employees who are called to jury duty shall notify the Superintendent of Schools as soon as notice is received. Employees shall request the court to defer jury duty whenever possible to the summer months when children are not regularly enrolled; the Superintendent or their designee will confirm and support such requests, when necessary.
b. Employees who cannot obtain a deferment or whose employment extends through the summer months shall be released for jury duty. Such employees shall receive the difference between their regular daily salary and pay received for jury duty.
c. A required court and/or administrative agency (hereinafter called Tribunal) appearance is defined as serving as a witness in any case arising out of or during the course of employment with the Board. The Board agrees to pay the teacher their regular contractual salary rate for these required Tribunal appearances and the teacher, in turn, agrees to forward to the Board any fees received for serving as a Tribunal witness. Should the teacher not forward to the Board (Personnel Office) such fees for serving as a witness, then a like amount will be withheld from their annual contract.
d. A required Tribunal appearance in a case not arising out of or during the course of employment with the Board where the teacher has a vested interest will be without pay, or personal days may be used provided the teacher has personal days. Vested interest shall be defined as any litigation which has been initiated by the teacher, their agent, or members of their family or any litigation which has been initiated against the teacher, their agent, or members of their family, stand to gain or lose money, property or standing.
e. A required Tribunal appearance in a case where the teacher is a subpoenaed witness to a criminal act shall be considered as a case wherein the teacher has no vested interest.

a) For jury duty or any summons related thereto; and,
b) To answer a subpoena or summons to attend as a witness in any proceeding authorized by law to compel the attendance of witnesses, provided that the teacher remits to the School Division any witness fee or jury stipend (excluding allowances and / or expenses) set by the court or other body. In a court case between the Association and the School Division where the court subpoenas a teacher to testify against the School Division, the Association will reimburse the School Division for the teacher's salary.

b. If necessary, employees may request the court to defer jury duty to a more appropriate time. The Superintendent of Schools will confirm and support such requests when necessary.
c. If an employee is paid by the courts for jury duty, the employee shall remit that payment to the District and receive their regular pay.
