Jury Duty & Court Witness. The Executive Superintendent of Human Resource Services or designate will grant a leave to an Employee who is summoned to serve as a juror or is required by Writ or Subpoena to appear in court as a witness (not on the Employee’s behalf) and will be paid the Employee’s regular pay for the day required to be in court, provided the Employee presents to the Employer the process which required the Employee’s presence in court and pays over to the Employer the amount received as such juror or witness (less travel and living expense).

Where a regular unit member is subpoenaed to a court of law on school related legal business, i.e. witness to a crime, student assault or child abuse, involving persons other than the unit member (and exclusive of disputes with the Board of Education), the unit member shall be granted the necessary time off with full pay less any witness fee paid by the court upon presenting a copy of the official subpoena to the Executive of Human Resources or designee.

The employee is responsible for reporting the impending absence to the Bucks IU online attendance reporting system as far in advance as possible to allow for the engagement of an appropriate substitute and/or notification to the appropriate school personnel. Section 3. An employee serving as a juror or court witness shall be paid the difference between any fees paid for such appearance, excluding travel expenses, and his/her regular salary, except where the employee or the Association is the adverse party to the employer in the litigation giving rise to the court appearance. Evidence of service including a certification from the Clerk of Court may be required by the Executive Director. This Article is inapplicable to any situation where the employee is a party plaintiff or defendant, or who otherwise has a direct or indirect interest in the outcome of the lawsuit. Section 4. The employee is expected to report to his/her regular duty when his/her attendance at court is not required.

Jury Duty & Court Witness. 26.1.1 Leave with pay shall be granted to an academic staff member who has been summoned for jury duty or who has been issued a summons to appear as a witness. 26.1.2 In instances where an academic staff member appears in court either as a plaintiff or defendant, leave shall either be without pay or chargeable against accumulated vacation credits. 26.1.3 Any payment made to the academic staff member with respect to his or her appearance in court either as a witness or juror, less any incurred direct costs, shall be turned over to the University.
Jury Duty & Court Witness. (a) When a Regular Employee is absent from work to perform jury service or to testify as a crown subpoenaed witness, or in their capacity as a Division Employee, the Division will pay their regular rate of pay for each hour they would have worked had they not been on jury duty, provided however, any jury fees, or as a witness, any witness fees received by them for performing such service or giving such evidence is submitted to the Employer. The Employee shall immediately notify the Division upon becoming aware of their requirement to attend at court.
