Land Use Plan. SUBLESSEE shall prepare and submit a Land Use Plan for the leased premises, in accordance with Section 253.034, Florida Statutes. The Land Use Plan shall be submitted to SUBLESSOR for approval through the Division of State Lands, State of Florida Department of Environmental Protection. The leased premises shall not be developed or physically altered in any way other than what is necessary for security and maintenance of the leased premises without the prior written approval of SUBLESSOR until the Land Use Plan is approved. SUBLESSEE shall provide SUBLESSOR with an opportunity to participate in all phases of preparing and developing the Land Use Plan for the leased premises. The Land Use Plan shall be submitted to SUBLESSOR in draft form for review and comments within ten months of the effective date of this lease. SUBLESSEE shall give SUBLESSOR reasonable notice of the application for and receipt of any state, federal or local permits as well as any public hearings or meetings relating to the development or use of the leased premises. SUBLESSEE shall not proceed with development of said leased premises including, but not limited to, funding, permit application, design or building contracts, until the Land Use Plan required herein has been submitted and approved. Any financial commitments made by SUBLESSEE which are not in compliance with the terms of this lease shall be done at SUBLESSEE’S own risk. The Land Use Plan shall emphasize the original management concept as approved by SUBLESSOR on the effective date of this lease which established the primary public purpose for which the leased premises are to be managed. The approved Land Use Plan shall provide the basic guidance for all management activities and shall be reviewed jointly by SUBLESSEE and SUBLESSOR. SUBLESSEE shall not use or alter the leased premises except as provided for in the approved Land Use Plan without the prior written approval of SUBLESSOR. The Land Use Plan prepared under this lease shall identify management strategies for exotic species, if present. The introduction of exotic species is prohibited, except when specifically authorized by the approved Land Use Plan. In accordance with Section 253.034, Florida Statutes, the SUBLESSEE shall submit a Land Use Plan update at the end of the fifth year from the execution date of this lease to establish all short-term goals developed under the Land Use Plan have been met in accordance with Section 253.034 (5) (i), Florida Statutes. Land Use Plan. Consistent with the existing general land uses that exist within the City, it is the intent of Owner to design a large lot residential subdivision whereby the actual location and design of its roadway system will comprise local streets only.

The Land Use Plan is intended to be the general blueprint which details key aspects of the future physical development of the Property. The Land Use Plan shall also serve as a necessary guide for future permit applications and permitting necessary to complete the construction of the Project. Developer shall have the obligation to further submit and obtain the City’s approval of a final site plan and final engineering plans and aesthetic review (“Final Engineering Plans”) consistent with the Land Use Plan in all material respects and in compliance with the City Code. Developer acknowledges and agrees that the Land Use Plan was not created with specific surveyed dimensions and that during the Final Engineering Plan process such dimensions shall be surveyed, duly engineered, and provided to the City for consideration under applicable City Codes. The Land Use Plan shall be subject to reasonable adjustments at the Final Engineering Plan phase in order to bring the Project into full compliance with the City Code, and as a result, the exact location, layout and dimensions of the building, landscaping, entrances, utilities, parking and other site improvements may vary slightly between Land Use Plan approval and approval of the Final Engineering Plans. These changes shall be allowed as long as the changes are consistent with the development standards noted in this Agreement and preserve the general character of the development shown on the Land Use Plan.

A. Lot Summarization. As of the date hereof, it is anticipated that the Property will contain a Church Facility with lot(s) to be allocated to the various operations of that facility: Church 1 lot 10 Acres
Land Use Plan. The Insight Land Use Plan provides a general depiction and approximate configuration for the Insight Parcels. Any boundary lines shown on the Insight Land Use Plan are approximate only, and may be adjusted without triggering an amendment to this Agreement or the Master Development Plan.
Land Use Plan. Led by PlaceWorks, our team will prepare a land use plan defining categories of place typologies comprising the Beach Boulevard Specific Plan area, differentiated by use, development scale and character. For each, we will describe intentions for urban form and design; general categories of uses; development capacities to be permitted; and opportunity areas for reuse, infill and/or intensification. The land use plan map and land use designations will be correlated with the regulating hybrid form-based code outlined in Task 4.3 below. Land use development scenarios for several key opportunity areas will be prepared, as needed, to engage the CAC and public in a dialogue about development feasibility and trade-offs. Mobility Plan. Led by Xxxx & Peers, the mobility plan will be drafted concurrently with the land use plan. One of the biggest challenges faced by this area is accommodating all users of the street while maintaining an adequate level of service for the approximately 66,000 vehicles that use this segment of Beach Boulevard on a daily basis. This plan will provide connectivity opportunities for all modes of travel (pedestrian, bicycle, transit, and vehicle). As experts in complete streets Xxxx & Peers will utilize their Mixed-Use Trip Generation Method tool to accurately evaluate the trip making characteristics for mixed-use and transit oriented development. The mobility plan will include new street sections that incorporate a landscape palette of native drought tolerant plants, trees, and shrubs. The new street sections will be used in public meetings to generate support for change and to show how new development can interact with the streets.
Land Use Plan. The Land Use Plan (Figure 2) summarizes the distribution of land uses for Xxxxxxx Hills. As illustrated in the Land Use Plan, the proposed Xxxxxxx Hills project is conceived as a master planned community which includes a wide variety of residential, commercial, office, recreational, open space, natural preserve, public and educational uses. The project will consist of estate, low and high density residential homes that gradually transition from the rural edge along the project’s eastern foothills to the proposed regional retail centers along the existing Grant Line Road and potential future Capital Southeast Connector Road. The project may also include a variety of regional and community retail centers, office uses, research facilities and a vast network of trails and public uses. The project also designates a unique 223-acre site as a university campus. The key features of the Land Use Plan include: PLNP2008-GPB-SDP-ZOB-AHP-00142 A maximum residential yield of 8,000 dwelling units, ranging from large lot homes to high density residential units proposed at up to 40 units per acre. A maximum allowable square footage of approximately 1.35+ million square feet of Commercial/Office use. The FRO or Flex Residential Overlay, would permit (but not require) retail and work centers, live work dwellings, children and senior day care centers in specified residential designations. The 205.7+ acre Town Center. The 223+ acre University/College Campus Center. The 200+ acre University Village adjacent to the University/College Center. The remaining Villages of Ridgeline, East Valley, Creekside and the Estates are primarily residential Villages in the eastern and northern portions of Xxxxxxx Hills, covering approximately 1,240+ acres, excluding agriculture and open space. Public uses including schools, and civic facilities, of approximately 106 acres. An open space and trail system, integrated community wide with creek avoidance and wetland habitat areas. Avoidance (Preserve) Areas, agricultural and open space (R2) informal recreation containing approximately 838+ acres, not including active parks. The total active park acreage for all Villages is approximately 99+ acres with an additional 7 acres of active park in the R2 areas, consistent with the Draft SPA and Development Agreement. Land Use Plan. The existing Land Use Plans will be updated to depict existing and recommended uses of all land within the ultimate airport property line (on-airport) and within the vicinity of SWO (off-airport). This will include area surrounding the Airport that, at a minimum, falls within the DNL 65 noise contour. Uses will be depicted by general land use categories, including such categories as agriculture, residential, industrial, commercial, parks and open space, aviation-related, public, floodplains, DOT Section 4(f) resources, among others as appropriate, but including special note of noise sensitive uses. Places of public assembly will be denoted, including churches, schools and parks. The Land Use Plan will be illustrated on the same sheet size as the Airport Layout Drawing and as described within the body of the Master Plan document. In accordance with FA SOP 3.00, Standard Operating Procedure for FAA Review of Exhibit “A” Airport Property Inventory Maps, the Exhibit ‘A’ Airport Property Inventory Map will be updated using the existing Airport Property Map, as well as any existing or supplemental property and/or easement information supplied by the Sponsor. This scope of services does include title or parcel information readily available from public records. It does not include land research or title commitment work and no land surveying will be performed. For appropriate property boundary description information (i.e. metes and bounds, township/range/section, lot and block, plat or other appropriate property description), this information will be provided to the Consultant by the Airport or City staff or that which is readily available from public records.
