Loss of Seniority/Termination. The seniority of an employee will be considered broken, all rights forfeited and the employee will be terminated when he/she:
a) Voluntarily leaves the service of the Company or is discharged for just cause.
b) Fails to return to work within three days when recalled from layoff without a reasonable excuse.
c) Has completed the probationary period but has less than fifteen (15) months seniority and has been laid off by the Company for twelve (12) months.
d) Has fifteen (15) months seniority or more and has been laid off by the Company for twenty-four (24) months.
e) Is absent for three consecutive workdays and fails during that time to notify the Company with a reason for the absence.
f) Use Leave of Absence for any purpose other than for the reason granted.
g) Has been absent from work due to illness or injury for thirty (30) months and there is no medical evidence of their ability to return to the workplace. This is applicable to employees hired June 1, 1999 or later.
h) In the case of probationary employees when recall rights which are equivalent to their number of full weeks of employment at the time of layoff, expire.
Loss of Seniority/Termination. Section A. An employee shall lose his/her seniority for the following reasons only:
1. He/she retires.
2. He/she quits.
3. He/she voluntarily moves to substitute employee status.
4. He/she is discharged and the discharge is not reversed through the procedure set forth in this Agreement.
5. He/she is absent for three (3) consecutive working days without notifying the district. A notice which is acceptable will be leaves of absence, sick leaves, jury duty, personal business days, funeral leave and maternity leave taken according to the terms of this Agreement.
6. If he/she does not return to work when recalled from layoff as set forth in the Recall Procedure. In proper cases, exceptions may be made.
7. If an employee gives a false reason for a leave of absence or engages in other employment during such leave, except as authorized by the District.
8. A Division II employee does not notify the transportation supervisor, in writing by request by the District, no later than June 30th. of each school year, of his/her intent to return to work for the following school year.
9. Return from sick leave and leaves of absence will be treated as five (5) above.
Loss of Seniority/Termination. An employee shall be discharged, and his/her name shall be removed from all seniority lists for just and reasonable cause. Cause to include, but not limited to:
a) if the employee resigns, in writing, and does not rescind the resignation within one (1) working day;
b) if the employee is laid off and fails to return to work within ten (10) days after he/she has been notified so to do by the Employer by Priority Post, requiring the signature of the addressee, to his/her last known address (a copy of which notice shall be sent to the Union). However, should the letter not be delivered by Priority Post through no fault of the employee, the ten (10) day period will commence only after the employee has become aware of his/her recall;
c) if the employee has been on layoff for lack of work or on long term disability for a period of more than thirty-six (36) consecutive months;
d) if the employee is absent without leave or justifiable reason for a period of five (5) consecutive working days.

Loss of Seniority/Termination. An employee shall lose all seniority rights up to and including termination for any of the following reasons:
Loss of Seniority/Termination. 13.01 An employee shall lose her seniority standing (subject to complaint or grievance procedure) and her name shall be removed from the seniority list and her employment shall be terminated if:
a) the employee voluntarily leaves the employ of the University, retires, or is retired under the terms of the University Pension Plan;
b) the employee is discharged and not reinstated;
c) the employee has been laid off for a continuous period of twelve (12) months;
d) the employee is absent from work without leave for more than two (2) consecutive days without providing a reason satisfactory to the University;
e) the employee fails to report to work at the termination of a leave of absence without providing a reason satisfactory to the University.
13.02 The inability of an employee to work by reason of illness or accidental injury shall not result in loss of seniority rights and termination of employment during a period of two (2) years and such period, after a review, may be extended by mutual consent of the University and the Union. The parties agree to that this clause will be interpreted in accordance with the Ontario Human Rights Code.
