Lunch Periods and Breaks. A. Employees who work in excess of five clock hours per day shall be entitled to a thirty minute duty free unpaid lunch period, scheduled by his/her supervisor, all as added to the normal work day, except as may be the practice at the time of the effective date of this agreement.
B. Each employee shall be entitled to a paid fifteen minute break for every four (4)

2. When Agency mission requirements do not allow an employee a full thirty (30) minute consecutive and uninterrupted lunch period, the employee will be compensated for his/her missed lunch period with thirty (30) minutes of Compensatory Time.

All bargaining unit members, except for bus drivers and bus assistants, shall receive unpaid lunch periods and paid breaks as follows: Teacher Assistants and Assistant Xxxx- Full day teacher assistants and Assistant Xxxx shall receive 1/2 hour uninterrupted duty-free unpaid lunch period which shall be scheduled approximately mid-shift in addition to paid ten minute breaks for each three hours worked. Part- time teacher assistants shall receive one paid ten minute break for each three and one-half (3 1/2) hours worked. Custodians - Eight hour custodians shall receive either an hour or a half-hour duty-free unpaid lunch which shall be scheduled approximately mid-shift in addition to two paid fifteen minute breaks each day. Part-time custodians shall receive one paid fifteen minute break for each three and one-half hours worked.

Lunch will be scheduled not earlier than four (4) hours, but not later than six (6) hours, after the start of the shift.
2. When mission requirements prevent an uninterrupted lunch IAW Paragraph 1, an on-the-job lunch of twenty (20) minutes or less may be counted as work time. On-the-job lunch periods are not considered off duty. Employees will be compensated for missed lunch periods with an amount of Compensatory Time, or Overtime (if Title 5), equal to the missed lunch period. Where such on-the-job lunch period is in effect, employees must remain at the worksite and be available for work.

In lieu of receiving Compensatory Time, and when mission requirements allow, an employee may opt to shorten his/her duty day by thirty (30) minutes on the same day during which they were not able to enjoy a full thirty (30) minute consecutive and uninterrupted lunch period. The choice as to whether receive Compensatory Time or to shorten the duty day is for the employee to make, and is only available on the same day on which the employee’s lunch is interrupted. Employees may not accumulate or carry over missed lunch periods to another duty day. Supervisors may not force an employee to choose one option over the other.
4. Fifteen (15) minute rest periods or breaks, during the first half and the second half (i.e., before and after lunch) of an employee’s shift, will be granted. Rest breaks will not be taken in conjunction with the lunch period, or at the beginning or end of the work day.
Lunch Periods and Breaks. A. Each teacher will be permitted an unencumbered lunch period of not less than thirty (30) minutes free from supervisory duties with students.
B. Elementary classroom teachers and other elementary teachers on full-day schedules who do not have periods of time free from direct student contact will be provided a fifteen-minute release period within the student day. The building principal will be responsible for establishing an appropriate schedule.

A. Food service personnel shall be entitled to a District-provided lunch in lieu of a duty-free lunch period regardless of the number of hours they work.
B. Lunch periods (30 minutes) and two breaks (15 minutes each) may be combined if the employee so chooses, to utilize a one hour time period with the approval of the immediate supervisor. Employees may also chose to separate their lunch and break times.
