MANAGEMENT GRIEVANCES UNION GRIEVANCES. 7.1 It is understood that the Association, on its own behalf and on behalf of any of its member Companies, may file a grievance with the Union and that if such complaint is not settled to the satisfaction of the parties concerned, it may be treated as a grievance and referred to Arbitration in the same way as a grievance of an employee. Such grievance shall be processed at Step No. 2 of the Grievance Procedure set out in Article 5 hereof.

MANAGEMENT GRIEVANCES UNION GRIEVANCES. It is understood that the Association, on its own behalf and on behalf of any of its member Companies, may file a grievance with the Union and that if such complaint is not settled to the satisfaction of the parties concerned, it may be treated as a grievance and referred to Arbitration in the same way as a grievance of an employee. A policy grievance which is defined as an alleged violation of this Agreement involving all or a number of employees in the bargaining unit, in regard to which a number of employees have signified an intention to grieve, or a grievance involving the Union itself, including the application or interpretation of this Agreement, may be brought forward in writing at Step No. 2 of the Grievance Procedure at any time within five full working days after the circumstances giving rise to such policy grievance occurred, and if it is not settled at this stage, it may go to a Board of Arbitration in the same manner as a grievance of an employee. ARTICLE IIVIACATION PAY AND STATUTORY HOLIDAY Vacation and Statutory Holiday Pay shall be credited weekly to each employee covered by this Collective Agreement, at the rate of ten percent of the gross wages earned, and income tax will be deducted weekly. It is understood and agreed that four percent of the gross wages is to be considered Vacation Pay and six percent of the gross wages is to be in lieu of Statutory Holiday Pay. It is further understood that Vacation Pay and Statutory Holiday pay credits will be paid to employees on termination and on the first pay day of July and November in each year. Local ARTICLE WELFARE PENSION PLANS The parties hereto agree that the Welfare Benefit Plan presently in existence shall continue. The amount of monies to be paid into the Welfare Plan by each Employer shall be eighty cents per hour for each hour earned by each Operating Engineer in his employ. Effective May the Employer contribution shall be increased to eighty-five cents per hour for each hour earned by each Operating Engineer in his employ. The parties hereto agree that the Pension presently in existence shall continue. The amount monies to be paid into the Pension Plan by each Employer shall be one dollar and twenty five cents per hour for each hour earned by each Operating Engineer in his employ. MANAGEMENT GRIEVANCES UNION GRIEVANCES. It is understood that the Employers, or any one of them through the Bureau, may file a Grievance with the Union and that if such complaint is not settled to the satisfaction of the parties concerned, it may be treated as a Grievance and referred to Arbitration in the same way as a Grievance of an employee. Such Grievances shall be processed as set out in Article hereof. A Union Policy Grievance which is defined as an alleged violation of this Agreement concerningall or a number of the employees inthe Bargaining Unit, in regard to which an individual employee not grieve, or in regardto which a number of employees have signified an intention to grieve, may be brought forward, in writing, in accordance with Article of the Grievance Procedure, and if it is not settled at this stage, it may ultimately go to a Board of Arbitration in the same manner as a Grievance of an employee.

  • MANAGEMENT GRIEVANCES 8.01 It is understood that the Management may at any time file a grievance with the staff representative of the Union and request a meeting with him to discuss any complaint with respect to the conduct of the Union, its officers or committee member, in its relationships with the Company or other employees or with respect to any complaint that there has been a violation of any contractual obligation undertaken by the Union, and that if such grievance by the Management is not settled to the mutual satisfaction of the conferring parties it may be referred to arbitration as set forth in Article VII above.

This section shall not apply to disciplinary grievances or application of competitive clauses under this Agreement.

  • Management Grievance The Employer may initiate a grievance at Step 3 of the grievance procedure by the Employer or designate presenting the grievance to the President of the Union or designate. Time limits and process are identical to a union grievance.

  • Policy Grievances ‌ Where either party to this agreement disputes the general application, interpretation or alleged violation of an article of this agreement, the dispute shall be discussed initially with the Board of Directors Human Resources Representative (or designate) or the Union within 30 calendar days of the occurrence. Where no satisfactory agreement is reached, either party, within a further 14 calendar days, may submit the dispute to arbitration, as set out in Article 9 of this agreement.

  • Individual Grievances Subject to and as provided in section 208 of the Federal Public Sector Labour Relations Act, an employee who feels that he or she has been treated unjustly or considers himself, herself aggrieved by any action or lack of action by the Employer in matters other than those arising from the classification process, is entitled to present a grievance, as in paragraph (b).

  • Association Grievances If a grievance affects a group of employees or the Association, the Association may initiate and submit such grievance to the Superintendent directly, and the processing of such grievance shall commence at Step 2. Grievances involving more than one supervisor and grievances involving the administrator above the building level may be filed by the Association at Step 2.

  • General Grievances Controversies may arise of a nature so general as to directly affect the majority of employees in a classification or department, or the majority of all employees. It is agreed that issues of this nature need not be subjected to the entire grievance procedure but may be initiated at Step 2. Attendance at Grievance Hearings initiated at Step 2 may include members of both negotiating committees.

  • Group Grievance Where a number of employees have identical grievances and each employee would be entitled to grieve separately they may present a group grievance in writing signed by each employee who is grieving to the Administrator or her designate within ten (10) days after the circumstances giving rise to the grievance have occurred or ought reasonably to have come to the attention of the employee(s). The grievance shall then be treated as being initiated at Step No. 1 and the applicable provisions of this Article shall then apply with respect to the processing of such grievance.
