MARKET RECOVERY. Section 1. The wage rates to be paid to Employees for bargaining unit work performed on projects subject to this Article XII will be 85% of the wage rates, and 100% of fringe benefits, provided in Article 8 above.
MARKET RECOVERY. Section 1. Notwithstanding any other provisions of this Agreement, the following terms shall automatically apply to any prevailing wage job where the Contractor is bidding against non-signatory or bona fide non-union contractors.
(A) All wages and fringe benefits shall be paid as set forth in the bid prevailing wage document for the duration of the job.
(B) All overtime shall be paid in accordance with applicable state and federal law.
(C) Show-up pay shall be one (1) hour.
(D) All other terms and conditions of employment shall be as mutually agreed to between the Employer and the Union.
MARKET RECOVERY. The Employer agrees to contribute one dollar ($1.00) per hour on all classifications of workers covered by this agreement to the Local Union’s Market Recovery Fund.
MARKET RECOVERY. The program will provide that when a signatory contrac- tor finds non-union competition bidding on a project he/ she is interested in, the signatory Contractors can submit a request to the Wisconsin Laborers’ Defense Fund Committee and/ or the Milwaukee Laborers’ Local No. 113’s Defense Fund Committee requesting a target rate. The Committee (s) will evaluate the request and deter- mine whether or not to provide a Targeting Grant on the Project and the amount of the Grant. It will be the re- sponsibility of each Contractor to contact the Wisconsin Laborers’ District Council at (000) 000-0000 and/ or the Milwaukee Laborers’ Local No. 113 at (000) 000-0000 to determine whether a particular job has been targeted.

Section 7.1 The Program will provide that when a signatory contractor finds non-union competition bidding on a project in which he/she is interested, the signatory contractor may submit a request form to the Wisconsin Laborers’ Defense Fund Committee requesting a target rate. The Committee will evaluate the request and determine whether or not to provide a targeting grant on the project and the amount of the grant. It will be the responsibility of each contractor to contact the Wisconsin Laborers’ District Council to determine whether a particular job has been targeted.
MARKET RECOVERY. The Employer agrees to contribute seventy-five cents ($.75) per hour on all classifications of workers covered by this agreement to the Local Union’s Market Recovery Fund.
MARKET RECOVERY. The purpose of this Article is to make the contractors signatory to this Agreement more competitive in a market that is now beyond the realm of possibility and to create added jobs for the unemployed members of International Union of Operating Engineers Local #841. When bona fide non-union and/or non-signatory competition is bidding against the Employer, the Employer agrees to employ bargaining unit employees, and the following shall supersede the contrary provisions in the Agreement.
1.) The Employer shall use the referral procedure as set forth in Article 39 of the Agreement.
2.) There shall be no xxxxxxx requirements on such projects, except that Operating Engineers shall do all work within their jurisdiction.
3.) The wages for work shall be as set forth in the project contract document for the duration of the project, except that fringe benefit contributions shall be as specified in the Agreement.
4.) All overtime shall be paid in accordance with all applicable state and federal laws in all cases except, on federal Xxxxx-Xxxxx jobs, the appropriate overtime rate shall be paid after ten (10) hours of work.
5.) The provisions of Article 18 shall apply, except that one (1) hour's reporting time shall be paid instead of two (2) hours.
MARKET RECOVERY. It is recognized by the parties that on certain projects, the union construction market is threatened by non-union competition. Where the mutual interests of the Union and the Contractor are served by cooperating to enable Union Contractors to compete more effectively, it is agreed that the Local Union having jurisdiction can negotiate a market recovery addendum to this Agreement on a job by job basis.
MARKET RECOVERY. 401 - Market/Geographic Area Committee. The parties to this Agreement recognize the constantly changing nature of the industry with respect to certain market and/or geographic areas and the necessity of the individual employers to maintain competitive positions in those areas in order to protect and assure the continued work opportunities of the employees covered by this Agreement. Therefore, the parties hereby establish a Market/Geographic Area Committee composed of one (1) representative of the Employer and one (1) representative of the Union. The committee shall evaluate market or geographic area requests for changes or modifications believed necessary to meet competition and determine if adequate economic justification is present to support such a change or modification.
MARKET RECOVERY. Upon the written request of an Employer signatory to this Agreement, the Union may give approval of variations in the wages, hours and conditions of employment set forth in this Agreement for a specific project or projects of a similar nature located within the geographical jurisdiction of this Agreement.
