Other Pays Sample Clauses
The "Other Pays" clause establishes that if a third party, such as an insurer or another responsible entity, covers a payment or obligation owed under the contract, the primary party's responsibility to pay is reduced or eliminated to the extent of that third-party payment. For example, if an insurance policy pays for damages that would otherwise be the responsibility of one party under the contract, that party is not required to pay the same amount again. This clause prevents double recovery and ensures that the party benefiting from the payment does not receive more than what is owed, thereby allocating risk and clarifying financial responsibility.
