RESERVATION AND CONTINUATION OF MANAGEMENT FUNCTIONS. 2.01 The Union recognizes that the management and direction of the working forces are fixed exclusively in the Employer and shall remain solely with the Employer except as specifically limited by the express provisions of this Agreement, and without restricting the generality of the foregoing, the Union acknowledges that it is the exclusive function of the Employer to:
(a) maintain order, discipline and efficiency;
(b) hire, assign, discharge, direct, transfer, layoff, recall and suspend or otherwise discipline employees, provided that if an employee claims s/he has been discharged or disciplined without cause, a grievance may be filed and dealt with in accordance with Article 09, Grievance;
(c) determine the materials, facilities and equipment to be used, the specifics of the assigned work, the methods and techniques of work, the standards of performance, the schedules of work and number of personnel to be employed;
(d) establish, enforce and alter from time to time rules and regulations to be observed by the employee.
2.02 The Employer shall exercise its discretion in a just and fair manner.

3.01 UWOSA recognizes that the management and direction of employees are fixed in Western and shall remain solely with Western except as limited by the express provisions of this Agreement, and without restricting the generality of the foregoing, UWOSA acknowledges that it is the exclusive function of Western to:
a) maintain order, discipline and efficiency;
b) hire, assign, retire, direct, promote, classify, transfer, layoff, recall employees;
c) discharge, suspend or otherwise discipline non-probationary employees for just cause;
d) discharge, suspend or otherwise discipline probationary employees;
e) determine the qualifications for and requirements of a position and the standards of work to be performed;
f) expand, reduce, alter, combine, transfer or cease any position, department, operation or service;
g) determine the machinery and equipment to be used, the specifics of assigned work, the methods and techniques of work, the standards of performance, the schedules of work and number of personnel to be employed;
h) establish, enforce and alter from time to time rules and regulations to be observed by the employees.

(b) hire, assign, discharge, direct, promote, demote, classify, transfer, layoff, recall and suspend or otherwise discipline nurses, provided that a claim of discharge or discipline without cause may be the subject of a grievance and dealt with as hereinafter provided;
(c) determine in the interest of efficient operation and highest standard of service, job rating or classification, the hours of work, work assignments, methods of doing the work and the working establishment for the service;
(d) generally to manage the operation that the Employer is engaged in and without restricting the generality of the foregoing to determine the number of personnel required, the services to be performed and the methods, procedures and equipment in connection therewith;
(e) make and enforce and alter from time to time reasonable rules and regulations to be observed by the nurses not inconsistent with the provisions of this Agreement. The Employer will advise the Association of any change of rules and regulations.
B.02 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.

4.01 The Union recognizes that the management and direction of the working forces are fixed exclusively in the Employer and shall remain solely with the Employer except as specifically limited by the express provisions of this Agreement, and without restricting the generality of the foregoing, the Union acknowledges that it is the exclusive function of the Employer to:
(a) maintain order, discipline and efficiency;
(b) hire, assign, discharge, direct, transfer, layoff, recall and suspend or otherwise discipline employees, provided that if an employee claims s/he has been discharged or disciplined without cause, a grievance may be filed and dealt with in accordance with Article 11, Grievance and Arbitration Procedure;
(c) determine the materials, facilities and equipment to be used, the specifics of the assigned work, the methods and techniques of work, the standards of performance, the schedules of work and number of personnel to be employed;
(d) establish, enforce and alter from time to time rules and regulations to be observed by the employee.
4.02 The Employer shall exercise its discretion in a just, fair, and equitable manner.
4.03 By September 1 of each year, the Employer shall provide a workshop on the provisions of this Collective Agreement to persons designated by the Department, School, or Faculty who administer the Collective Agreement. The Employer shall consult with the union through the Joint Labour/Management Committee as to what topics may be appropriate to emphasize in the workshop. Persons designated by the Department, School, or Faculty shall be required to attend this workshop on an annual basis during the life of this Collective Agreement. Course supervisors shall be encouraged to attend this workshop.
4.04 In consultation with the Union, the Employer will maintain relevant training materials and guides, including but not limited to the Duties Specification Agreement and Administration of Overtime provision guides.

(c) determine the machinery and equipment to be used, the methods and techniques of work, the standards of performance, the schedules of work and number of personnel to be employed;
(d) establish, enforce and alter from time to time rules and regulations to be observed by the employees.
.02 The Employer's right to exercise the management function in this Article is subject to the provisions of this Agreement.
.03 The Employer and the Union agree that in accordance with the Ontario Human Rights Code, there shall be no discrimination or harassment in the application of the provisions of this Agreement because of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, age, marital status, family status, handicap or any other prohibited grounds that may be established in the Code.
.04 The Employer and the Union agree that there shall be no discrimination in the application of the provisions of this Agreement by reason of membership, non-membership or activity/non-activity in the Union, or by the member’s exercise of any provision or right under this Agreement.

B.1 The Association recognizes that the management of the Hospital and the direction of working forces are fixed exclusively in the Hospital and shall remain solely with the Hospital, except as specifically limited by the provisions of this Agreement, and without restricting the generality of the foregoing, the Association acknowledges that it is the exclusive function of the Hospital to:
(a) maintain order, discipline and efficiency;
(b) hire, assign, retire, discharge, direct, promote, demote, classify, transfer, layoff, recall and suspend or otherwise discipline employees, provided that a claim of discharge, suspension or discipline without cause may be the subject of a grievance and dealt with as hereinafter provided;
(c) determine in the interest of efficient operation and highest standard of service job rating or classification, the hours of work, work assignments, methods of doing the work, the working establishment for the service and the location of work;
(d) generally to manage the operation that the Hospital is engaged in and without restricting the generality of the foregoing to determine the number of personnel required, methods, procedures and equipment in connection therewith;
(e) make and enforce and alter from time to time reasonable rules and regulations to be observed by the employees;
(f) the Hospital must operate in a manner consistent with its obligations to the public.
B.2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.
RESERVATION AND CONTINUATION OF MANAGEMENT FUNCTIONS. B-1 The Association acknowledges that it is the function of the Employer:
(a) to maintain order, discipline and efficiency, and to establish and from time to time alter reasonable rules and regulations governing the conduct of nurses. Such reasonable rules and regulations and any changes thereto shall be communicated to the nurses and the Association, and shall be posted on all bulletin boards;
(b) to direct the working forces and to decide on the number of nurses needed by the Hospital at any time and to decide on the use of new or improved or changed methods and equipment;
(c) to hire, discharge, retire, transfer, promote, demote, suspend or otherwise discipline nurses, provided that a claim of unjust promotion, demotion, transfer, lay-off, or suspension or a claim that a nurse has been discharged or disciplined unjustly may be the subject of a grievance dealt with as herein provided.
B-2 These rights shall not be exercised in a manner inconsistent with the provisions of the Collective Agreement.

4.02 The Employer shall exercise these rights in a manner that is reasonable, not arbitrary, and consistent with this Agreement.
RESERVATION AND CONTINUATION OF MANAGEMENT FUNCTIONS. B-1 The Union acknowledges that it is the exclusive function of the Employer to manage and direct its operations and affairs in all respects and without limiting or restricting that function to:
(a) To maintain order, discipline, efficiency, and quality patient care;
(b) Hire, assign, retire, discharge, direct, promote, demote, classify, transfer, layoff, recall and suspend or otherwise discipline Employees, provided that a claim of discharge or discipline without just cause may be the subject of a grievance and dealt with as hereinafter provided;
(c) Determine in the interests of efficient operation and highest standard of quality patient care and service, job rating or classification, the hours of work, work assignments, methods of doing the work and the working establishment for the service;
(d) Generally to manage the operation that the Hospital is engaged in and without restricting the generality of the foregoing, to determine the number of personnel required, the services to be performed and the methods, procedures and equipment in connection therewith;
(e) Make and enforce and alter from time to time reasonable rules and regulations to be observed by the Employees not inconsistent with the provisions of this Agreement.
B-2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.
