Section Union Security. (a) Every motor vehicle and every piece of mobile equipment used by the Company, categories of which are set out in Appendix "A", whether by the Company or leased by the Company, shall be operated by a member of the Union. In the hiring of equipment on any basis, the Company shall first make every effort to obtain equipment operated by a member of the Union from a company signatory to this Agreement. However, if unable to do so and if equipment is to remain in the hire of the Company in excess of forty-eight (48) hours, it shall be replaced by equal equipment operated by a member of the Union if available in immediate or adjacent area from a company signatory to this Agreement. The Company agrees that where leased or hired equipment is used, such equipment shall only be used or hired from companies, individuals or firms whose dependent contractors and company drivers are covered by Collective Agreement with Teamsters Local Union No. If it becomes necessary for the Company to dry lease equipment, said equipment shall be operated by members of Teamsters Local Union No. All storing and handling of merchandise or other goods or materials shall be carried on by Company dependent contractors and company drivers, members of the Union, categories of which are set out in Appendix "A", where such work is under the control of the Company. Wherever physically possible and where such work is under the control or direction of the Company, all equipment shall be loaded and unloaded by the dependent contractors and company drivers of the Company, members of the Union. The practice of loading and unloading equipment by other than dependent contractors and company drivers of the Company where such work is under the control or the direction of the Company shall not be increased and shall wherever possible be discontinued. The Company agrees not to contract out any work normally performed by dependent contractors and company drivers covered by this Agreement if any dependent contractor is on lay-off for lack of work at the time such contracting out is introduced or if the contracting out would cause the lay-off of any dependent contractor.

Section Union Security. (1)The parties agree to the following Union security provisions covering all employees:
Section Union Security. Any Crewmember shall, as a condition of continued employment, agree to sign the payroll deduction form for the purpose of union dues deduction (See Annex This form is provided by the Union and given to the Crewmember by the Company. Union dues shall be deducted as of the Crewmembers first pay cheque after the coming into effect of this Collective Agreement. The Company shall deduct from the pay cheque of each Crewmember, every pay period, the amount owed to the Union for union dues, and on the second pay period of the month the amount owed for initiation fees, where applicable, and/or any other special or occasional deduction requested by the Union. In the event of an error, the Company shall not be responsible financially or otherwise, either to the Union or to any Crewmember for any failure to make deductions or for making improper or inaccurate deductions or remittances other than to adjust the error in a subsequent deduction and remittance. The Company’s liability for any and all amounts deducted pursuant to the provision of this section shall terminate at the time it remits payment to the Union. The Union shall advise the Company of the amount of union dues, initiation fees and/or any deduction determined by the Union, and the Company shall remit the amounts so deducted to the authorized Union Representative before the fifteenth ( I 5th) day of the month following the month during which said deductions were made, along with a list of all the Crewmembers. Only payroll deductions now or hereafter required by law and deductions of total amounts due to the Company shall be made from wages prior to the deduction of dues. In the event of a labour dispute within the Company, the Company and the Union shall meet and try to agree on the appropriate measures to be taken, in order to ensure the Crewmembers’ safety, their belongings and the Company’s property. SECTION REPRESENTATION In this Agreement, the term "Certified Representative" shall mean the Crewmember or the business agent from Local (hereinafter the "Business Agent"). Section Union Security. As a condition of employment, all employees hired before and after the signing of this Agreement shall complete an Authorization of Check-Off form (Appendix and shall have deducted the amount of Union dues or its equivalent as a condition of continued employment. Such amount shall be the current constitutional Union dues or its equivalent as pre- scribed by the Constitutional authority of the United Steelworkers of America. As long as an Authorization of Check-Off form is in effect, the Company shall deduct the amount of Union dues or equivalent from the salary of the employee concerned. The deduction shall be made from the first pay cheque of the subsequent month and monthly thereafter. All Union dues or equivalent deducted under the terms of this Section of the Agreement shall be remitted by the Company to the person by the Financial Secretary of‘Local to receive such dues on or before the last day of each calendar month.

ARTICLE3 GENERAL Section Posting of Agreement The Company will provide a bulletin board in each Company lunchroom or dispatch area for the posting of this Agreement and for such notices as the Union or Company may from time to time wish to post. Provided capable employees are available, all suitable equipment must be in use before additional equipment can be leased or hired.
