Seniority While Outside Bargaining Unit. A bargaining unit employee, who is transferred out of the bargaining unit, shall retain bargaining unit and classification seniority for a period of six (6) months measured from the date of the transfer. City-wide seniority shall continue to accumulate, regardless of the length of time an employee performs work outside the bargaining unit. An employee who has been transferred out of the bargaining unit may not use bargaining unit or classification seniority bump back into the bargaining unit in the event of a reduction of the work force.

Seniority While Outside Bargaining Unit. An Employee who accepts an out-of-scope position with the Employer shall not accumulate seniority. In the event the Employee returns to the bargaining unit within eighteen (18) months, prior bargaining unit seniority shall be reinstated. This term may be extended through mutual agreement between the Union and the Employer.
Seniority While Outside Bargaining Unit. (a) When an Employee covered by this Agreement accepts a position outside the Bargaining Unit he/she shall retain his/her seniority within the Bargaining Unit and his/her job in the Bargaining Unit will be held for a maximum of ninety (90) calendar days. The Employer agrees to advise the Union, in writing, whenever an Employee has been temporarily transferred from the Bargaining Unit to a non- union position.
Seniority While Outside Bargaining Unit. ‌ A bargaining unit employee who is promoted out of the bargaining unit shall be permitted to return to the Patrol Officer classification or rank. In the event this occurs, the employee’s Patrol Officer bargaining unit seniority shall resume from the point at which the employee was promoted or transferred out of the Patrol Officer bargaining unit. City-wide seniority shall continue to accumulate regardless of the length of time an employee performs work outside the bargaining unit. If an employee bumps back into or returns to the bargaining unit, the employee may be placed on the shift that has an opening or on which manpower is most needed, as determined by the City, if no shift has an opening at the time the employee bumps back. The employee will then be permitted to bid their shift during the next shift bidding cycle in accordance with the process set forth in Article 5, Section 5.1.
Seniority While Outside Bargaining Unit. No employee shall be forced to take any position outside of the bargaining unit. An employee may accept a temporary non-union assignment of up to six (6) months in a twelve (12) month period without losing their seniority in the bargaining unit. This time frame may be extended by an additional six (6) months upon mutual agreement between the Parties. It is agreed that any and all vacancies resulting from the initial vacancy shall be posted and filled as per Article 18. Upon return to the bargaining unit, the employee shall be returned to his/her former position. In addition, any other job position changes to any other bargaining unit member shall also revert back to their original positions. Upon return to the bargaining unit, the employee’s seniority date will be adjusted by the number of weeks the employee is in the excluded position. During this period of leave, the employee will continue to pay union dues based on the rate of pay in the new position.

  • Positions outside the Bargaining Unit (a) An employee may substitute temporarily in a position outside the bargaining unit for up to fifteen (15) months from the date of the assignment. Bargaining unit employees shall be given the first opportunity to fill the resulting vacancy. The employee shall have the right to return to her or his bargaining unit position prior to the expiry of the fifteen (15) month period by giving the Employer six (6) weeks’ notice. Where an employee is backfilling outside of the bargaining unit for purposes of pregnancy and/or parental leave, the period of time will be extended up to nineteen (19) months from the date of the assignment. An employee who remains outside of the bargaining unit beyond the period covered by this article shall lose all seniority. When the employee returns to the bargaining unit, all other employee(s) shall revert to their previous positions. An employee must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer unless the parties agree otherwise.

  • Transfers and Seniority Outside Bargaining Unit No employee shall be transferred to a position outside the bargaining unit without the employee's consent. If an employee is transferred to a position outside of the bargaining unit, the employee shall retain seniority acquired at the date of leaving the unit, but will not accumulate any further seniority. If such an employee later returns to the bargaining unit, the employee shall be placed in a job consistent with the employee's seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.

  • Bargaining Unit Seniority The length of continuous service in a position or succession of positions within Bargaining Unit Two (2), beginning with the last date of hire or transfer into the Bargaining Unit, as defined by seniority credits.

  • Single Bargaining Unit The parties to this Agreement, along with all those employees whose employment is governed by this Agreement, constitute a single bargaining unit for the purposes of negotiating and implementing the terms of this Agreement. The form and operation of this single bargaining unit will be subject to this Agreement.
