Supplemental Employment Benefits (SEB) Plan. L35.1 The Supplemental Employment Benefits Plan hereinafter referred to as the SEB Plan means the Plan set out in Appendix B.
L35.2 A Teacher who has been granted:
(a) Pregnancy Leave and who is eligible to receive employment insurance maternity benefits, or
(b) Parental Leave for the purposes of adoption and who is eligible to receive employment insurance parental benefits, and who complies with the requirements of the SEB Plan shall be compensated in accordance with the SEB Plan.
Supplemental Employment Benefits (SEB) Plan. (a) The object of this SEB Plan is to supplement the employment insurance (E.I.) benefits received by DECEs from the Canada Employment and Immigration Commission for temporary unemployment caused by Pregnancy or Adoption Leaves.
(b) Only DECEs granted a Pregnancy Leave or an Adoption Leave are covered by this Plan.
(c) The other requirements for receipt of a SEB are:
Supplemental Employment Benefits (SEB) Plan. All employees eligible for Maternity Leave and sick leave benefits will be covered by the Supplemental Employment Benefits Plan hereinafter called “the Plan”. The Plan is to supplement Employment Insurance benefits (E.I. benefits) received by employees for temporary unemployment caused by health-related reasons relating to pregnancy, during Maternity Leave. The Plan shall only be payable for days which the employee would have worked had she not been absent on Maternity Leave. Employees shall prove that they have applied for and are in receipt of E.I. benefits, and that they are incapable of working because of a condition related to the pregnancy in order to receive payment under the Plan. The Plan is payable for a period during which an employee is not in receipt of E.I. benefits if the only reason for non-receipt is the claimant is serving a two (2) week E.I. waiting period. Employees shall submit a District Medical Form recommending absence from work because of a condition relating to her pregnancy. The benefit level paid under the Plan is set at the equivalent of the employee’s regular salary and benefits. The total amount of Plan benefits and E.I. benefits will not be greater nor less than the equivalent of the employee’s regular salary and benefits. An employee who is not eligible for E.I. benefits shall be entitled to access sick leave for the duration of the health-related portion of Maternity Leave. The Plan will be paid for the duration of absence from duties for a health reason relating to pregnancy, during maternity leave up to a maximum of 15 weeks. The duration of absence will be determined by a District Medical Form from the employee’s physician or a midwife registered with the College of Midwives of Alberta. After ninety (90) consecutive working days of disability, the employee shall apply for Long Term Disability Insurance benefits and the Plan payments shall cease. The Plan will be financed by the District’s general revenues. SEB payments will be identified and kept separately from the District’s payroll records. Employees do not have any right to the Plan payments except for supplementation of the E.I. benefits for the unemployment period specified in the Plan. Payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits will not be reduced or increased by payments received under the Plan. Supplemental Employment Benefits (SEB) Plan a) In recognition that there will be a physical and/or mental health related portion of any maternity leave during which a woman may be medically unfit for duty as an employee due to pregnancy, delivery or post-delivery, such employee shall be eligible for SEB Plan benefits if she is: • on maternity leave; • medically unfit for duty for health-related reasons due to pregnancy, delivery or post-delivery; and • in receipt of Employment Insurance benefits or serving the waiting period.
b) Effective September 1, 2013, every employee who is eligible for SEB Plan benefits in accordance with 9.04.
03 a) shall be entitled to such benefits for a period of seventeen (17) weeks commencing the date of delivery, without being required to provide medical evidence. SEB Plan benefits will only be paid for days for which employees would normally receive pay.
c) A female employee shall apply to the Employer for SEB Plan benefits, using forms established by the Employer, no later than one hundred and twenty (120) calendar days following the birth of her child.
d) The amount of SEB Plan benefits provided shall be the amount required to supplement the employee’s Employment Insurance benefits to ninety-five percent (95%) of her salary entitlement, subject to the usual deductions required.

Supplemental Employment Benefits (SEB) Plan. C.11.1 The object of this SEB Plan is to supplement the employment insurance (E.
I.) benefits received by teachers covered by this collective agreement from the Human Resources and Social Development Canada for temporary unemployment caused by Pregnancy or Adoption Leaves.
C.11.2 The teacher must apply for and be in receipt of E.I. pregnancy or adoption benefits from the Human Resources and Social Development Canada before SEB becomes payable and must also be eligible for pregnancy or adoption leave under the Ontario Employment Standards Act.
C.11.3 An application for SEB must be made by the teacher on a form to be provided by the Board. The teacher shall provide verification of the approval of the E.I. claim.
C.11.4 The teacher will receive 100% of the teacher’s full salary during the two-week waiting period before E.I. benefits commence. For the following three (3) weeks the teacher’s E.I. benefits will be supplemented to 100% of the teacher’s full salary. During this five (5) week period there will be no deduction to the teacher’s sick leave account.
C.11.5 SEB payments will be financed by the employer. A separate accounting will be kept on SEB payments.
C.11.6 On termination of the plan all remaining assets will revert to the employer or be used for payments under the plan or for administrative costs of the plan.
C.11.7 Employees do not have a right to SEB payments except for supplementation of E.I. benefits under Article C.11.4 during the unemployment period as specified in the plan.
C.11.7.1 Employees do not have the right to SEB payments if they are accessing the postpartum sick leave plan.
C.11.8 Payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under this plan.
C.11.9 Effective September 1, 2010 the application of the SEB Plan as outlined in C.11.0 shall apply to all eligible teachers throughout the calendar year.

In recognition that there will be a health related portion of a maternity leave during which a woman will be medically unfit to work for health related reasons due to pregnancy, delivery or post-delivery, benefits for this period will be paid under the provisions of a Supplemental Employment Benefits Plan (SEB Plan) designed by the Employer and in accordance with the registration requirements of the Benefits Program, Canada Employment and Immigration. C.11.2 The teacher must be eligible to receive E.I. pregnancy or parental benefits from the Human Resources Centre of Canada, (Formerly know as Canada Employment and Immigration Commission) and must also be eligible for pregnancy or parental leave under the Ontario Employment Standards Act.
C.11.3 An application for SEB must be made by the teacher on a form to be provided by the Board. The teacher shall provide verification of the approval of the E.I. claim.
Supplemental Employment Benefits (SEB) Plan. An Employee, who is in receipt of Employment Insurance (EI) maternity, parental or adoption benefits pursuant to The Employment Insurance Act, shall be paid a SEB that is equivalent to the difference between the gross weekly EI benefit the Employee is eligible to receive and one hundred percent (100%) of the Employee's regular weekly rate of pay. This SEB payment shall commence following completion of the one-week EI waiting period and upon submitted proof of receipt of EI benefits. The SEB payment shall continue while the Employee is in receipt of the EI maternity benefits for a maximum of fifteen (15) weeks. The Employer will pay one hundred percent (100%) of the Employee's regular weekly rate of pay for the one-week waiting period required for maternity, parental or adoption benefits under the Employment Insurance Act.
