Testing Criteria. No unit member shall be required to submit to a medical evaluation of his physical or mental condition in regard to a chronic communicable infectious disease without determination of probable cause for said evaluation. The probable cause determination shall consist of: 1) a report in writing as defined above, or; 2) the unit member agreeing to voluntarily submit to such an evaluation.
Testing Criteria a. No bargaining unit member shall be required to submit to a medical evaluation of his/her physical or mental condition without determination of just cause for said evaluation. The just cause determination shall be made by a tripartite panel which shall conduct a due process hearing and render a written determination which shall be final and binding on the parties.
b. The tripartite panel shall be comprised of a physician selected by the Board, the bargaining unit member's personal physician, and an arbitrator mutually selected by the Board and the Association in accordance with the procedures set forth in the grievance procedure of this Contract. The mutually selected arbitrator shall act as chairman of the panel and shall serve in that capacity for all subsequently convened panels to determine probable cause for medical evaluation.
c. The tripartite panel shall conduct a due process hearing to determine whether there is probable cause for the medical evaluation of a bargaining unit member. Within ten (10) days after the conclusion of the due process hearing, the panel shall render a written determination and the rationale to the Superintendent and the bargaining unit member.
d. In the event that a health risk becomes apparent and may affect many or all bargaining unit members, as determined by a physician in the appropriate public health district, the Board, with concurrence of the Association, shall be permitted to bypass the tripartite panel and immediately provide for the examination and/or immunization of any or all bargaining unit members to prevent the spread of the disease.
e. All costs of the tripartite panel shall be borne by the Board.
Testing Criteria. The assessment centers shall be developed in accordance with the most current Guidelines and Ethical Consideration for Assessment Center Operations, International Taskforce on Assessment Center Guidelines. These guidelines establish specific requirements and procedures for conducting assessment centers. The specific job-related exercises shall be used in a custom assessment center will be developed by an approved third party administrator. The assessment center testing may consist of the following criteria: Interview Exercise: Oral Presentation Exercise; In-Basket Exercise; and Role-Play Scenario Exercises.

Testing Criteria. Employees may be tested for alcohol or drugs under any of the following conditions:
1. Reasonable grounds would include a combination of various factors such as: slurred speech, red eyes, dilated pupils, incoherence, unsteadiness on feet, smell of alcohol or marijuana emanating from the employee’s body, increased carelessness, erratic behavior, inability to perform their job, other unexplained behavioral changes. The department shall not be limited to the above examples. Any employee not currently trained and certified as an E.M.T.-A., Advanced E.M.T.- A. or E.M.T.-P. should receive training in the signs and symptoms of alcohol and drug abuse.
2. After participation in an alcohol or drug abuse rehabilitation program, an employee shall be required to undergo tests, within the two (2) year period following the successful completion date of the program.
3. During the investigation of any motor vehicle accident or injury that is the fault of the employee, or an incident in which an employee or employees are involved in on duty, which may lead to liability issues or question of impairment. These tests are done for investigative purposes, as well as to assist in the establishment of an "affirmative defense" and will be completed as soon as possible following the incident during the following circumstances: • Motor vehicle accidents in which the employee is cited, damages are likely to or will generate an insurance claim on the part of the township, a motor vehicle accident which is likely to or may result in a potential legal liability for the township or results in an injury requiring immediate medical treatment. • Where required to be eligible for workers compensation when an on duty injury requires medical treatment at the time of injury. Upon completion of the tests, the employee(s) will be taken to their home and placed on paid administrative leave until the results of the test have been received.
Testing Criteria. All test criteria with respect to Early Window Titles on Licensed Service is to be determined by Licensor in its sole discretion; provided that the test criteria will include the following: Licensor anticipates testing a variety of Early Window Availability Dates for Early Window Titles, provided that it will not test an Early Window Availability Date on a date that is less than six (6) weeks from the date of the “Widest Theatrical Release” for such Early Window Title in Canada nor later than 8 weeks and 6 days after Widest Theatrical Release. Notwithstanding the foregoing, in the event that Licensor determines in its reasonable discretion that the marketing program for an Early Window Title is not aligned with the intent of the Early Window Test, Licensor shall have the option to move the initial availability date for all subsequent Early Window Titles to a date that that is more than 8 weeks after theatrical release. Unless Licensor notifies Licensee otherwise, the Early Window Availability Date for each Early Window Title will fall on a Wednesday. As used herein, “Widest Theatrical Release” shall mean the initial theatrical release of the Early Window Title in the Territory or throughout the whole of the Xxxxxxx Xxxxxxx Xxxx; provided that if the initial theatrical release is distributed as a “limited” theatrical release, such that the Early Window Title is made available only in select geographical areas (other than the whole of the Xxxxxxx Xxxxxxx Xxxx) within the Territory, then Widest Theatrical Release shall instead mean the materially expanded release that follows the limited theatrical release; provided further that if the Early Window Test is limited to the geographic area of the limited theatrical release, then Widest Theatrical Release shall mean the limited theatrical release. Licensor will provide Licensee with three weeks advance notice of the Early Window Availability Date of each Early Window Title. The public announce date for each Early Window Title will be no more than two weeks prior to the Early Window Availability Date. Each Early Window VOD Term shall be no fewer than fourteen (14) calendar days, which period will end at least four (4) weeks prior to the date of the DVD release for the applicable Early Window Title in the Early Window Territory. Determination shall be made by a tri- partite panel which shall be final and binding on the parties. The tri-partite panel shall be a physician selected by the employer, the teacher’s personal physician, and a third party selected by the county health department. The third party shall act as chairman of the panel and shall serve in that capacity for all subsequently convened panels. The tri-partite panel shall conduct a due process hearing to determine whether there is probable cause for the medical evaluation of a teacher. Within ten (10) calendar days after the conclusion of the due process hearing, the panel shall render a written determination and the rationale to the Superintendent and the teacher. In the event that a health risk becomes apparent and may affect any or all teachers, as determined by a physician in the appropriate public health district, the employer, with concurrence of the OTA or at the request of the teacher, shall be permitted to bypass the tri-partite panel and immediately provide for the examination and/or immunization of any or all teachers to prevent the spread of the disease.
