Work Preference. Regular nurses shall have work preferences on the basis of seniority and skill and ability. The qualified senior nurse shall be given first opportunity to fill vacancies and shall be scheduled before less senior nurses, full time, and part time, respectively. In layoff situations, the least senior qualified nurse shall be the first to be laid off. Length of service, together with skill and ability in these specific areas, will be used, recognizing that the best interests of the patients is the primary consideration. Where skill and ability are equal, length of service shall prevail.
Work Preference. Preference for all available work time shall be given to bargaining unit employees over any other individuals. Outside Agency personnel may be utilized after available work time has been offered to bargaining unit employees who have made themselves available for said work time by so indicating on a daily "Availability List" not later than seven (7) days after the posting of the next monthly schedule. These lists will be maintained in their respective departments and will be made available for review by the Union, upon reasonable notice. In the Nursing Division, "Overtime Availability Forms" will be submitted to a central nursing location. The forms will be made available for review by the Union upon reasonable notice. In the event of call-ins, bargaining unit employees who have made themselves available on said list, followed by bargaining unit employees currently on duty in each respective department, shall be offered said work time prior to utilizing outside agency personnel.
Work Preference. The Employers will give preference to owner operators (dump trucks and disposable boxes) who are members of Teamsters' Union Local 230. It is agreed that owner-operators, utilized by employers, shall be members of, or shall within seven (7) working days of their first (1st) day of engagement obtain membership in Local 230 (which Local 230 must not withhold) and thereafter shall continue to pay monthly dues (but not initiation fees in the case of new members) at the standard rate. The terms and conditions of engagement of owner-operators will in all other respects be individually determined and are not in any other way covered by the provisions of this Agreement.

A bargaining unit employee may bump an agency nurse with at least 24-hour notice before the start of the shift. In the event there is less than 24 hours notice then Virtua shall have the discretion whether or not to permit the bumping to occur. In the event of call-outs, bargaining unit employees who have made themselves available, followed by bargaining unit employees currently on duty, shall be offered said work prior to Virtua utilizing outside agency personnel.

Length of service, together with skill and ability 25 in these specific areas, will be used, recognizing that the best interests of the 26 patients is the primary consideration. Where skill and ability are equal, length 27 of service shall prevail. 28
Work Preference. Preference for available bargaining unit work shall be given to bargaining unit employees over contracted staff. Bargaining unit work shall not include preference for individual patient assignments or specific work assignments.

Bargaining unit work shall not include preference for individual patient assignments. Agency nurses may be utilized for posted, unfilled vacancies, if no qualified candidate has applied during the posting period, and for unanticipated staffing fluctuations on a temporary basis not to exceed ninety-one (91) days. Agency contracts may be renewed as long as the vacant position remains posted and there are no applicants at the time of the renewal. Agency nurses shall not be used to eliminate bargaining unit positions, or to permanently replace or reduce the hours of bargaining unit positions.

Drivers with available hours who wish to work on the weekend will be required to sign a weekend work sheet. This sheet will be posted on Wednesday and will remain posted until Friday at Those drivers who do not sign the sheet will be considered for weekend work. Employees who have signed the list and have available hours will be offered weekend work in order of seniority. The Company shall endeavour to arrange the highway runs in a manner that will give preference to senior drivers. Whenever extra employees are required in the Highway Department, the Company agrees that the senior City Driver shall have the first opportunity of bidding on such run, provided he has the necessary qualifications. An employee, who feels he has been unjustly dealt with in this respect, shall have recourse to the Grievance Procedure outlined in Article of this Agreement.
