Personal Files. (a) There shall be one (1) official recognized personal file and this file shall be maintained by the Employer. An employee shall, after making an appointment, be allowed to inspect his/her personal file and may be accompanied by a representative of the union if he/she so desires. A copy of any document placed in an employee's official personal file, which might at any time be the basis of disciplinary action, shall be supplied concurrently to the employee who shall acknowledge having received the same document by signing the file copy.
Personal Files. Any Owner Operator and Employee shall be allowed to inspect his/her own personal file in the presence of the Company, during normal business hours. Any officer of the Union, acting on behalf of the Owner Operator and/or Employee, may inspect the Owner Operator's and Employee file, with the written authorization from the Owner Operator and/or Employee. Any reprimand notices or corrective action measures will remain on the Owner Operator’s and Employee(s) files for one year from the date of notice or reprimand, unless there is a re-occurrence of the same or similar infraction. At the completion of the one year period, the reprimand or corrective action notice will be removed from the file. If a repeat infraction occurs within the one year period, the original and subsequent notices or reprimands will remain on the file for a further year from the date of the most recent notice or reprimand. Reprimand notices and disciplinary measures resulting from a violation of a criminal or civil nature, including driving record, will remain part of the Owner Operator's and/or Employee file indefinitely. Whenever an Owner Operator and/or Employee signs a document pertaining to discipline, he/she does so only to acknowledge that he/she has been notified accordingly.

Personal Files. (a) The Board shall treat Employee files and communications as confidential and shall not examine or disclose information without just cause nor disclose information to a third party unless it is for use in a disciplinary or criminal investigation or has been the subject of a subpoena served on a representative of the Board. Authorization to search, access or disclose personal data shall require the approval of the Vice-President (Administration). The Association shall be notified of any exercise of this clause and the circumstances leading to that exercise.
(b) The Parties agree that members have a right to privacy in their personal and professional communications and files, whether on paper or in an electronic form.
Personal Files. 12.1 Data pertaining to the employment of an employee and necessary for the administration of this Agreement shall be placed in a personal file within the office of the employee's Xxxx; copies of the data contained in the personal file in the Xxxx'x office may also be kept in department files and in the President's Office. In the case of medical reports provided in confidence by an employee's physician for the purpose of complying with the terms of the Academic Long Term Disability Plan, and in that case only, information regarding that employee shall be kept in a separate file in the Human Resources Division, and shall be accessible only to agents of the Employer for the purpose of administration of that plan. Any other requests for access to that information must be approved by the Joint Committee for the Management of the Agreement. The Employer is responsible for assuring that the personal files within the Deans' offices have all of the relevant data. In particular, material in departmental and other files to be used in connection with renewal of probation, tenure, promotion or salary review shall be contained in the Xxxx'x Office file. Employees are expected to cooperate with designated University officers engaged in the discharge of this responsibility.
12.1.1 No anonymous material, except approved course evaluations, shall be kept by the Employer concerning any employee. Approved course evaluations are those which (a) are approved for use by the faculty of a department (or College in the case of a non-departmentalized College) in committee within guidelines established by the College, and (b) are properly validated instruments of performance evaluation. Information from such course evaluations included in an employee's file shall be aggregated or summarized and shall exclude any anonymous remarks made by students.
12.2 Each employee shall have the right to reasonable access to the entire contents of the employee's own personal file, with the exception of confidential information, as defined in Article 12.
Personal Files. 41.01 There shall be one official personal file, the location of which shall be designated by the permanent head. An employee shall at any reasonable time, be allowed to inspect his/her personal file and may be accompanied by a representative of the Union if he/she so desires.
41.02 A copy of any document placed on an employee's official personal file which might at any time be the basis of disciplinary action, shall be supplied concurrently to the employee who shall acknowledge having received such document by signing the file copy.
41.03 Any such document shall be removed and disregarded after the expiration of two (2) years from the date it was placed in the employee's file provided there has not been a recurrence of a similar incident during that period. The employee shall be responsible to see that any such document is removed.
41.04 When a formal assessment of an employee's performance is made, the employee concerned must be given an opportunity to acknowledge receipt of the assessment form in question. When as a result of this assessment, the performance of an employee is judged to have been unsatisfactory; the employee may present a grievance in accordance with Article 12.
