Reinstatement after Leave. An employee on an approved leave of absence is required to contact the Appointing Authority if an extension is being requested. Failure to contact the Appointing Authority about an extension prior to the end of the approved leave shall be deemed to be a voluntary resignation, and the employee shall be severed from State service. The Local Union and the Appointing Authority may agree to waive the five (5) month reassignment restriction in order to temporarily fill the position of an employee on unpaid Military Leave until s/he returns from active duty. Any employee returning from an approved leave of absence as covered by this Article shall be entitled to return to employment in his/her former position or another position in his/her former class/class option in his/her seniority unit, or a position of comparable duties and pay within his/her seniority unit. Employees returning from extended leaves of absence (one (1) month or more) shall notify their Appointing Authority at least two (2) weeks prior to their return from leave. Employees may return to work prior to the agreed upon termination date with the approval of the Appointing Authority. Employees returning from an unpaid leave of absence shall be returned at the same rate of pay the employee had been receiving at the time the leave of absence commenced plus any automatic adjustments that would have been made had the employee been continuously employed during the period of absence. Reinstatement after Leave. Except as provided in this Agreement or by Minnesota law, an employee who returns from a leave of absence without pay has the right to return to employment in the same Department and in the same classification at the expiration of the leave. An employee who is laid off before the leave expires shall be entitled to the layoff provisions of the Agreement. An employee returning from an unpaid leave of absence shall be compensated at the same rate of pay received when the leave commenced plus any non- discretionary increases which became effective during the time of the leave. For increases requiring a specific length of service in order to be eligible, any time off the payroll of four (4) consecutive months or more will extend the eligibility date for the next increase by the entire time off the payroll.

Any supervisor returning from an approved leave of absence of less than six (6) months, shall be entitled to return to a position in his/her former classification within thirty-five (35) miles of the former position. For approved leaves of absence of six (6) months or more, supervisors shall be entitled to return to one of the following: • a position in the class from which the supervisor left and within thirty-five (35) miles of the former position, or • a vacancy in a related class, with the same range assignment as the supervisor's class, for which the supervisor is determined qualified by the employer, and within thirty-five (35) miles of the person's work location. Reinstatement after Leave. When a family leave of absence is granted for more than twelve (12) weeks, the Employer does not guarantee that the employee will be reinstated in their former position or to the same grade and step level when he/she is ready to return to work. That decision will be at the discretion of the Employer. However, every effort will be made to place the employee in a position for which he/she is qualified. If no positions are available, the employee will be given top consideration as job openings occur in line with their qualifications.
