University Rights. 4.1.1 The Association acknowledges that the University possesses and may exercise all powers conferred upon it under the Act, subject to the express provisions of this Agreement. In the implementation of the provisions of this Agreement, the University shall act fairly, equitably, and ethically in its actions affecting Members.
4.1.2 The Association acknowledges that it is the right of the University to hire, appoint, promote, transfer and classify employees and it is the right of the University to dismiss, suspend or otherwise discipline any employee for just and sufficient cause, in a fair and equitable manner in accordance with the provisions and specifications of this Agreement.
University Rights. Except as otherwise specifically provided in this Agreement, all rights, powers or authority possessed by the University prior to the execution of this Agreement including the determination and administration of policy and the control, supervision and direction of all employees are retained by, reserved to and vested exclusively in the University.

4.2.2 In the event that there is a request under FIPPA concerning a Member, the privacy office will inform the Member, at the time of notification, of their right to have WLUFA support throughout the process.
4.2.3 The Association acknowledges that it is the right of the University to hire, appoint, promote, transfer and classify employees and it is the right of the University to dismiss, suspend or otherwise discipline any employee for just and sufficient cause, in a fair and equitable manner in accordance with the provisions and specifications of this Agreement.
University Rights. All rights not specifically addressed in this Agreement or the Framework Agreement are reserved for the University. The University agrees to act fairly, reasonably and without discrimination when exercising these rights. Common law employment principles apply to the employment relationship between the University and employees unless specifically modified by the terms of this Agreement. It is understood that the determination of which matters are covered by a specific term of this Agreement and which are solely within the rights and discretion of the University is subject to the grievance procedure. Exercise of the University’s rights and discretionary decision making power is not subject to the grievance procedure, except with regard to whether such rights and discretion were exercised fairly, reasonably and without discrimination.
University Rights. Except as specifically modified by the terms of this Agreement, the University shall retain all rights and authority, whether exercised or not, to govern, control, and direct its operations. These rights include, but are not limited to:
(a) determine methods, means, resources and personnel by which operations and academic programs are to be conducted;
(b) determine administrative organization;
(c) determine size and qualifications of faculty and staff;
(d) allocate and assign work;
(e) control the use of University buildings, property, equipment and other resources;
(f) determine admission standards and procedures;
(g) determine eligibility for and procedures and processes for awarding scholarships and financial aid;
(h) determine academic standards, policies and procedures;
(i) determine the application of academic standards;
(j) determine academic degree, program and course offerings and requirements;
(k) assess academic programs and determine degree eligibility;
(l) impose academic sanctions including dismissal;
(m) impose sanctions for violation of the Student Conduct Code;
(n) hire, promote, transfer, assign, reassign and retain employees;
(o) suspend, discharge or take other disciplinary action against employees for just cause;
(p) relieve employees from duty due to lack of work or other non-disciplinary reasons.
University Rights. Nothing in this agreement shall be construed to impair the University's exclusive right to manage its affairs and direct the work of its Employees except as otherwise herein expressly provided.
University Rights. The University and the Board of Regents retain and reserve all rights, powers, authority and responsibility vested in them, whether exercised or not, to manage the University. This agreement shall not limit, restrict or modify the right to manage, and all rights inherent therein, except as expressly modified by the terms of this agreement. The right to manage shall include but not be limited to the right to:
a. manage and direct the work of University employees;
b. hire, promote, demote, transfer, assign and retain employees in positions within the University;
c. discipline, suspend, or discharge employees for proper cause;
d. maintain the efficiency of governmental operations;
e. relieve employees from duties or lay off employees because of lack of work, lack of funds or for other legitimate reasons;
f. determine the methods, means and personnel by which operations are to be carried out and determine the size and composition of the work force;
g. determine the mission and goals of the University and the method and means necessary to fulfill the mission and goals, including the right to alter, curtail, or discontinue any goal, service, or program;
h. establish reasonable work rules;
i. plan, govern, and control the University as permitted by law;
j. determine the financial policies and procedures of the University;
k. determine the control and use of University buildings, property, material and equipment;
l. determine degree programs and requirements, course offerings and schedules, standards and procedures for admission to programs, and all other academic standards, policies and procedures;
m. operate the University in accordance with all applicable federal and state laws;
n. take all other actions as the University and the Board of Regents deem necessary to carry out the mission of the University. The foregoing enumeration of the management rights of the University shall not be determined to exclude other rights granted by state or federal law or by the constitutions of Kansas or the United States. Further, this agreement is not intended to supersede any subject controlled by state or federal law, or to deny employees of the University of any rights afforded to them by statute except as expressly waived by the terms of this agreement.
University Rights. 18.2.1 The University retains its statutory rights to the general supervision of the institution and the control and direction of expenditures from the institution’s funds. The University has the legal responsibility to carry out the educational mission of the institution. The University reserves the right to manage, direct and supervise all work performed. The University reserves the right to manage its affairs within its legal mandate and retains all management powers not specifically abridged, delegated or modified by the terms of this Agreement.
18.2.2 These rights include, but are not limited to:
(a) Determining the mission of the University and methods and means necessary to fulfill that mission.
(b) Setting policy for the University.
(c) Determining the size of the University, including the budget and the number and type of academic and nonacademic staff.
(d) Establishing and maintaining standards as they relate to accreditation, curriculum, technology, service and research.
(e) Responsibility for the construction and maintenance of all University facilities, grounds and equipment on and off campus.
(f) Maintaining and improving the efficiency and effectiveness of University operations related to administration and program.
(g) Final authority regarding faculty criteria for hiring and promotion, faculty employment, promotion, transfer, non-appointment, non- renewal, and reassignment.
(h) Determining faculty standards of service, faculty assignments, responsibilities to be performed, scheduling of these responsibilities, and evaluation of performance.
(i) The right to make rules, regulations and policies that do not conflict with the provisions of this Agreement.
(j) Conducting workplace investigations, and disciplining or discharging faculty for cause.
(k) Planning, establishing, modifying, reorganizing or abolishing academic units, degree programs, and courses of instruction.

(p) relieve employees from duty due to lack of available work or other non-disciplinary reasons.
University Rights. The Union recognizes the prerogatives of the University to operate and manage its affairs in such areas as, but not limited to:
(A) direct GAs;
(B) appoint, promote, transfer, assign, and retain GAs;
(C) relieve GAs from duties because of lack of work or funds or under conditions where continuation of such work be inefficient and nonproductive;
(D) maintain the efficiency of government operations;
(E) determine the methods, means, job classifications, and personnel by which government operations are to be conducted;
(F) take whatever actions may be necessary to carry out the missions of the agency in situations of emergency; and
(G) establish the methods and processes by which work is performed.
