HIRING AND PROMOTION. 38.01 No employee shall in any way be penalized for refusing to accept a promotion or transfer. 38.02 The Management agrees to recognize and carry out in practice, whenever feasible and in its best interest the principle of promotion of staff members. 38.03 An employee who is promoted to another occupation will be given a 65 working day probationary period (which may be extended to 90 working days, with the agreement of the union) in the new occupation. If either Management or the employee conclude the employee is unsuitable for the occupation, the employee shall be returned to the former occupation.

HIRING AND PROMOTION. 18.01 The Employer shall fill bargaining unit job vacancies from within the bargaining unit before hiring new employees, providing employees are available with the necessary qualifications to fill the vacant position. The Employer shall notify the Union when vacancies occur.

(f) Where two (2) or more applicants for bargaining unit positions have relatively equal qualifications skill and ability to perform the work required, the employee with the most seniority will be awarded the job. (g) The Employer shall, on request, provide an explanation to an employee as to why his/her application was not successful and identify areas where improvement could be made. (h) If the Employer continues to use the beat system it will post a notice when beats are to be re-assigned. Employees will then have an opportunity to express interest in being assigned to a specific beat. The Employer will give consideration to such expressions of interest in making the decision on the assignment of the beats. (i) New employees shall be on probation for three (3) months. The probationary period may be extended by mutual agreement between the Employer and the Union. The Employer may dismiss a probationary employee for any reason whether the probationary period is extended or not, provided such dismissal is not otherwise arbitrary, discriminatory or in bad faith. (j) Employees shall be free to refuse promotions without penalty.

HIRING AND PROMOTION. 17.01 The Employer shall post notice of any bargaining unit opening for a period of three working days. Present employees will be given first consideration. 17.02 If an employee accepts a promotion to a higher classification, he/she shall be permitted to return to his original position if he so decides within a one (1) month period. The Employer shall have the right to return the employee to his former position if he is not qualified for the higher position.

HIRING AND PROMOTION. New applicants who seek employment as a part-time firefighter in the bargaining unit shall complete the appropriate written application and submit it to the Tallmadge Civil Service Commission. All tests shall be administered by the Tallmadge Civil Service Commission, which shall calculate the results from these tests and shall forward them to the Fire Chief, who shall in all cases make the final selection. In filling the position of Full-Time Firefighter, members of the Association shall be preferred, all qualifications being equal. All promotions shall be filled in as expeditious a manner as possible.
