Administrative Policy. Cal Poly Corporation (CPC) may from time to time, at its sole discretion and without notice, implement new policies and procedures necessary for the effective administration of the collective Dining Plan(s). New policies and/or procedural changes shall not in any way modify material terms, vested rights, or dispute resolution procedures for disputes already in progress.

B. The maximum workweek by full-time education support professionals at their regular rate of pay shall be forty
Administrative Policy. The following administrative policy provisions shall be used for administering the vacation policy:
A. All vacations will be determined from July 1 to June 30 of each contract year. New employees will have vacation allowance prorated at the rate of .83 days per month and will be eligible to take such accrued vacation after the next June 1. New employees must work ten (10) or more days in order to accrue any vacation allowance during the first month of employment. No vacation time will be allowed before the vacation days have been earned.
B. Vacation days may not be accumulated from one year to the next. However, vacation days allowed for the following year may be used beginning June of the current year with approval of the immediate supervisor and department director. Unused vacation days allowed for the previous year may be used through December 31 of the current year with approval of the immediate supervisor and department director. However, vacation days allowed for the current and/or previous year may be taken during June, July, August and September through with approval of the immediate supervisor and department director. After September 30 December 31, the vacation allowance may not exceed the days accrued for the current year.
C. Vacations are to be scheduled at times that are best for the District and the employee. Generally, vacations are to be scheduled during off-peak work seasons. Any special considerations must be approved by the immediate supervisor. Employees must present written vacation plans to the immediate supervisor for approval in advance.
D. The length of vacation is figured on the number of years of continuous contract service in the District. For purposes of computing movement on the vacation schedule, employees hired prior to January 1 will be credited with a full year's employment for the first contract year. Those hired after January 1 will not receive vacation credit for the first year. (Placement on the salary schedule has no relation to vacation allowance.)
Administrative Policy. Administrative Policy is established to provide guidelines for administering the Call Back Pay provisions as specified in the labor agreement. The policy shall establish when the call back provision commences and when it shall end.
a. Duty hours for call back pay purposes shall commence as follows:
1. When the employee reports at the scene of emergency, or;
2. When reserve apparatus is put into service.
b. Duty hours cease when the employee is relieved at either of the two above assignments.
c. Call Back Pay. The employee shall receive thirty (30) minutes pay in addition to the actual time worked as specified in items 1 and 2 above if over three (3) hours.
Administrative Policy. Defendants shall agree to institute the following business practice changes for the benefit of the Settlement Class and crew members.
4.5.1 If a situation arises where the vessels are unable to sail with passengers (and therefore the crew would not be fulfilling the duties for which the shipowner bargained in the contracts with crew), the shipowners may send a memorandum to the entire crew advising them of the facts and asking them to elect three crew representatives in good standing to discuss a resolution. The shipowner would also pick two crew representatives in good standing.

1. Sick leave is intended for use by the employee only for personal health-related absences, except as outlined below under critical family care. Annual leave should be used for non-critical care of an ill family member.
A. B. Definitions
1. Immediate family is defined as husband, wife, daughter, son, father, mother, brother, sister, or other person residing in the employee’s home on a permanent basis. Special circumstances may be appealed to the Sick Leave Review Committee for consideration of immediate family status.
2. Continuous service includes an approved leave of absence, sabbatical leave, sick bank, military and/or FMLA leave.
a. If an employee resigns his/her position in the District and then returns, he/she must start over on years of service and sick leave accumulation.
