ASSOCIATION DUES OR FEES AND PAYROLL DEDUCTIONS. 1. All teachers following thirty (30) days after the effective date of this Agreement or thirty (30) days after the commencement of employment shall have deducted from their pay monthly either: A. Membership Dues of the Association or B. Representation service fees of the Association, not to exceed the amount of dues uniformly required of membership of the Association, nor the amount as permitted by law in accordance with Association established policies and procedures. Teachers may pay Association dues or the representation service fees directly to the Association in lieu of deduction. 2. The Association shall certify to the Board at the beginning of each school year the membership list of the Association subject to deduction of membership dues and the amount of the monthly Association dues to be deducted. The Association shall also certify to the Board, as soon as the amount is known, the amount of the monthly representation service fees to be deducted. These amounts so certified and deducted shall be forwarded to the Association, provided that when a teacher objects to the proper amount of such deduction, the amount of the deduction contested shall be placed in an escrow account as required by law until a determination of the proper amount of the deduction has been determined in the appropriate administrative and/or judicial forums. 3. The Association agrees to indemnify and hold the Board, including each individual school board member and/or its agents, harmless against any and all claims, demands, costs, suits, damages, awards, judgments or other forms of liability, including but not limited to back pay damages and all court or administrative costs that may arise out of or by reason of any action taken by the Board or its agents for the purpose of complying with the terms of this article. It is specifically and expressly agreed that any payment of any demand arising hereunder shall be made directly from the Association to the demanding party and at no time shall the Board be obligated to pay out any monies for any reason associated with the provisions of this article. 4. Upon written authorization from the teacher, the Board agrees to make voluntary deductions from the salaries of teachers for mutually agreeable purposes, which shall include but not limited to: A. TBA Education Credit Union: Upon written authorization by the teacher, the Board shall deduct and forward to the TBA Education Credit Union the amounts authorized. B. Tax sheltered annuities...
ASSOCIATION DUES OR FEES AND PAYROLL DEDUCTIONS. A. The Board shall provide annually to the Association a list of teachers employed or to be employed by the Board, along with the full or part time status of each teacher and their salary schedule status. The Board shall provide notification of this same information for any additions or deletions that occur during the year. The Association agrees to defend, indemnify and hold harmless the Public Schools of Petoskey, its Board of Education, individual school board members, past and present, administrative employees and agents, past and present, against any and all claims, demands, costs, suits, damages, awards, judgments or other forms of liability, including but not limited to back pay damages and all court or administrative costs, including unemployment compensation costs, that may arise out of or by reason of any action taken by the Board or its agents for the purpose of complying with the terms of this Article. It is specifically and expressly agreed that any payment of any demand arising hereunder shall be made directly from the Association to the demanding party and at no time shall the Board be obligated to pay out any monies arising out of any claims or demands that are brought or made due to this Article. It is expressly understood that the Association has the right to select counsel, if necessary, for any defense necessary under this Article and shall have the sole discretion regarding the settlement of any claims to which the Association may be responsible. The Association agrees that it will take no action claiming or supporting the claim that its agreements in this section pertaining to defense, indemnification, and holding harmless are void or unenforceable. Further, in the event that it is ever determined that the Association's agreement to indemnify and/or hold harmless is void or unenforceable, this shall not affect the Association's duty to defend and assume all costs and expenses regarding defense.

Any teacher who is a member of the Association, or who has applied for membership, may sign and deliver to the Board an assignment authorizing deduction of Dues, Assessments and Contributions to the Association. Pursuant to such authorization, the Board shall deduct one-ninth of such dues, assessments and contributions from the regular salary check of the teacher each month for nine (9) months, beginning in October and ending in May of each year. (Any teacher who shall not perform services for any entire month of the school year shall have his/her dues reduced by one-ninth of the yearly dues for each entire month he/she did not work, except where the failure to perform services during any month was the result of the teacher taking any paid leave of absence or sick leave provided for in this contract.) B. Upon appropriate written authorization from the teacher, the Board shall deduct from the salary of the teacher and make appropriate remittance for annuities, credit union, saving bonds, charitable donations, or any other plans or programs jointly approved by the Association and the Board. C. This article shall be effective retroactively to the date of the Agreement and all sums payable hereunder shall be determined from said date.

Assessments and contributions will be deducted upon mutual consent of the parties. Such authorization shall continue to be in effect from year to year. Such sum shall be deducted from regular salaries of such teachers and remitted to the Association. B. Upon appropriate written authorization from the teacher, deductions for items of mutual agreement shall be made by the school district and submitted to the proper account. C. All dues collected from members of the Association shall be returned to the Northern Michigan Education Association. The Association shall control and disburse its own funds. D. The Association agrees to indemnify the Inland Lakes School District and save said district harmless from any and all claims, actions, and liabilities arising out of the acts or omissions of said school district and/or its employees in the implementation of this section of the current master contract. E. The Association may annually request salary/step information for each employee as needed for calculation of dues or fees. The District shall provide the information within fifteen (15) business days. Deductions shall be equalized over twenty (20) pays and shall be remitted to the association or its designee monthly as deducted.

Pursuant to such authorization, the Board shall deduct one-tenth of such dues, assessments and contributions from the regular salary check of the participating teacher each month for ten (10) months, beginning in September and ending in June of each year. Any participating teacher who shall not perform services for any entire month of the school year shall have his/her dues reduced by one-tenth of the yearly dues for each month he/she did not work, except where the failure to perform services during any month was the result of the participating teacher taking any paid leave of absence or sick leave provided for in this contract. B. Upon appropriate written authorization from the teacher, the Board shall deduct from the salary of any teacher and make appropriate remittance for annuities, credit union, savings bonds, charitable donations, or any other plans or programs jointly approved by the Association and the Board. Pursuant to such authorization, the Board shall deduct such dues, assessments and contributions from the regular salary check of the teacher each pay period beginning in September. Any teacher who shall not perform services for any entire month of the school year shall not be required to pay dues for each entire month he/she did not work, except where the failure to perform services during any month was the result of the teacher taking any paid leave of absence or sick leave provided for in this contract. The Board will remit the full amount of dues for all members of the Association no later than November 30 of each year. B. Upon appropriate written authorization from the teacher, the Board shall deduct from the salary of any teacher and make appropriate remittance for annuities, credit union, savings bonds, charitable donations, or any other plans or programs jointly approved by the Association and the Board.
