Court Leaves. Leave without loss of salary and benefits shall be granted to an academic staff member subpoenaed to be a witness or juror in Canada. The academic staff member shall notify the Department Head and Xxxx (or administrative equivalent) immediately upon being subpoenaed.

In the event of a court notification falling on an approved leave that immediately precedes or immediately follows a four (4) day (or more) period of pre-scheduled leave of advance credit hours or annual leave (or any combination thereof), then the compensation set out in Article 7(4) (a)(iii) being sixteen (16) hours shall apply.

If Members are required to absent themselves from their duties to appear in court as a result of legal action taken against them in regard to matters arising out of the performance of their duties at the University, they shall not be penalized for such absence. Such an absence shall be governed by paragraph 2 of this Article.
Court Leaves. The Employer will grant a leave with regular salary and benefits to employees summoned to be a juror or subpoenaed to be a witness for the periods requiring absence from the University. The employee will advise the Employer immediately when summoned or subpoenaed and when the employee knows of the periods during which absences will be required. The employee will cooperate with the Employer in an effort to avoid undue interruption of the employee’s responsibilities to students.

Court Leaves. 1. Any Member who is called for jury duty or is compelled by subpoena to attend as a witness or expert before any body in Canada shall be granted a leave of absence with pay (save for a Member on leave of absence without pay).
2. The Member shall notify the immediate supervisor in writing as soon as possible after receiving notification of being called. A copy of the summons and proof of attendance shall be provided by the Member if requested.
3. Members and immediate supervisors shall attempt to make arrangements to ensure that duties are carried out during the period of absence.
4. In the event that a Member is accused of an offence which requires a court appearance, he or she shall be granted a leave of absence without loss of benefits and pay, to which he or she would otherwise be entitled, for the actual time of such an appearance. In the event that the accused Member is jailed awaiting a court appearance, he or she shall receive leave without pay. Should the Member be found not guilty of the offence he/she will be reimbursed lost salary for the period during which he/she was incarcerated. The Member shall have the option of taking annual vacation leave to which he or she is entitled in lieu of all or part of the leave without pay.
5. If a Member is incarcerated following conviction, and the Employer does not elect to discipline the Member, he or she shall be granted Leave of Absence Without Pay for a maximum period of two years. The Member shall have the option of taking annual leave to which he or she is entitled in lieu of all or part of the leave without pay.
6. When Members wish time off in order to pursue a civil action in court, the Members shall apply to the immediate supervisor for a Leave of Absence Without Pay (see Article 3.5).
